A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,
APPROVING THE FIRST AMENDED AND RESTATED
ACQUISITION AGREEMENT BETWEEN THE CITY OF
MIAMI BEACH AND THE SCHOOL BOARD OF DADE
COUNTY, FLORIDA FOR THE EXPANSION AND RE-
OPENING OF THE SOUTH POINTE ELEMENTARY
SCHOOL ; AND AUTHORIZING THE MAYOR TO
EXECUTE THE FIRST AMENDED AND RESTATED
AGREEMENT.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA,
WHEREAS, the City Commission previously approved the
expansion and re-opening of the South Pointe Elementary School ;
and
WHEREAS, the City of Miami Beach ("City") and the School
Board of Dade County, Florida ("Board") entered into an
Acquisition Agreement ("Agreement") on February 2 , 1987 , pursuant
to City Commission Resolution No. 86-18712 passed on December 17 ,
198: ; and
WHEREAS, the City and the Board have renegotiated the
Agreement to provide primarily, that (1) the Board will receive
fee simple title to the acquired parcels rather than lease them,
and (2) the Board will reimburse the City for acquisition,
demolition, and relocation costs of the parcels, up to $2
million; and
WHEREAS, the negotiated changes are reflected in the
attached First Amended and Restated Acquisition Agreement, which
has been recommended by the City Manager and form approved by the
City Attorney.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, the First Amended and Restated Acquisition
Agreement is approved for the expansion and re-opening of the
South Pointe Elementary School and the Mayor is authorized to
execute the First Amended and Restated Acquisition Agreement
attached hereto.
