A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, PROVIDING FOR THIRD AMENDMENT TO THE
GENERAL FUND BUDGET FOR FY 1988/89; MAKING PROVISIONS
FOR: 1) PURCHASE OF SEMI-AUTOMATIC WEAPONS - $134,898;
2) PAYMENT FOR LEGAL COUNSEL ON THE HOMESTEAD ISSUE -
$55,000; 3) RETAINING OF A HEARING OFFICER REGARDING THE
HOMESTEAD ISSUE - $30,000; AND, 4) PROVIDING FOR A CITY
PSYCHOLOGIST - $4,000.
WHEREAS, The Police Department is in the process of replacing the standard
service revolver with a semi -automatic pistol ; and,
WHEREAS, on June 14, 1989, the City Commission engaged the services of
both Robert Shevin and David Nevel , as co-counsel , to research and make
recommendations regarding the process of appeal relating to the Homestead Case
and it is now determined that $55,000 is required to pay for those services;
and,
WHEREAS, on July 26, 1989, the City Commission adopted Resolution No. 89-
19669 appointing Judge Seymour Gelber as Hearing Officer on the Homestead Issue
with total fees not to exceed $30,000; and,
WHEREAS, the City has engaged the services of a City Psychologist on a
part-time basis at an annual cost of $36,000 and funding in the amount of $4,000
is required for the remainder of the fiscal year.
WHEREAS, funding in the amount of $134,898 is available from the proceeds
of Federal asset sharing resulting from a joint Federal -municipal drug case for
the purchase of the weapons and $89,000 from the General Fund Balance for the
remaining increase in appropriations.
BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, that the City Commission of the City of Miami Beach hereby amends the
FY 1988/89 General Fund Budget, as summarized herein and listed below.

SUBJECT: A RESOLUTION PR I V I D I NG FOR THE THIRD AMENDMENT TO THE FY 1988/89
GENERAL FUND BUDGET.
The attached Resolution provides for the third amendment to the FY 1988/89
General Fund Budget:
1. POLICE DEPARTMENT - $134,898
The City of Miami Beach's Police Department is in the process of replacing
the standard service revolver with a semi-automatic pistol . In order to
accomplish this, it is necessary to increase funding for the Department.
Funds in the amount of $134,898 is available from the proceeds of Federal
asset sharing resulting from a joint Federal -municipal drug case.
2. OFFICE OF MAYOR AND COMMISSION - $55,000
On June 14, 1989, the City Commission engaged the services of both Robert
Shevin and David Nevel ,. as co-counsel , to research and make recommendations
regarding the process of appeal relating to the Homestead Case. At the time
of appointment a source of funding was not identified. To date, the City has
received invoices for services totalling $47,949.33 (Shevin - $37,599.33;
Nevel - $10,350) with an indication of additional charges should further
services be requested.
Funding in the amount of $55,000 is available from General Fund Balance and
includes a contingency of $7,050.67
3. OFFICE OF THE CITY MANAGER - $34,000
A. On July 26, 1989, the City Commission adopted Resolution No. 89-19669
appointing Judge Seymour Gelber as Hearing Officer on the Homestead Issue.
This appointment included total fees not to exceed $30,000 and was not
previously identified.
Funding in the amount of $30,000 is available in the General Fund Balance.
B. The City has engaged the services of a City Psychologist on a part-time
basis at an annual cost of $36,000. Funding for this position is not
provided for in the budget.
Funding in the amount of $4,000 is required for the remainder of the fiscal
year and is available in the General Fund Balance.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt the attached
resolution which provides for the third amendment to the FY 1988/89 Budget for24
the General Fund.
