RESOLUTION 89-19847 RESOLUTION NO. 89-19847 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 22, ENTITLED ',RATE SCHEDULE,' OF THE ADMINISTRATIVE RULES AND REGULATIONS GOVERNING POLICE TOWING PERMITS AS REFERENCED IN SECTION 44-53 OF THE MIAMI BEACH CITY CODE, BY PROVIDING FOR AN INCREASE IN THE MAXIMUM ALLOWABLE RATES FOR ROAD SERVICE AND TOWING AND STORAGE OF CERTAIN VEHICLES. WHEREAS, the Police Department has recommended revisions in Section 22 , entitled "Rate Schedule" of the Administrative Rules and Regulations Governing Police Towing Permits to establish rates in keeping with those charged in other local jurisdictions; and WHEREAS, the City Commission of the City of Miami Beach has determined that it is in the best interests of the City to amend the Administrative Rules and Regulations Governing Police Towing Permits as set forth in the amended Section 22 of the Administrative Rules and Regulations attached hereto and made a rPr4- hereof. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Section 22 entitled "Rate Schedules" of the Administrative Rules and Regulations Governing Police Towing Permits as referenced in Section 44-53 of the Miami Beach City Code is hereby amended by an increase in the maximum rates for road service and towing and storage of certain vehicles as set forth in the attached amendment. Par • s 1( -- City Manager SUBJECT: REVISIONS TO THE ADMINISTRATIVE RULES AND REGULATIONS FOR POLICE TOWING PERMITS, PROVIDING FOR AN INCREASE IN THE MAXIMUM ALLOWABLE FEES HI STORY Pursuant to City Ordinance #80-2222 , effective August 20, 1980, the City Commission established a Police Vehicle Towing permit system. The permittees are further regulated by Administrative Rules and Regulations for Police Towing Permits approved pursuant to City Commission Resolutions #86-18437, #86-18709 and #87-18919 . Maximum allowable rates for towing of vehicles when authorized by a police officer are established pursuant to these Administrative Rules. The maximum allowable rates were last revised effective October 1, 1986. BACKGROUND The Miami Beach Police Department's Impound Unit surveyed police agencies in Dade County regarding police towing rates. The following is a report of fees charged by towing companies for police authorized tows of "Class 2 Vehicles" - Sedans, Compacts, Station Wagons, Pickups and similar vehicles, which represent the most frequent tows: Agency Fee Admin. In addition, all other agencies have a $2 . 00 per towing mile charge. The smaller municipalities use the same towing companies and charge basically the same rates. ADMINISTRATION RECOMMENDATION The City Administration recommends that the City Commission approve the attached Resolution approving the revised Section 22 . RATE SCHEDULE of the Rules and Regulations Governing Police Towing Permits as referenced in Section 44-53 of the City Code of the City of Miami Beach, providing for an increase in the maximum allowable fees which may be charged under Police Towing Permits.
