A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, PROVIDING THAT EXCEPT AS OTHERWISE
PROVIDED BY THE MIAMI BEACH CITY CHARTER, RELATED LAWS,
OR CITY CODE, A WRITTEN CONTRACT, WRITTEN AGREEMENT OR
OTHER WRITTEN DOCUMENT WHEREIN THE CITY OF MIAMI BEACH IS
A PARTY OR IS OTHERWISE BOUND TO TERMS THEREOF MAY BE
NEGOTIATED BY THE CITY MANAGER AND SHALL BE PRESENTED TO
THE MIAMI BEACH CITY COMMISSION FOR REVIEW AND APPROVAL
WITH SUBSEQUENT EXECUTION THEREON BY THE MAYOR.
WHEREAS, under authority of the Miami Beach City Charter, the
Mayor of Miami Beach is the only City Official who may execute contracts
wherein the City is a party; and
WHEREAS, under the City of Miami Beach' s Commission/City Manager
form of government, the City Manager may negotiate the terms of written
documents in which the City of Miami Beach is a party or in which the
City is bound to the terms thereof; and
WHEREAS, consistent with the above, and pursuant to the theory that
no one individual has the power to independently bind a governmental
entity to terms of an agreement without the advice and consent of the
governing legislative body, all legal documents in which the City of
Miami Beach is one of the contracting parties or in which the City is
otherwise bound to the terms thereof must be presented to the Miami
Beach City Commission before execution by the Mayor may occur.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that except as otherwise expressly
provided by the Miami Beach City Charter, Related Laws, collective
bargaining agreements and matters related thereto, or City Code, any
written agreement, written contract, or other written document wherein
the City of Miami Beach is a party or is otherwise bound to the terms
thereof may be negotiated by the City Manager, and shall be presented to
the Miami Beach City Commission for review and approval with subsequent
execution thereon by the Mayor.
