RESOLUTION 90-19964 RESOLUTION NO : 90-19964 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CONFIRMING CITY OF MIAMI BEACH RESOLUTION NO. 90-19917, ADOPTED ON FEBRUARY 21ST OF 1990, WHICH ORDERS AN IMPROVEMENT AND ESTABLISHES A SPECIAL ASSESSMENT DISTRICT TO BE KNOWN AS THE NORTH SHORE PUBLIC AREA REVITALIZATION DISTRICT NUMBER 1 AND PROVIDING FOR SAID IMPROVEMENT TO BE AN ASSESSABLE PROJECT IN ACCORDANCE WITH SECTIONS 29 AND 30 OF THE CITY CHARTER. WHEREAS, the City Commission of the City of Miami Beach, by Resolution No. 90-19917 passed and adopted on the 21st day of February, 1990, ordered the North Shore Public Area Revitalization District #1, and the Director of Public Works has prepared and filed with the City Clerk plans and specifications of such improvement and an estimate of the cost thereof, including an estimate of the cost of the incidental expenses of said improvement, and an estimate of the amount to be assessed against each front foot of abutting property; and WHEREAS, By City of Miami Beach Resolution No. 90-19918 , adopted on February 21, 1990, the City Commission ordered a public hearing for Wednesday, April 18 , 1990 at 3 : 00 P.M. to take testimony regarding the establishment of said Special Improvement District; and WHEREAS, due notice by publication as required by the City Charter has been made that the City Commission would on the 18th day of April, 1990, at the City Commission Chambers, City Hall , at 3 : 00 p.m. receive and hear objections of all persons interested to the confirmation of said resolution ordering said improvement, and objections having been presented and heard at the time and place aforesaid; and WHEREAS, Pursuant to said public hearing, Section 30 (h) of the Miami Beach City Charter requires that a Resolution confirming City of Miami Beach Resolution No. 90-19917 be adopted. Due to an increase in crime and a drop in tourism, the North Shore area has suffered reduced business earnings, lower property values, and fewer tourists. The proposed capital improvement project, which consists of street and sidewalk modifications, attractive landscaping, pedestrian-oriented lighting and furnishings, is designed to help reverse this trend. Funding for this project will be a cooperative effort of City, State, and private dollars. The proposed project's total budget, including a breakdown of the component costs, is provided in the enclosed information package. The North Shore Development Corporation, in conjunction with the City Of Miami Beach, has scheduled two public workshops designed to inform you of the proposed project. These workshops will be held on Thursday, March 29th, and Thursday, April 5th, at 5:00 p.m., at City National Bank, 300 - 71st Street. We encourage you to attend and participate in these workshops so that the City may properly address your questions. In addition to the public's views presented at these workshops, the City Commission has requested that we survey the area property owners to seek their opinion on the proposed capital improvement project. The plan will be discussed in March and April. On April 18, 1990 the City Commission will make their decision whether to implement the project. If the project is approved, a Request For Proposal (RFP) will be issued with an adequate response time, so that a design engineer can be selected by August of this year. A project manager will be hired by October to coordinate construction and participate in marketing plans for the area. Detailed design plans and bid specifications would be prepared in December 1990 and a contractor selected from public bids in March of 1991. Construction would begin in phases during March/April of 1991. Earlier phases would be completed much sooner. The final phase of construction would begin sometime in 1992 and be completed by January of 1993. Will Construction Inconvenience Pedestrians and Merchants ? Construction involving the streetscape improvements will cause limited inconvenience. Construction would proceed in phases, so that any inconvenience would last only a few months. Access would be preserved to the greatest extent possible during the entire time. The positive impact on the area resulting from the improvement will begin to develop before the completion of construction. What are the Project Components ? The major component consists of street and sidewalk modifications and repairs, in addition to the State of Florida's street resurfacing streets plans. This component would cost $2,488,000. Second, more effective and increased lighting throughout the project area would cost $1,010,000. Each year, $100,000 would be allocated for maintaining the improvements. Engineering design would cost 1376,000, landscaping with palms, planters, grates, etc, is budgeted at $175,000, mobilization for construction costs would amount to 1188,000, and street furniture would cost 185,000. As is customary with construction projects, a 10 percent contingency is provided in the overall budget. Will the Public be Part of the Process ? This project has been developed during a year-long planning process with significant participation from the North Shore Development Corporation, the Miami Beach Chamber of Commerce North Shore Task Force and the City's Safe Neighborhood District 2 planning team. Two community workshops were held with property owners, merchants and residents on October 24, 1989, and on November 14, 1989, to review this project and seek input. The City Commission first reviewed these plans at their meeting of February 21, 1990. Prior to the City Commission public hearing scheduled for April 18, 1990, information will be provided to the public in the form of visual displays at the community locations previously mentioned. Written information will be distributed and oral presentations will take place at two public workshops to be held on March 29 and on April 5. The public workshops will take place at 5:00 pm in the City National Bank lobby at 300 - 71st Street. City officials and representatives of the North Shore Development Corporation will be present to explain in detail the proposed improvements and the Special Assessment District plan and to hear views from the community. For further information regarding this project please contact the City of Miami Beach Department of Economic and Community Development at 673-7193. 