A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT
TO THE AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND THE MIAMI DESIGN PRESERVATION
LEAGUE, INC. ADOPTED BY RESOLUTION 87-19024 TO
PROVIDE FOR AN EXTENSION OF THE TERM OF THE
AGREEMENT TO AUGUST 31, 1989
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
WHEREAS, the City of Miami Beach and the Miami Design
Preservation League, Inc. on October 1, 1987, entered into an
Agreement for the purpose of funding the operation of a Welcome
Information Center as a special economic development activity; and
WHEREAS,the Miami Design Preservation League, Inc. represents
that contractual goals can be successfully achieved by August 31,
1989 ; and
WHEREAS,the parties to the Agreement are desirous of amending
the Agreement; and
WHEREAS, the Agreement makes provisions for modifying said
Agreement by an amendment thereto; and
WHEREAS, the City Commission deems it to be in the best
interest of the City, its residents and citizens that said
Amendment be entered into;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that. the Mayor and City Clerk are
hereby authorized and directed to execute the Amendment to the
Agreement with the Miami Design Preservation League, Inc. , in the
name of and on behalf of the City to provide for an extension of
the term of the Agreement to August 31, 1989 .

AMENDMENT TO AGREEMENT
This amendment to agreement made and entered into this
7th day of April, 1989, pursuant to the terms of the agreement
entered into by and between the City of Miami Beach, a Florida
municipal corporation, hereinafter called the "City" , and the Miami
Design Preservation League, Inc. (the "Agreement") .
WITNESSETH
WHEREAS, the parties are desirous of modifying the terms and
certain provisions of the Agreement authorized by Resolution Number
87-19024 of the City Commission of Miami Beach; and
WHEREAS, the Agreement makes provisions for modifying said
Agreement by an amendment thereto; and
WHEREAS, the City Commission of the City of Miami Beach by
Resolution Number 89-19578 dated April 5, , 1989,
has authorized these modifications to the Agreement with the Miami
Design Preservation League, Inc. , as an amendment to said
Agreement:
NOW, THEREFORE, the parties to the Agreement do hereby agree
as follows:
1. "SECTION III: TERM OF AGREEMENT" , Paragraph Two on Page 3 of
the Agreement is hereby amended to read as follows:
"This project shall become operational as of October 1, 1987 ,
and shall continue through August 31, 1989. "
2 . It is understood and agreed by the parties hereto that none
of the other terms and conditions of the Agreement are changed or
modified and it is agreed that said other Sections shall continue
until said Agreement is terminated under the Termination Provision
of Agreement.
IN WITNESS WHEREOF, the parties hereto have hereunto caused these
presents to be signed in their names by their duly authorized
officers and principals, attested by their respective witnesses and
City Clerk on the day and year first herein above written.

BACKGROUND:
On October 1, 1987, the City of Miami Beach entered into an
Agreement with the Miami Design Preservation League, Inc. (MDPL)
for the purpose of funding a Welcome Information Center as a
Special Economic Development activity funded under the Community
Development Block Grant Program.
During this past year, the City and the MDPL have been working to
provide the U.S. Department of Housing and Urban Development (HUD)
with the documentation necessary to clear a finding that involved
the eligibility of assistance provided for the Welcome Center under
the provisions of 24 CFR 570. 203 (b) .
On March 6, 1988 , the City received a letter from HUD indicating
that the final documentation transmitted by the City is
satisfactory to clear the finding. Since no funds were able to be
expended on this activity until the finding was cleared, it is now
necessary to extend the term of the Agreement to August 31, 1989,
in order for contractual goals to be successfully achieved by the
MDPL.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission approve the
Resolution authorizing an amendment to the Agreement between the
City of Miami Beach and the Miami Design Preservation League, Inc. ,
adopted by Resolution 87-19024 to provide for an extension of the
term of the Agreement to August 31, 1989 .
