A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, AUTHORIZING THE MAYOR OF
THE CITY OF MIAMI BEACH TO ENTER INTO AN
INTER-LOCAL AGREEMENT BETWEEN DADE COUNTY,
THE CITY OF MIAMI, THE CITY OF HIALEAH AND
THE CITY OF MIAMI BEACH AGREEING TO A FORMULA
FOR DISTRIBUTING THE PROCEEDS OF THE LOCAL
OPTION GAS TAX LEVIED BY DADE COUNTY UNDER
THE PROCEDURES OF SUBSECTION ( 3 ) (A) 1 OF
SECTION 336.025, FLORIDA STATUES (1987) .
WHEREAS, the Board of the County Commissioners of Dade
County, Florida has scheduled an ordinance for adoption, pursuant
to Florida Statute Section 336 . 025, imposing an additional tax on
every gallon of motor fuel and special fuels sold within Dade
County; and
WHEREAS, it is recommended to the Board of County
Commissioners that six-cent ( $0 . 06 ) local option gas tax be
imposed pursuant to Section 336 . 025, Florida Statutes; and
WHEREAS, it is recommended that the current Inter-
local Agreements between the County and those cities representing
a majority of the residents of the incorporated area of
Metropolitan Dade County be renewed; and
WHEREAS, pursuant to the Inter-local Agreements, the
proceeds of the local option gas tax, levied and imposed pursuant
to the Dade County Ordinance, shall be allocated on the basis of
seventy-four percent (74%) to the County and twenty-six percent
( 26%) to be distributed among the incorporated municipalities in
Dade County who are eligible under Section 336 . 025 ( 6) , Florida
Statutes . Net proceeds shall be the amount less the cost of
collection by the Florida Department of Revenue.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City
Commission of the City of Miami Beach supports the renewal of the
local option gas tax pursuant to the terms and conditions of the
existing and proposed Inter-local Agreements .
BE IT ALSO DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the City Commission of the
City of Miami Beach, Florida duly authorize the Mayor and is
hereby directed to enter into an Inter-local Agreement between
Metropolitan Dade County, the City of Miami , and the City of
Hialeah.
