A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A NEGOTIATED CONTRACT ON BEHALF
OF THE CITY WITH GEORGE HYMAN
CONSTRUCTION COMPANY FOR THE STEPHEN MUSS
CONVENTION CENTER EXPANSION - WEST SIDE
WRAP-AROUND, FOR A LUMP SUM PRICE OF
$15,750,000.
WHEREAS, George Hyman Construction Company, the sole
bidder, submitted a base bid to the City of Miami Beach which was
in excess of the Construction Cost Budget for the Stephen Muss
Convention Center Expansion - West Side Wrap-Around, Bid No. 141-
87/89
41-
87/89 (the "Project") ; and
WHEREAS, the City of Miami City Code, Section 31A-11 (c) ,
authorizes the City to negotiate with a sole bidder, and the City
Commission authorized negotiations with the Contractor on
December 9, 1988 ; and
WHEREAS, Contractor and City negotiated certain changes in
the Scope of Work, certain changes in the Special Provisions of
the Contract, and certain changes in the General Conditions of
the Contract; and
WHEREAS, the parties wish to enter into a contract
reflecting the above described changes, but otherwise retaining
the terms and conditions of the Bid Documents for a Lump Sum
Price of $15, 750, 000 ; and
WHEREAS, funds for the above contract award are available
from Bond Fund 358 ($11, 750, 000) , and on interim basis, a loan
($4 , 000, 000) from the General Obligation Bond Debt Service
Account, to be repaid from the proceeds of the issuance of
Convention Center Completion Bonds, funded from the Convention
Development Tax.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, to authorize the Mayor and City
Clerk to execute a negotiated contract on behalf of the City with
George Hyman Construction Company for the Stephen Muss Convention
Center Expansion - West Side Wrap-Around for a Lump Sum Price of

$15,750, 000, with funding appropriated from Bond Fund 358
($11,750, 000) , and on interim basis, a loan ($4 , 000, 000) from the
General Obligation Bond Debt Service Account, to be repaid from
