RESOLUTION 90-20130 RESOLUTION NO. 90-20130 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING FOR NOVEMBER 7, 1990, AT 10:30 A.M. TO CONSIDER THE REVOCATION OF AN AMENDMENT TO A CERTIFICATE OF APPROPRIATENESS FOR DEMOLITION OF THE BANCROFT ANNEX, 1521 COLLINS AVENUE. WHEREAS, on July 25, 1990 the City Commission granted the owners of the Bancroft Annex, 1521 Collins Avenue, an amendment to a previously approved Certificate of Appropriateness for Demolition, for the Bancroft Annex subject to certain conditions which the Commission deemed necessary for the public health, safety and welfare; and WHEREAS, the owners of the Bancroft Annex, 1521 Collins Avenue, have been given sufficient time and opportunity to comply with said conditions and have not done so. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF MIAMI BEACH, FLORIDA that the City Commission shall hold a public hearing on November 7, 1990 at 10:30 a.m. to consider the revocation of the amendment to the Certificate of Appropriateness for Demolition for the Bancroft Annex, 1521 Collins Avenue. Pa - insle / City Manager SUBJECT: 1521 Collins Avenue: Request for Public Hearing date to Consider the Revocation of an Amendment to a Certificate of Appropriateness for Demolition of the Bancroft Annex. The Request The Administration requests the City Commission set a public hearing for the purpose of considering revocation of the amendment to the existing Certificate of Appropriateness for Demolition of the Bancroft Annex building, 1521 Collins Avenue. { Background At its July 25, 1990 meeting, the City Commission granted an amendment to a Certificate of Appropriateness for Demolition of the Jefferson-Bancroft Properties (121 15th Street and 1500-1521 Collins Avenue) . The amendment would allow the Bancroft Annex building to receive a demolition permit prior to receiving a building permit for the new hotel reviewed by the Historic Preservation Board in 1987. The Commission granted an amendment to the Certificate of Appropriateness for Demolition subject to an Agreement that would be drafted by the City Attorney' s Office. The Agreement included the following terms: 1. Prior to receipt by Mia Beach, Ltd. of the Amendment to the Certificate and prior to the issuance of a demolition permit, Mia Beach was to execute the Agreement and present the City with two irrevocable letters of credit to be approved by the City Attorney: a. A letter of credit in the amount of $30, 000 to secure the boarding up of the Jefferson-Bancroft premises which would be released after the premises were secured by Mia Beach. b letter of credit in the amount of $100, 000 which could be used by the City to maintain the premises (including fencing of the pool area) and/or to demolish the. Bancroft Annex building in the event that Mia Beach fails to do either. The amount would be reduced to $75, 000 after one year and for every year thereafter to $50, 000 if Mia Beach demolishes the Annex timely and properly maintains the property. This letter of credit would be released when the premises are redeveloped. 11 AGENDA ITEM Rie7— DATE / 0I 0-90 2. Mia Beach was to obtain a demolition permit by August 25, 1990, commence demolition within 15 days and complete demolition within 30 days after obtaining the permit, or as soon thereafter as possible using diligent efforts. 3 . Mia Beach was to complete the board-up of the Jefferson and Bancroft Hotels upon commencement of demolition of the Bancroft Annex. As per the City Commission's direction, the City Attorney prepared the appropriate agreements which the property owner has not executed. The owner has not submitted a completed application to the Building Department for a demolition permit. It is the opinion of the Administration that the property owner has been given sufficient time to comply with the conditions set at the July 25, 1990 City Commission meeting and that revocation of the Amendment to the Certificate of Appropriateness be considered. In order to protect the public and surrounding properties, the City's Building Official has ordered the securing of the premises including cement blocking of openings in the Jefferson, Bancroft and Bancroft Annex buildings and fencing of the pool area. Administration Recommendation The Administration recommends that the City Commission set a public hearing for the purpose of considering revocation of the Amendment to the Certificate of Appropriateness for Demolition of the Bancroft Annex, 1521 Collins Avenue.
