RESOLUTION 89-19811A RESOLUTION NO. 89-19811A A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING EXECUTION OF AN AGREEMENT WITH "CONTRACTOR" , FOR THE RETENTION OF SERVICES AS AN ICE RINK COORDINATOR FOR THE CITY OF MIAMI BEACH, IN ACCORDANCE WITH "RFP No. 22-89/91, COMMISSION MEMORANDUM No. 590-89, 11/15/89" BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, the City of Miami Beach has determined that it is necessary to employee the professional services of a part-time Ice Rink Coordinator for the City of Miami Beach; and WHEREAS, the City has budgeted funds through the City's Professional Services Accounts for compensation of said Ice Rink Coordinator; and WHEREAS, the City Manager shall recommend to the City Commission that the City enter into an Agreement with James L. Beagan for a two (2) year period beginning December 11, 1989, and ending December 10, 1991, to be paid on a bi-weekly basis for a minimum of 30 hours per week, at a rate of $480.00 bi-weekly; providing that aforesaid individual provides certain services for the City of Miami Beach Scott Rakow Youth Center Ice Rink, as per agreement; and WHEREAS, the City Commission, being familiar with the provisions of said Agreement, deems it to be in the best interests of the City and its citizens and residents to enter into said Agreement; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be and they are hereby authorized and directed to execute said Agreement with James L. Beagan in the name of and on behalf of the City, and that the disbursing officers of the City be and they are hereby authorized and directed to disburse the monies required by the terms of said Agreement from funds of the City available for said purpose. Date ,2y_f_ct AGREEMENT This Agreement, made and entered into this 11th day of December, 1989, by and between the City of Miami Beach, a Florida municipal corporation, hereinafter referred to as the "City" and James L. Beagan hereinafter referred to as "Contractor" and in accordance with "RFP No. 22-89/91, Commission Memorandum No. 590-89, 11/15/89" . WITNESSETH: WHEREAS, the City desires to employ the professional services of a part-time Ice Rink Coordinator for the City of Miami Beach, for a two (2) year period, from December 11, 1989, up to and including December 10, 1991, with an option to renew for a second two (2) year period; and WHEREAS, the City has budgeted funds for the compensation of said Ice Rink Coordinator; and WHEREAS, the Contractor is responsible for rendering services to the City, as hereinafter set forth, as said Ice Rink Coordinator. NOW THEREFORE, for in consideration of the promises and the mutual convenants and agreements contained herein, the parties agree as follows: 1. The term of this Agreement shall be for the two (2) year period starting December 11, 1989, through December 10, 1991. 2. The Contractor will be identified as Ice Rink Coordinator and will be paid bi-weekly for a minimum of 30 hours per week, at the rate of $480.00 bi-weekly. This will be considered a part-time position. The Contractor will report to the Director of the Youth Center or the Director's designee, who is considered to be the Contractor's immediate supervisor. 3. The Contractor will abide by established Work Rules with regards to all time off. It is further agreed by both parties that any time off shall be at the expense of the Contractor and at the convenience of the City. 4. It is agreed by the parties that the City shall have the right to cancel this entire Agreement or any part hereof upon failure of the Contractor to meet any of the requirements set forth herein. 5. In the event of injury, illness, or any other cause which prevents the Contractor from meeting any of the requirements set forth herein, the City Manager of Miami Beach shall notify the Contractor by certified mail at his last known address , that employment with the City is terminated and shall replace said Contractor with the approval and consent of the Miami Beach City Commission. 6. The Contractor shall provide the following services for the City: To schedule the ice rink programs at the Scott Rakow Youth Center, to assist or coach, when required, shows and/or competition routines ; to recommend the purchase of necessary equipment for the maintenance of the ice rink and rink facilities; to supervise all contracted ice rink personnel; to keep required records; to assist in planning yearly budget for ice rink expenses; to promote a program of competitions, lessons, classes, shows, and exhibitions; to effect and maintain good public relations; to offer services such as clinics , exhibitions , or work-shops; coordination of private parties and group usage; to provide regular continuing opportunities for professional ice skating instruction that will assure maximum use of the rink; to perform regular ice rink and ice skate maintenance, to include ice skate sharpening and blade mounting of rental skates; to do related work as required. The Contractor, at his own expense, must possess and maintain throughout period of contract Ice Skating Institute of America (I.S. I.A. ) membership and personal liability insurance. 7. The Contractor shall have the privilege to operate at his own expense, without compensation to the City, an ice skating pro shop which may include but not be limited to: a. Ice skate apparel and equipment b. Ice skates, mounting and sharpening of blades. c. Ice skating related items. d. Private lessons at rates established by the City. The City assumes no responsibility for pro shop merchandise, lost, stolen, destroyed, etc. All State and Federal regulations and taxes are the responsibility of the Contractor. 8. The Contractor understands that he is not considered a regular City Employee and is therefore not eligible for any coverage under any of the City's insurance programs, including, but not limited to: Accident, Workmen's Compensation and Unemployment Compensation. 9 . It is understood that it is the sole responsibility of the Contractor to pay all federal income taxes and social security on the salary being paid to him. The City will provide the Contractor with copies of all forms submitted to the Internal Revenue Service. 10. The rights and privileges granted herein or any part hereof shall not be assigned except by express consent of the City Commission of said City.