3 What is the Purpose of the Capital Improvement Project ? By making the area safe and attractive for pedestrians and motorists we are sending a message that people care about their community. Criminologists have found that such environmental changes significantly deter crime. In turn, a properly designed, attractive area attracts pedestrians, tourists, shoppers and residents, thereby increasing local sales and property values and encouraging investment in new hotels, apartments and stores. Can I See How the Capital Improvement Project Will Actually Look Stand-up displays with a full description and photographic images of the improvement project for Collins Avenue and 71st Street are located at Surf Drugs (7430 Collins Avenue) and the North Shore Public Library (7501 Collins Avenue). Additional sites may be added during March. How Much Would the Proposed Capital Improvement Project Cost ? The estimated total cost is $5,885,000 to be spread over ten years at about 10 percent interest. The City would issue bonds to fund construction. Bondholders will be repaid over a period of ten years. Who Would Pay for the Capital Improvement Project ? Each property fronting on the streets being improved would be assessed an equal portion per lineal foot of property frontage. The City and State would pay for 30 percent, or $1,765,000 of the total cost and 70 percent, or $4,120,000 of the project, would be paid for by the assessed property owners. Who Will Benefit from the Capital Improvement Project ? The improvement would benefit property owners, residents, shoppers and pedestrians. Owners of commercial property would enjoy the appreciation of their property value and increased earnings based on the safety and attraction of the area. How Will the Assessment Process be Implemented ? The City Commission has established the North Shore Public Area Revitalization District No. 1, consisting of Collins Avenue from 63rd to 75th Streets, Ocean Terrace and Collins Court from 73rd to 75th Streets, 73rd and 75th Streets between Collins Court and Ocean Terrace and 71st Street from Collins Avenue to Rue Notre Dame, with the Fountain Area on Normandy Isle. A public hearing is scheduled for April 18, 1990, when the City Commission will decide whether to take the necessary steps to implement the project. If approved, property owners will be billed annually for their portion of the improvement project based on their lineal footage. The City will pay interest and the principal on the project bonds from the special assessment funds. How Much Would a Typical Property Owner be Assessed Each Year ? The private share of the total cost is 70 percent, or 14,120,000 which comes to $183.11 for each lineal foot of frontage. (The total number of feet of lineal frontage on the project streets comes to 22,500 feet). Spread over ten years at 10 percent interest, the annual assessment for a typical 50-foot lot comes to $1,492.00, or approximately $124.33 per month. Will a Corner Property Have to Pay for Footage All Around ? Yes. The formula adjustment for corner properties allows footage on the second street to be assessed at 50 percent and footage on an alley such as Collins Court between 73rd and 75th Streets would be assessed at only 25 percent. 2 INFORMATIONAL HANDOUT Attachment 'A" THE NORTH SHORE PUBLIC AREA REVITALIZATION CAPITAL IMPROVEMENT PROJECT What is the North Shore ? North Shore is the area in the City of Miami Beach north of 63rd Street and south of 87th Street, where the City of Surfside begins. Due to a sudden rise in crime and the drop in tourism between 1979 - 1983 North Shore suffered lower business earnings, lower property values, fewer visitors and more blight. Today, North Shore's significant assets are restored beaches, new businesses, rehabilitated apartment buildings, a brand new State Park, a privately-managed public golf course, wide streets and a strong base of concerned residents and local property owners. Where is the North Shore Commercial Area ? The commercial arteries of the North Shore are well defined and include Collins Avenue from 63rd Street to 75th Streets, Ocean Terrace, Collins Court, 71st Street between Collins Avenue and the Normandy Isle Fountain area and the Fountain Area west to Rue Notre Dame on Normandy Isle. What is the North Shore Development Corporation ? North Shore Development Corporation (NSDC) is a non-profit community development corporation made up of local property owners and North Shore businessmen. NSDC was chartered in 1988 to preserve and improve the economic health and vitality of the North Shore area; to expand the commercial and residential base; and to reverse the deterioration of the North Shore by engaging in redevelopment, restoration and revitalization programs. NSDC attempts to identify community concerns and transmit a strong message to the City, County and State that North Shore is developing a consensus for revitalization in order to save itself from further decline and to target assistance to improve the community. NSDC has helped propose, monitor and support the City's provision of salaries, vehicles and equipment for 50 new police officers with better procedures to increase their responsiveness and visibility. City staff have participated with the NSDC at community meetings with citizens to listen to problems and help create solutions. Graffiti removal, increased clean-ups and stricter code enforcement have been implemented. $122,000 of the City's Community Development Block Grant (DCBG) funds were budgeted for facade improvements matched by owners and Dade County funds. An additional $108,000 of the City's CDBG funds has enabled private apartment rehabilitation projects by guaranteeing lower interest rates. What is the Suggested Capital Improvement Project ? The capital improvement project for North Shore will consist of street and sidewalk modifications, attractive landscaping, pedestrian-oriented lighting and street furniture, including benches, tree grates and attractive trash receptacles. Detailed designs aimed at lowering crime and improving property values have been developed by the City with State funding through the Safe Neighborhoods