RESOLUTION 89-19622 RESOLUTION NO. 89-19622 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SUPPORTING UNITED STATES SENATE RESOLUTION NO. 114 AND UNITED STATES HOUSE RESOLUTION 141 URGING THE BANKRUPTCY COURT TO TAKE ALL APPROPRIATE ACTIONS INCLUDING THE APPOINTMENT OF AN INDEPENDENT TRUSTEE TO RESTORE EASTERN AIRLINES TO FULL OPERATIONS PENDING SALE OF THE COMPANY, AND SUPPORTING THE GREATER MIAMI CITIZENS FOR JUSTICE AT EASTERN IN THEIR EFFORTS TO ENCOURAGE A SPEEDY AND JUST RESOLUTION OF THE CRISIS AT EASTERN AIRLINES. WHEREAS, the operations of Eastern Airlines have been substantially shutdown since March 4 , 1989, due to a strike by the International Association of Machinists which has been supported by the pilots and flight attendant unions; and WHEREAS, Eastern Airlines filed a petition under Chapter 11 of the United States Bankruptcy Code on March 9 , 1989 ; and WHEREAS, a recently proposed agreement for the sale of Eastern Airlines has expired for failure of the parties to agree on the management of Eastern until a new owner could assume control ; and WHEREAS, the Bankruptcy Court has the power to appoint an independent trustee to manage Eastern' s return to full operations during the interim period, pending an agreement for sale of Eastern Airlines and transfer of control to a potential owner; and WHEREAS, ten thousand Eastern families have lost regular paychecks and said loss is being felt by local businesses large and small as well as by the employees and their families; and WHEREAS, hotels, restaurants and recreation-related businesses in the City of Miami Beach and throughout Dade County which depend heavily on visitors and tourists are suffering a heavy falloff of business due to the shutdown of Eastern Airlines; and WHEREAS, Florida' s Senator, Bob Graham has introduced United States Senate Resolution No. 114 urging the Bankruptcy Court to take all appropriate actions including the appointment of an independent trustee to restore Eastern Airlines to full operations pending sale of the Company, and United States House Resolution No. 141 has also been introduced proposing this interim solution; 1 and WHEREAS, a local ad hoc group, Greater Miami Citizens for Justice at Eastern, has formed to support a speedy and just resolution to the Eastern Airlines crisis and to support Senate Resolution No. 114 and House Resolution 141; and WHEREAS, the return of Eastern Airlines to full operations is in the public interest and in the best interest of the creditors, employees and customers of Eastern Airlines as well as the economy of the City of Miami Beach and other communities, States and regions of the country formerly served by Eastern Airlines. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission supports United States Senate Resolution No. 114 and United States House Resolution 141 urging the Bankruptcy Court to take all appropriate actions including the appointment of an independent trustee to restore Eastern Airlines to full operations pending sale of the Company, and also supports the Greater Miami Citizens For Justice At Eastern Airlines in their efforts to encourage a speedy and just resolution of the crisis at Eastern Airlines. Baker 30N 30 1989 1700 Convention Center Drive Miami Beach, Florida 33119 Time — Dear Elaine: Thank you for contacting my office regarding the welfare of Eastern Airlines and its employees . As a Floridian, I share your concerns about the impact this situation will have on Florida ' s economy and the future of the airline . In response to the problems facing Eastern, I have followed closely the efforts of the National Mediation Board and have been in constant contact with all the parties in the negotiations. It was my hope that an agreement could be reached to enable Eastern to once again become a strong, economically viable airline, responsive to the needs of its customers and employees. After over 16 months of negotiations, a lengthy strike, and the reality of bankruptcy, it is apparent that an immediate solution is not forthcoming. I had hoped that the President Bush would exercise his power under the Railway Labor Act and appoint an Emergency Board to review the dispute and make recommendations for a resolution. I supported the House' s legislation calling on the President to take this action . On June 2, 1989, the Senate unanimously passed a Sense of the Senate Resolution 114 , encouraging the involved parties to resolve the dispute expeditiously. The resolution, which I introduced, recommended the use of a court-ordered trustee during this interim period if necessary. Delay serves no one -not the travelling public , not Eastern employees or investors, and certainly not our aviation system. Eastern is one of the many important corporate citizens of Florida, and it is difficult to imagine Florida without Eastern Airlines.
