A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A NEGOTIATED CONTRACT ON BEHALF
OF THE CITY WITH GEORGE HYMAN
CONSTRUCTION COMPANY FOR TOPA
RECONSTRUCTION.
WHEREAS, George Hyman Construction Company, the sole bidder,
submitted a base bid to the City of Miami Beach which was in
excess of the Construction Cost Budget for TOPA Reconstruction
Bid No. 12-87/87 (the "Project") by $2 . 77 million; and
WHEREAS, the City of Miami Beach City Code, Section 31A-
11 (c) ,
1A-11 (c) , authorizes the City to negotiate with a sole bidder; and
WHEREAS, Contractor and City negotiated certain changes in
project scope, certain changes in the Special Provisions of the
Contract, and changed the method of pricing the Project from a
Lump Sum Price to a Guaranteed Maximum Price; and
WHEREAS , the parties wish to enter into a contract
reflecting the above described changes but otherwise retaining
the terms and conditions of the Bid Documents; and
WHEREAS, Temple Emanu-El requested that the TOPA facility be
made available for the High Holy Days on 9/12 and 9/13/88 (8 : 00
A.M. to 1: 00 P.M. ) and 9/21/88 , and Contractor will meet the
electrical subcontractor to determine the availability of air
conditioning and lighting at that time; and
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, to authorize the Mayor and City
Clerk to execute a negotiated contract on behalf of the City with
George Hyman Construction Company for TOPA Reconstruction.
PASSED and ADOPTED this 10th day of June , 1988 .
