2019-30803 Resolution RESOLUTION NO. 2019-30803 A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATIONS OF THE MAYOR'S PANEL ON OCEAN DRIVE — SAFETY, SECURITY AND INFRASTRUCTURE SUBCOMMITTEE, TO REQUIRE MORE AGGRESSIVE ENFORCEMENT OF QUALITY OF LIFE OFFENSES THROUGHOUT • THE YEAR; AND DIRECTING THE ADMINISTRATION TO IDENTIFY RESOURCES AND POLICY RECOMMENDATIONS THAT COULD BE UTILIZED TO MITIGATE QUALITY OF LIFE CONCERNS FOR FUTURE HIGH IMPACT PERIODS; AND FURTHER DIRECTING THE ADMINISTRATION TO UPDATE THE REVENUE AND EXPENDITURE REPORT FOR THE OCEAN DRIVE MXE DISTRICT AND IDENTIFY OPPORTUNITIES FOR ACHIEVING FINANCIAL EFFICIENCIES AND CONDUCTING ADDITIONAL OUTREACH. WHEREAS, the protection of the health, safety and general welfare of the City's residents and visitors is one of the fundamental functions performed by the City; and WHEREAS, visible signs of crime and civil noncompliance create an environment that encourages further crime and disorder, including serious crimes; and WHEREAS, at the April 4, 2019 meeting of the Mayor's Panel on Ocean Drive — Safety, Security and Infrastructure Subcommittee ("Subcommittee"), the Subcommittee recommended that the City pursue more aggressive enforcement throughout the year with respect to violations of open container laws, marijuana laws, underage drinking, noise and quality of life offenses, in order to convey to the City's residents and visitors that such misconduct will not be tolerated; and WHEREAS, due to its domestic and international popularity as a resort destination, many large-scale events occur on City property and/or on the City's public beaches, also referred to as "High Impact Periods" in accordance with the City Code; and WHEREAS, the City has seen an increasingly large number of visitors during these High Impact Periods, and the sizeable number of individuals attending these events has posed numerous challenges for the City; and WHEREAS, authorized and unauthorized uses of the beaches and City property during High Impact Periods have caused extensive damage, personal injury, property degradation, and have dramatically affected the quality of life of the City's residents; and WHEREAS, such High Impact Periods have the potential to give rise to elevated levels of criminal activity, excessive noise, and disturb the surrounding neighborhoods and negatively affect nearby businesses and residents; and WHEREAS, at the April 4, 2019 Subcommittee meeting, the Subcommittee recommended that the Administration reflect on previous High Impact Periods and identify tools, policies and resources that could be utilized on an ongoing basis to mitigate the adverse quality of life impacts of future High Impact Periods; and WHEREAS, in collaboration with the Subcommittee, the Ocean Drive Association ("ODA") works to continue the vision of Ocean Drive as America's first American Riviera and the first Historic architectural district in Miami Beach; in addition to enhancing the experience for the residents and visitors to the Ocean Drive neighborhood; and WHEREAS, at the April 4, 2019 Subcommittee meeting, representatives of the ODA recommended that the Administration update the revenue and expenditure report for the Ocean Drive MXE District to potentially incorporate feedback provided by the ODA and identify opportunities for achieving financial efficiencies and conducting additional outreach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendations of the Mayor's Panel on Ocean Drive – Safety, Security and Infrastructure Subcommittee, to require more aggressive enforcement of quality of life offenses throughout the year; and directing the Administration to identify resources and policy recommendations that could be utilized to mitigate quality of life concerns for future High Impact Periods; and further directing the Administration to update the revenue and expenditure report for the Ocean Drive MXE District and identify opportunities for achieving financial efficiencies and conducting additional outreach.
