RESOLUTION 90-20160 RESOLUTION NO. 90-20160 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH APPROVING A CHANGE IN THE MAXIMUM GREENS FEES AND GOLF CART RENTAL FEES TO BE CHARGED UNDER THE MANAGEMENT AGREEMENT WITH AMERICAN GOLF CORPORATION, EFFECTIVE NOVEMBER 1, 1990 WHEREAS, pursuant to Resolution No. 86-18464 , the City of Miami Beach (hereinafter referred to as "City") entered into a Management Agreement (hereinafter referred to as "Agreement") with American Golf Corporation (hereinafter referred to as "Operator") commencing October 1, 1986 and ending September 30, 1991 ; and WHEREAS, the Agreement provides for the operational management of City-owned golf courses known as Bayshore Golf Course, Normandy Shores Golf Course and Par 3 Golf Course; and WHEREAS, the Agreement provides that greens fees and golf cart rental fees are subject to the prior approval of the City Commission; and WHEREAS, pursuant to Resolution No. 88-19152 , adopted February 3 , 1988 , the City Commission approved a revised schedule of maximum greens fees and golf cart rental fees; and WHEREAS, approximately two years afterward, the Operator submitted a subsequent request for an increase in the maximum amount of greens fees and golf cart rental fees which may be charged; and WHEREAS, pursuant to Resolution No. 90-20082 , the City Commission approved this second request for a rate increase; and WHEREAS, at its meeting on September 19 , 1990, in response to resident inquiries, the City Commission set October 24 , 1990 as the date for reconsideration of Resolution No. 90-20082 ; and WHEREAS, the Operator revised its proposed rate increase; and WHEREAS, the City Administration reviewed the Operator' s request for an increase in fees; and WHEREAS, the City' s Golf Advisory Committee reviewed the Operator' s revised request for an increase in the greens fees and golf cart rental fees at its meeting on October 5 , 1990 and recommended that the City Commission approve the proposed fees; and . WHEREAS, the proposed fees are described on the attached Revised Exhibit "H" to the Agreement, Page 2 of 3 , Revised Effective November 1, 1990 . NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, as follows: 1. Resolution No. 90-20082 is hereby rescinded in its entirety, and 2 . The Mayor and the City Clerk are hereby authorized to execute this Resolution No. 90-20160 signifying its adoption and approval of the fees described on the attached Revised Exhibit "H" , Page 2 of 3 , effective November 1, 1990 . Parkin IV 2--lori City Manager iV r RESOLUTION APPROVING A CHANGE IN THE MAXIMUM GREENS FEES SUBJECT: AND GOLF CART RENTAL FEES TO BE CHARGED UNDER THE MANAGEMENT AGREEMENT WITH AMERICAN GOLF CORPORATION, EFFECTIVE NOVEMBER 1, 1990 HISTORY: Pursuant to City Commission Resolution No. 86-18464 , the City entered into a Management Agreement with American Golf Corporation ("Operator") for operational management of Bayshore, Normandy Shoes and Par Three Golf Courses. The Management Agreement established a schedule of maximum fees and charges which remained in effect from June 1986 until February 1988 . Pursuant to Resolution No. 88-19152 , adopted February 3 , 1988 , the City Commission approved a revised schedule of maximum greens fees and golf cart rental fees. Pursuant to Resolution No. 90-20082 , adopted September 5, 1990, the City Commission approved another revised schedule of maximum greens fees and golf cart rental fees. Later, in response to resident inquiries, the City Commission at its meeting on September 19 , 1990 set a date and time to reconsider the approval granted earlier to the revised schedule. BACKGROUND: Upon learning of the City Commission ' s scheduled reconsideration of the approval granted as noted above, the Operator scheduled a meeting with the Golf Advisory Board to review the proposal in light of the concerns raised by some walking golfers. The Golf Advisory Board reviewed a revised proposal at its meeting on October 5, 1990 and following. extensive discussions, approved it for recommendation to the City Commission. The revised proposal includes accommodations on the part of the Operator to allow Annual. Permit holders to golf by walking and pulling carts rather than renting golf carts during the Winter Season. ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission approve the attached Resolution rescinding Resolution No. 90-20082 in its entirety and authorizing the Mayor and City Clerk to execute the attached Resolution signifying approval of the revised golf course greens fees and golf cart rental fees, as described on Revised Exhibit "H" to the Management Agreement, Page 2 of 3 , effective November 1, 1990 .
