A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, SCHEDULING A PUBLIC
HEARING FOR WEDNESDAY, FEBRUARY 21, 1990 AT
3 : 00 P.M. TO TAKE TESTIMONY REGARDING THE
LINCOLN ROAD COMMERCIAL DISTRICT SPECIAL
IMPROVEMENT DISTRICT NUMBER 1, ESTABLISHED FOR
A ONE YEAR PERIOD BY CITY OF MIAMI BEACH
RESOLUTION NO. 89-19849 , PROVIDING THAT AT
SUCH TIME THE MIAMI BEACH CITY COMMISSION WILL
HEAR AND RECEIVE WRITTEN OBJECTIONS OF ALL
INTERESTED PERSONS CONCERNING THE ESTABLISHMENT
OF SAID SPECIAL IMPROVEMENT DISTRICT, IN
ACCORDANCE WITH SECTIONS 29 AND 30 OF THE CITY
CHARTER OF THE CITY OF MIAMI BEACH.
Whereas, Chapter 170, Florida Statutes, and Sections 29 and 30
of the Miami Beach City Charter authorize "the levy and
collection of special assessments against property benefited for
the purpose of stabilizing and improving retail and/or wholesale
business districts and/or nationally recognized historic
districts through promotion, management, marketing and other
similar services in business districts of the municipality" ; and
Whereas, By City of Miami Beach Resolution No.89-19848 adopted on
December 20, 1989 , the City Commission ordered the establishment
of the Lincoln Road Commercial District Special Improvement
District Number 1 in order to fund a promotion, management and
marketing program for the Lincoln Road Commercial District; and
Whereas, Section 30 (f) of the City Charter of the City of Miami
Beach requires that the City Clerk shall publish in a newspaper
of general circulation in the City of Miami Beach, a notice
stating that at a meeting of the City Commission on a certain
date and hour, the City Commission will hear objections of all
interested persons to the confirmation of Resolution No- 89-19848
ordering the establishment of the Lincoln Road Commercial
District Special Improvement District Number 1. ; and
Whereas, Section 30 (g) of the City Charter of the City of Miami
Beach requires that at the City Commission meeting named in the
aforementioned notice, the Commission shall receive written
objections of interested persons, and may act upon the
objections; and
Whereas, Section 30 (i) of the City Charter of the City of Miami
Beach requires that at said City Commission meeting, all
objections not made in writing shall be waived ; and, that
confirmation of the resolution shall be the final adjudication of
the issues presented, unless proper steps shall be taken in a
court of competent jurisdiction to secure relief within ten days.
NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, THAT:
A public hearing is hereby scheduled to take place before the
City Commission in the City Commission Chambers, City Hall, 1700
Convention Center ve Miami Beach, Florida on Wednesday,
February21, 1996 PC4t Commission will hear objections of

Number 1.

BACKGROUND
The Lincoln Road Commercial District Special Improvement District
Number 1 was established by the Miami Beach City Commission for a
one year period by Resolution No. , adopted on December 20,
1989 . Sections 29 and 30 of the City Charter of the City of Miami
Beach requires that a public hearing be held to hear objections
of all interested persons concerning the establishment of the
District.
Prior to the public hearing, the Lincoln Road Development
Corporation shall schedule a series of workshops for property
owners and other interested parties to inform them of the
objectives of the management program, the manner of the proposed
assessment and to discuss potential physical improvements within
the Lincoln Road Commercial District.
RECOMMENDATION
The Administration recommends that the attached Resolution be
passed which schedules a public hearing for Wednesday, February
21, 1990 in order for the Miami Beach City Commission to hear and
receive in writing, objections from all interested persons
regarding the establishment of the Lincoln Road Commercial
District Special Improvement District Number 1.
