RESOLUTION 90-20084 RESOLUTION NO. 90-20084 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY ATTORNEY TO RETAIN THE SERVICES OF HIGH-POINT SCHAER AS A CONSULTANT TO ANALYZE THE CLAIM OF THE GEORGE HYMAN CONSTRUCTION CO. , DATED MAY 29, 1990 FOR THE CONVENTION CENTER PROJECT, WITH SERVICES TO BE BILLED ON AN HOURLY BASIS UP TO A MAXIMUM FEE OF $40,000 (PLUS ACTUAL OUT OF POCKET EXPENSES) , WHICH WILL NOT BE EXCEEDED WITHOUT FURTHER COMMISSION APPROVAL. WHEREAS, the City of Miami Beach has received from its Architect of Record a claim dated May 29, 1990 from The George Hyman Construction Co. in the amount of $6. 26 million for delays alleged to have been experienced during construction of Phases I and II of the Convention Center Project; and WHEREAS, in order to properly analyze this claim it is necessary to secure the services of an experienced claims consultant to evaluate the claim and all back up records; and WHEREAS, the City Attorney recommends High Point Schaer as the claims consultant; and WHEREAS, this expenditure has been approved by the Tourist and Convention Center Expansion Authority. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney is authorized to retain the services of High-Point Schaer as a consultant to analyze the claim of The George Hyman Construction Co. , dated May 29 , 1990 for the Convention Center project, with services to be billed on an hourly basis up to a maximum fee of $40, 000 (plus actual out of pocket expenses) , which will not be exceeded without further commission approval, to be paid from Bond Fund No. 358 . 's claim and recommends that the Commission adopt the attached resolution authorizing the retention of High-Point Schaer, with the services to be billed on an hourly basis up to a maximum fee of $40, 000.358.
