A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, RECOGNIZING THE NEEDS OF
THE RESIDENTS LIVING IN THE AREA SELECTED FOR THE
SOUTH POINTE ELEMENTARY SCHOOL LAND ACQUISITION
PROJECT; PROVIDING FOR THEIR POSSIBLE
COMPENSATION, BASED UPON THEIR PROPERTY INTEREST;
AND PROVIDING FOR THE USE OF THE SOUTH POINTE
ELEMENTARY SCHOOL LAND ACQUISITION PROJECT
BOND FUND.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
WHEREAS, in Resolutions 1187-19007, 88-19212 and 88-19415, the City
Commission approved the acquisition of certain properties for the South Pointe
Elementary School Land Acquisition Project; and,
WHEREAS, as of December 28, 1988, the City of Miami Beach has acquired
title to the subject properties; and,
WHEREAS, the acquisition will necessitate the relocation of certain
residents currently residing in the subject properties; and,
WHEREAS, it is the intention of the City to compensate fully all those
persons entitled to compensation; and,
WHEREAS, the City desires to pay relocation benefits to those qualified
residents eligible for such benefits.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that: 1) All of the above recitals
are true and correct, 2) The City Commission hereby directs the City Manager to
issue benefits to those residents determined to be eligible in the following
manner: The tenant shall be allowed to occupy his/her current rental unit until
June 1, 1989 without paying rent to the City; additionally, the City will provide a
direct payment to any such tenant upon vacating the applicable rental unit. Said
payment shall be equal to one and one-half (1 1/2) times the normal monthly
rental fee. All tenants will be required to vacate their rental unit on or before
June 1, 1989; and 3) Payments will be made from the South Pointe Elementary
School Land Acquisition Project Bond Fund, and costs are estimated not to
exceed $15,000.
