RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR
AND THE CITY CLERK TO EXECUTE A FIRST
AMENDMENT TO A LEASE AGREEMENT BETWEEN THE
CITY OF MIAMI BEACH AND THE MIAMI BEACH JEWISH
COMMUNITY CENTER, INC. FOR USE OF A PORTION OF
THE PARKING LOT AT 65TH STREET AND INDIAN
CREEK DRIVE FOR THE CONSTRUCTION AND OPERATION
OF A ROWING FACILITY
WHEREAS, pursuant to City Commission Resolution No. 88-19458 ,
the City of Miami Beach and the Miami Beach Jewish Community
Center, Inc. entered into a lease agreement for use of a portion
of the parking lot at 65th Street and Indian Creek Drive for the
construction and operation of a rowing facility; and
WHEREAS, the Lessee wishes to enlarge the area of the leased
premises to accommodate expanded participants in the rowing
programs to be conducted at the Premises; and
WHEREAS, the City Manager has prepared a First Amendment to
the Lease Agreement, to revise the description of the area to be
utilized by the Lessee for its rowing related activities as
described on Exhibit A of the Lease Agreement and the City Attorney
has approved it as to form.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are
hereby authorized to execute the First Amendment to the Lease
Agreement between the City of Miami Beach and the Miami Beach
Jewish Community Center, Inc. for use of a portion of the municipal
parking lot at 65th Street and Indian Creek Drive for the
construction and operation of a rowing facility.

SUBJECT: FIRST AMENDMEN TO MODIFY THE SITE PLAN OF THE LEASE
AGREEMENT WITH MIAMI BEACH JEWISH COMMUNITY CENTER,
INC. FOR USE OF A PORTION OF THE PARKING LOT AT 65TH
STREET AND INDIAN CREEK DRIVE
HISTORY:
Pursuant to City Commission Resolution Number 88-19458 , the City
entered into a lease agreement with the Miami Beach Jewish Community
Center, Inc. for the use of a portion of the parking lot located at
65th Street and Indian Creek Drive. Under the Lease Agreement the
Jewish Community Center will construct and operate a rowing facility
building upon the premises. The Lease Agreement provides for a five
(5) year term, expiring December 31, 1993 , with one five (5) year
renewal option.
Recently representatives of the University of Miami Athletic
Department' s rowing program expressed interest in participating in
the Jewish Community Center' s program on the premises. Additionally,
the Jewish Community Center has receivednotification of interest
from other rowing organizations to conduct special teaching rowing
events, competitive rowing events and other related rowing
activities on the site.
The Lessee wishes. to enlarge the area ' s of the leased premises in
order to accommodate the increased participation in its programmatic
activities.
The Lessee anticipates constructing a temporary structure on the
premises from which to operate its programmatic activities for a
period not to exceed twenty four (24) months, pending completion of
fund raising and construction activities for the permanent
structure.
The Land Use Committee reviewed the proposed First Amendment to the
Lease Agreement at its meeting on November 9 , 1989 .
TERMS AND CONDITIONS:
To accommodate the additional participants in the programmatic
activities of the Jewish Community Center at the site, modifications
to the site plan have been prepared and are described on the
attached "Revised Exhibit A - Survey of Site, Dated November 9th,
1989" .
ADMINISTRATION RECOMMENDATION:
The City Administration recommends that the City Commission approve
a Resolution approving the First Amendment to the Lease Agreement
with the Miami Beach Jewish Community Center, Inc. , to modify the
site plan for use of the parking lot at 65th Street and Indian Creek
Drive. 5

THIS FIRST AMENDMENT TO LEASE AGREEMENT, made and entered into
this e2/ day of , 1989, by and between the CITY OF
MIAMI BEACH, a municipal corporation, hereinafter referred to as
the "Lessor" and MIAMI BEACH JEWISH COMMUNITY CENTER, INC. , a
private not-for-profit corporation registered in the State of
Florida, hereinafter referred to as "LESSEE. "
WITNESSETH
WHEREAS, pursuant to City Commission Resolution No. 88-19458 ,
the Lessor and Lessee entered into an Agreement (hereinafter
ref e, ~ed to as "LEASE AGREEMENT") dated December 9 , 1988 , for the
lease of certain real property (hereinafter described as the
Premises) particularly described in Exhibit "A" of said Lease
Agreement; and
WHEREAS, the rowing program of the University of Miami will
become a participant in the Miami Beach Jewish Community Center
rowing program at the Premises; and
WHEREAS, the rowing facility building constructed by the
Lessee will be used for developing special teaching rowing events,
competitive rowing events and other related rowing activities ; and
T'HEREAS, the Lessee wishes to enlarge the area of the Premises
as 'c .:ribed in Exhibit A of the L( ,se Agreement to accommodate the
expanded program participants.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, and other good and valuable consideration, the
receipt of which is hereby acknowledged, the parties hereby agree
as follows:

1. Exhibit A attached to the Lease Agreement is hereby amended
and replaced with the "Revised Exhibit A - Survey of Site,
Dated November �� , 1989" attached hereto and made apart
hereof for all purposes.
2 . The parties hereby ratify and confirm all other terms and
conditions of the Lease Agreement which remain unchanged.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be signed by the duly authorized officers and the
respective corporate seals to be affixed this a.l day of
1989 .
