WHEREAS, the City Commission of the City of Pembroke Pines (the "City") desires to encourage full participation by all individuals of all backgrounds who are interested in being appointed to City Advisory Boards; and WHEREAS, the City is one of South Florida's most diverse cities; and WHEREAS, strengthening community connections among diverse groups, fostering cultural activity, and creating heritage projects and programs will enhance life and activity within the City; and WHEREAS, over the years, volunteer Diversity and Heritage Committee members have donated countless hours to make thoughtful recommendations to the City Council about how best to move forward with ethnic community engagement and strongly recommended the formation of a permanent advisory board to the City; and WHEREAS, the City Commission finds that recognizing and formalizing the Diversity and Heritage Committee into a formal City Advisory Board is in the best CODING: Words in strike through type are deletions from existing law; Words in underlined type are additions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, THAT: SECTION 1. The foregoing "WHEREAS" clauses are hereby ratified as true and correct, and incorporated herein by this reference. SECTION 2. Chapter 32, entitled "Departments, Boards and Commissions," of the City of Pembroke Pines Code of Ordinances, is hereby amended by specifically creating a Diversity and Heritage Advisory Board, as follows: Diversity and Heritage Advisory Board Sec. 32.190 Establishment and Mission (a) There is hereby established a Board to be known as the "Diversity and Heritage Advisory Board." (b) The mission of the Diversity and Heritage Advisory Board is to promote awareness and to celebrate the rich Heritage and the vast Diversity of the City of Pembroke Pines. Sec. 32.191 Duties and Responsibilities The Diversity and Heritage Advisory Board shall have the following powers and duties: (1) Recommendations to the commission on diversity and equity strategies that strengthen connections among diverse community groups and with city government. Page 2 of 5 PROPOSED ORDINANCE NO. 2019-10 ORDINANCE NO. 1928 (2) Recommendations to the commission on exploring new methods and techniques to acknowledge tangible and intangible cultural heritage and expand recognition programs related to heritage preservation activities. (3) Recommendations to the commission, on ways to work with public and private stakeholders in the City to increase understanding of the diverse groups that make up the City. Sec. 32.192 Composition and Quorum (a) The Diversity and Heritage Advisory Board consists of fifteen (15) regular members and two (2) alternates, who live or conduct business in the city, with a strong commitment to the mission of the Diversity and Heritage Advisory Board. The Mayor and each City Commissioner shall appoint three (3) regular members. The Mayor shall appoint the two (2) alternates. (b) Eight (8) voting members in attendance shall constitute a quorum of the Board. Sec. 32.193 Meetings The Diversity and Heritage Advisory Board shall meet at least once per quarter or on an as needed basis. Other meetings may be held as necessary to carry out the duties and responsibilities of the Board. Sec. 32.194 Board Action Advisory Only The actions, decisions and recommendations of the Diversity and Heritage Advisory Board shall not be final or binding on the City Commission, but shall be advisory only. Sec. 32.195 Assistance to the Board The City Clerk or his/her designee shall act as secretary to the Board and be res.onsible for .rovidin• the items necessa for conduction meetin.s as re.uested by the Chair of the Board, and for recording and preparation of meeting minutes. It is the intention of the City Commission of the City of Pembroke Pines that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Pembroke Pines, Florida, and that the Sections of this ordinance may be renumbered, re-lettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4. If any clause, section, or other part or application of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect. SECTION 5. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 6. The City Attorney clarified that the commission did not have to make formal appointments tonight. Mayor and Commissioner Siple named their appointees but Commissioner Castillo asked that the Notice of Vacancy continue to be advertised and he would invite applications to be submitted for appointment on August 7,2019. Commissioner Schwartz recommended the setting of the date for the first Diversity&Heritage Committee meeting some time in the third week of August. On May 15, 2019 Commissioner Castillo introduced an item with a motion to discuss and direct the creation of a permanent, on-going city effort demonstrating respect for community diversity by creating a diversity advisory board charged with recommending policies, identifying heroes in promoting American and international diversity and civil rights; statuary and tributes to luminaries in diversity, located in City parks, and properties; events and activities promoting civic unity and strength through increased celebration of the City's diversity. 2. The Commission agreed by consensus to direct the City Attorney to draft an City of Pembroke Pines,FL Page 2 Printed on 6/20/2019 Agenda Request Form Continued(2019-10) ordinance that would not only embrace the previous community status of the Diversity and Heritage Committee, but would augment the status of the board to a formal diversity advisory committee with numbers of members per City commission district,to be brought back before Commission for review. 3. Over the years, volunteer Diversity and Heritage Committee members have donated countless hours to make thoughtful recommendations to the City Commission about how best to move forward with ethnic community engagement, and strongly recommended the formation of a permanent advisory board to the City. 4. The City Commission finds that recognizing and formalizing the Diversity and Heritage Committee into a formal City Advisory Board is in the best interests of the citizens and residents of the City. 5.
