RESOLUTION 89-19715 RESOLUTION NO. 89-19715 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REPEALING RESOLUTION NO. 89-19693 WHICH CALLED FOR A PUBLIC HEARING TO CONSIDER AN AMENDMENT TO THE COMPREHENSIVE ZONING ORDINANCE NO. 1891; AMENDING SUBPART B. 2 OF SUBSECTION 7-1 ENTITLED "CONDITIONAL USES" OF SECTION 7 ENTITLED "SUPPLEMENTARY USE REGULATIONS" , PROVIDING THAT EXTENSIONS OF TIME FOR APPROVED ACLF'S TO OBTAIN A BUILDING PERMIT, CERTIFICATE OF OCCUPANCY, CERTIFICATE OF COMPLETION OR OCCUPATIONAL LICENSE SHALL ONLY BE APPROVED BY A FIVE SEVENTHS (5/7) VOTE OF THE CITY COMMISSION; AND ALSO TO CONSIDER AN ALTERNATIVE AMENDMENT PROPOSED BY THE PLANNING BOARD CONCERNING SUBPART B. 2 OF SUBSECTION 7-1 ENTITLED "CONDITIONAL USES" OF SECTION 7 ENTITLED "SUPPLEMENTARY USE REGULATIONS" , ESTABLISHING NEW TIME LIMITATIONS FOR APPROVED ACLF'S TO OBTAIN A BUILDING PERMIT, CERTIFICATE OF OCCUPANCY, CERTIFICATE OF COMPLETION OR OCCUPATIONAL LICENSE AND PROVIDING NEW PROCEDURES FOR APPROVED ACLF'S TO OBTAIN EXTENSIONS OF TIME LIMITATIONS FROM THE PLANNING BOARD. WHEREAS, on July 26, 1989 the Miami Beach City Commission passed Resolution No. 89-19693 which called for a public hearing to be held on October 4, 1989 to consider an amendment to the Comprehensive Zoning Ordinance No. 1891; amending Subpart B. 2 of Subsection 7 . 1 entitled "Conditional Uses" of Section 7 entitled "Supplementary Use Regulations" , providing that extensions of time for approved ACLF' s to obtain a building permit, certificate of occupancy, certificate of completion or occupational license shall only be approved by a five sevenths (5/7) vote of the City Commission; and also to consider an alternative amendment proposed by the Planning Board concerning Subpart B. 2 of Subsection 7-1 entitled "Conditional Uses" of Section 7 entitled "Supplementary Use Regulations" , establishing new time limitations for approved ACLF' s to obtain a building permit, certificate of occupancy, certificate of completion or occupational license and providing new procedures for approved ACLF' s to obtain extensions of time limitations from the Planning Board; and 1 WHEREAS, the subject matter of said public hearing of October 4 , 1989 has been included in the Proposed Zoning Ordinance set for public hearings at 5: 00 p.m. on September 7, 1989 and September 21, 1989 ; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Resolution No. 89-19693 is hereby repealed. Park1r ,..-C ,,, APs City Manager er SUBJECT: REQUEST TO RE 'EAL PUBLIC HEARING PERTAINING TO EXTENSIONS OF TIME FOR ADULT CONGREGATE LIVING FACILITY (ACLF) BACKGROUND July 26, 1989 Planning Board includes language in the proposed Zoning Ordinance pertaining to the extension of time for Adult Congregate Living Facilities. Aug. 31, 1989 Zoning Ordinance Review Committee approves amendment to the proposed Zoning Ordinance. PLANNING BOARD ACTION In recognition of the Commission' s concerns toward applicants who obtain extensions of time but do not build, the Planning Board recommended an amendment to the proposed Zoning Ordinance which creates specific time limitations for an ACLF to obtain a Building Permit and an Occupational License. The Planning Board felt that the new language in the proposed Zoning Ordinance addressed the City Commission' s concerns regarding extensions of time. ADMINISTRATION RECOMMENDATION It is recommended that the City Commission not hold a Public Hearing regarding this matter by repealing Resolution No. 89-19693 . a:aclf 26 • AGENDA ITEM _ — F— .