Program. These streetscape designs affect traffic flow, signage, alley lighting, greenery, and create an attractive human environment. These changes are endorsed by the Police Department and show results where they have been applied elsewhere in the nation. April 3 , 1990 Meeting announcements for the March 5, 1990 public workshop were distributed by hand to all merchants and tenants who would be affected by the proposed improvement project. The merchants and tenants were encouraged to attend the workshop to further discuss the proposed improvement project and to gather input from effected parties. April 5, 1990 The second of two public workshops to discuss the proposed capital improvement project was held at the City National Bank, 300 - 71st Street. Attendance at this meeting was 34 effected individuals. AFFECTED PROPERTY OWNERS INPUT OBTAINED TO DATE: As mentioned earlier, a questionnaire was sent to all property owners of record. The following three (3) questions were included: 1. Have you, or will you, attend either of the public workshops? YES NO (15) ( 5) 2 . As a property owner in the North Shore Public Area Revitalization District #1, are you in favor of the proposed improvement project? YES NO (15) ( 6) 3 . Are you willing to pay for a special assessment to fund the proposed improvement project? YES NO (11) ( 9) You will note that based on the responses received to date, that 75% responded favorably to question #1; 71% responded favorably to question #2 ; and 55% responded favorably to question #3 . As the surveys continue to be received and compiled, we will provide the City Commission with an update on April 18, 1990. ADMINISTRATION RECOMMENDATION: Following the Public Hearing scheduled for 3 : 00 p.m. , the Administration recommends adoption of the attached Resolution confirming City of Miami Beach Resolution No. 90-19917, adopted on February 21st of 1990, which orders an improvement and establishes a special assessment district to be known as the North Shore Public Area Revitalization District # 1 and providing for said improvement to be an assessable project in accordance with sections 29 and 30 of the City Charter. 18 October 17, 1989 The North Shore Development Corporation met and asked the City to present design concepts to make the North Shore a safer and more economically viable portion of Miami Beach. October 24 , 1989 A meeting was held at 3 : 00 p.m. in the City National Bank Lobby at 300 71st Street. This meeting included: property owners in the North Shore area, North Shore Development Corporation Board members, and staff from the City' s Economic and Community Development Department. Attendance at this meeting was 29 effected individuals. Input was gathered from all parties with regard to a capital improvement project being proposed for the area. November 7, 1989 Meeting announcements were distributed by hand to all merchants and tenants who would be affected by the proposed improvement project. Prior to this meeting notices had been mailed to the affected owners of record in the area. The merchants and tenants were encouraged to attend a meeting scheduled for November 14 , 1989, to discuss a proposed improvement project and to gather input from affected parties. November 14, 1989 A meeting was held at 3 : 00 p.m. in the City National Bank Lobby at 300 71st Street. This meeting included: property owners, merchants and tenants from the North Shore area, North Shore Development Corporation Board members, and staff from the City' s Economic and Community Development Department. Attendance at this meeting was 54 effected individuals. Input was gathered from all parties with regard to a capital improvement project being proposed for the area. February 21, 1990 The City Commission approved Resolution No. 90-19917 which orders a capital improvement project for the area to known as the North Shore Public Area Revitalization District No. 1. The City Commission also approved Resolution No. 90-19918 which established the date to hear public testimony with regard to the proposed district as April 18, 1990 at 3 : 00 p.m. in Commission Chambers at City Hall. March 22, 1990 Meeting announcements and information packets were sent to all property owners of record (from the tax roles) who will be affected by the proposed capital improvement project. Questionnaires which asked the property owners to responded to three questions were also distributed in the information packet. A sample of the information packet and questionnaire is provided as Attachment "A" to this document. March 29, 1990 The first of two public workshops to discuss the proposed capital improvement project was held at the City National Bank, 300 - 71st Street. Attendance at this meeting was approximately 16 individuals. BACKGROUND: As you are aware, the City and the North Shore Development Corporation (NSDC) have been working diligently for quite some time, to revitalize and upgrade the North Shore Area. Since the publication of the "North Shore Revitalization Plan" in March 1986, many actions have been taken, and various programs have been instituted in the North Shore Area, in order to reverse the decline and to upgrade the area. However, a major capital improvement project is necessary, if we are to effectively revitalize the North Shore Area. On February 21, 1990 the City Commission adopted Resolution No. 90-19917, which orders an improvement and establishes a special assessment district to be known as the North Shore Public Area Revitalization District #1 (NSPAR #1 ) , providing for said improvement to be an assessable project in accordance with Section 29 and 30 of the City charter. As a follow-upto that action, pursuant to Resolution No. 90-19918 , a public Hearing has been scheduled for Wednesday April 18, 1990 at 3 : 00 p.m. , and such public Hearing was duly advertised. Following that Hearing, you will be asked to adopt a new Resolution which confirms Resolution No. 90-19917 (2/21/90) . PLANNING AND CITIZEN PARTICIPATION PROCESS: An extensive planning phase and public information/input process has been undertaken for the North Shore Public Area Capital Improvement Project, as follows: March , 1986 The North Shore Revitalization Plan is published by the City of Miami Beach.
