RESOLUTION 90-20180 RESOLUTION NO. 90-20180 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO INCREASE THE SCOPE OF THE GEORGE HYMAN CONSTRUCTION COMPANY CONTRACT FOR THE THEATER OF THE PERFORMING ARTS IN THE AMOUNT OF $730, 000; FOR THE PURPOSE OF INCREASING THE CONTRACT'S CONTINGENCY ALLOWANCES IN ORDER TO PAY FOR WORK ALREADY COMPLETED OR IN PROCESS AND TO REINSTATE DESIRED WORK WHICH WAS INITIALLY CANCELED THROUGH VALUE ENGINEERING. FUNDS ARE AVAILABLE FROM UNAPPROPRIATED BOND FUND NO. 356. WHEREAS, it is necessary and desirable to increase the scope of the Contract with George Hyman Construction Company to increase the existing Contingency Allowance; and, WHEREAS, it has been determined that the amount of $500, 000 i s necessary for completion; and, WHEREAS, it has been determined that an additional amount of $230, 000 is desired to reinstate those items which where canceled through value engineering; and, WHEREAS, funds are available from Bond Fund No. 356. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby authorizes the City Manager to increase the scope of the George Hyman Construction Company Contract for the Theater of the Performing Arts in the amount of $730, 000; for the purpose of increasing the Contingency Allowances in order to pay for work already completed or in process, and those items which were eliminated through the initial value engineering, and that these funds be placed in the contingency allowance and administered as part of the existing Contract. Funds are presently available from Bond Fund No. 356 . PASSED and ADOPTED this 21st day of November , 1990. Park %r City Manager SUBJECT: INCREASE IN THE SCOPE OF THE GEORGE HYMAN CONSTRUCTION COMPANY CONTRACT WITH THE CITY OF MIAMI BEACH FOR THE THEATER OF THE PERFORMING ARTS The Theater of the Performing Arts is now nearing completion. When the Contract was first awarded in 1988 several items were eliminated as part of the value engineering to establish the contract price at $15, 058, 000 including $1, 000, 000 for contingencies. We have overrun the original contingency allowance and require an additional amount of $500, 000 to pay for work already completed or in process. We also need to reinstate work deleted by value engineering or for work now considered desirable to enhance the overall appearance of the Theater. The estimated value of those items is an additional $230, 000 . All these items have been presented to the T.O.P.A. Ad Hoc Committee and have been formally approved (see attached) . Another item that was requested at the Ad Hoc Committee meeting was the restoration and relocation of the Mermaid sculpture. At this time, we do not have any idea as to the cost of .relocation or a location to move it to. This item will have to be brought back at a later date. At present, the work is progressing, and we anticipate that we will have the first show moving in on December 3 , 1990. We are confident that we will be ready for the first performance to be held on December 4, . 1990. After the completion 'of the initial shows through December 10, 1990, the Theater will again be closed till early January 1991. . It is during this time when we plan on accomplishing most of this new work. In any event, we do not feel that any work beyond early January 1991 would interfere with any scheduled events. . This increase plus the increase approved at the start of Phase III would bring the total contingency allowance to $2, 180, 000 or 14 .4% of the total cost. This is an acceptable contingency expenditure for a project of this nature. • ADMINISTRATION RECOMMENDATION It is the recommendation of the Administration, that the City Commission approve the attached Resolution increasing the scope of the George Hyman Construction Company Contract for T.O.P.A. in the amount of $730, 000, and further, that these funds be placed in the contingency allowance and administered as part of the existing Contract.
