A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING
THE APPROPRIATION OF FUNDING, IN THE APPROXIMATE
AMOUNT OF $8,241,507, FROM FLORIDA DEPARTMENT OF
TRANSPORTATION FOR ROADWAY AND DRAINAGE
IMPROVEMENTS ON S.R. A1A/INDIAN CREEK DRIVE, FROM 25TH
TO 41ST STREET; FURTHER AUTHORIZING THE CITY MANAGER
OR HIS DESIGNEE TO EXECUTE ALL NECESSARY DOCUMENTS
IN CONNECTION WITH THE AFORESTATED FUNDS, INCLUDING
FUNDING AGREEMENTS AND AUDITS; AND FURTHER
AUTHORING THE CITY MANAGER OR HIS DESIGNEE TO TAKE
ALL NECESSARY ACTIONS RELATED TO THESE FUNDS.
WHEREAS, Indian Creek Drive is a state owned and maintained road that is under
FDOT's jurisdiction; and
WHEREAS, in 2015, City representatives traveled to Tallahassee to meet with the
Secretary of Transportation to discuss the impact of flooding events on Indian Creek Drive, and,
as a result, City staff and FDOT agreed to a cost sharing project for major infrastructure
construction; and
WHEREAS, on September 30, 2016, the City and FDOT entered into a Department
Funded Agreement (DFA) for Financial Project Number 439228-2-58-01 for roadway and
drainage improvements on S.R. A1A/Indian Creek from 41st Street to 26th Street ("the Project").
The agreement provided FDOT funds to a maximum amount of $20,008,493, and City funds to
a maximum amount of$5,400,000, for a total Project value of$25,408,493; and
WHEREAS, on June 27, 2019, the City and FDOT executed an amendment to the DFA;
said amendment increasing FDOT's maximum participation by $5,991,507 to $26 million, and
the City's maximum participation by $1,636,848 to $7,036,848, for a total Project value of
$33,036,848; and
WHEREAS, recently, the City Administration has been negotiating with FDOT for
additional funding for the Project, and if the negotiations are successful, FDOT's maximum
contribution to the Project will increase by $2.25 million to $28.25 million, and the City's
maximum contribution will also increase by $2.25 million to $9,286,848; and
WHEREAS, the Administration recommends that the Mayor and City Commission
appropriate $8,241,507 of FDOT funding from: 1) The Amended Agreement; and 2) Recent
Negotiations as follows:
1) Amended Agreement:FDOT $5,991,507
2) Recent Negotiations: FDOT $2,250,000; and
WHEREAS, this agenda item requests that the Mayor and City Commission appropriate
only the FDOT funds; and

WHEREAS, there is a companion Capital Budget amendment item, requesting that the
Mayor and City Commission approve the appropriation of the City's portion of the funding for the
Indian Creek Project ("City's contribution"), which appropriation exceeds the requisite matching
funds from the City as required by the DFA, as follows:
1) Amended Agreement:City $1,636,848 and
2) Recent Negotiations: City $2,250,000; and
WHEREAS, this agenda item is subject to the approval of the Capital Budget amendment
for the City's Contribution; and
WHEREAS, the Administration recommends that the Mayor and City Commission approve
the appropriation of the FDOT funding for the Project.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
approve and authorize the appropriation of funding, in the approximate amount of $8,241,507,
from Florida Department of Transportation for roadway and drainage improvements on S.R.
A1A/Indian Creek Drive, from 25th to 41st Street; further authorize the City Manager or his
Designee to execute all necessary documents in connection with the aforestated funds,
including funding agreements and audits; and further authorize the City Manager or his
Designee to take all necessary actions related to these funds.

Adopt the Resolution.
ANALYSIS
Indian Creek Drive is a state owned and maintained road that is under FDOT's jurisdiction. In 2015 City

maximum participation increased by $1,636,848 to $7,036,848. The amended total funding for the
Project under the amended agreement is $33,036,848,with FDOT and City funds.
Recent Negotiations
Recently,the City Administration has been negotiating with FDOT for additional funding for the Project.
If the negotiations are successful, FDOT's maximum contribution to the Project will increase by $2.25
million to $28.25 million. The City's maximum contribution will also increase by $2.25 million to
$9,286,848.

Total FDOT funds to be appropriated in this agenda item-$8,241,507
Capital Budget Item Appropriating City-funded Portion of the DFA
This agenda item requests that the Mayor and City Commission appropriate only the FDOT funds.
There is a Capital Budget Amendment item on today's Regular Agenda (July 31, 2019), that is
associated with this agenda item. The Capital Budget Amendment appropriates the City's portion of
funding for the Indian Creek Project. The associated Capital Budget item includes, and exceeds the
requisite matching funds from the City as required by the DFA,which is:
1. Amended Agreement: City $1,636,848
2. Under Negotiation: City $2,250,000
Total maximum participation funding required by DFA-$3,886,848
This agenda item is subject to the approval of the Budget Amendment on the regular agenda.
CONCLUSION
The Administration recommends that the Mayor and City Commission .adopt the Resolution
approving the appropriation of funding.
