RESOLUTION 89-19607 RESOLUTION NO. 89-19607 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE LEGISLATURE OF THE STATE OF FLORIDA TO APPROPRIATE FUNDS FOR THE CONSTRUCTION OF ADDITIONAL JAIL FACILITIES IN DADE COUNTY AND OTHER COUNTIES LACKING ADEQUATE FACILITIES TO INCARCERATE FELONS AND HABITUAL MISDEMEANANTS AND TO ENACT LEGISLATION PROVIDING FOR MANDATORY JAIL TIME FOR HABITUAL MISDEMEANANTS, AND PROVIDING THAT HABITUAL MISDEMEANANTS WHO HAVE BEEN ARRAIGNED AND ARE AWAITING TRIAL NOT BE RELEASED UNLESS THEY PROVIDE VERIFIABLE ADDRESSES AT WHICH THEY MAY BE SERVED FOR TRIAL. WHEREAS, the City Commission of the City of Miami Beach, Florida, is aware that there exist within the City persons who habitually molest and disturb the peace of the elderly and other citizens in violation of ordinances of the City of Miami Beach; and WHEREAS, the City Commission is aware that said habitual misdemeanants are continually arrested and released without serving jail time; and WHEREAS, the City Commission is also aware that habitual misdemeanants who have been arrested and arraigned often fail to furnish true addresses at which they may be served for trial at a later date and thereby successfully evade prosecution; and WHEREAS, the City Commission also recognizes that habitual misdemeanants as well as felons who have committed non-violent crimes are often released without serving jail time due to the lack of space in jail facilities in Dade County and other populous counties in the State of Florida. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission urges the Legislature of the State of Florida to appropriate funds for the construction of additional jail facilities in Dade County and other counties lacking adequate facilities to incarcerate felons and habitual misdemeanants and to enact legislation providing for mandatory jail time for habitual misdemeanants and providing that 1 habitual misdemeanants who have been arraigned and are awaiting trial not be released unless they provide verifiable addresses at which they may be served for trial.
