A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, PROVIDING FOR THE 8TH AMENDMENT TO THE
FY 1990/91 POLICE CONFISCATED FUND BUDGET, PROVIDING FOR
THE RECEIPT AND TRANSFER OF $325,462 TO THE GENERAL
FUND.
WHEREAS, as part of a joint Federal/local drug forfeiture case, the
City of Miami Beach's Police Department, on May 22, 1991 received $325,462 from
the U.S. Department of Justice; and,
WHEREAS, these funds must be utilized for law enforcement purposes
by increasing and not supplanting the current appropriated operating budget; and
WHEREAS, such funds have previously been appropriated by Resolution
No. 91-20253 in the Police Department's General Fund budget for law enforcement
purposes; and,
WHEREAS, for internal fiscal and audit controls it is desirable that
such funds be first deposited in the Police Confiscated Fund and then transferred
to the General Fund.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, that the City Commission of the City of Miami Beach
hereby amends the FY 1990/91 Police Confiscated Fund Budget as follows:

SUBJECT: A RESOLUTION PROVIDING FOR THE 8TH AMENDMENT TO THE FY 1990/91 POLICE
CONFISCATED FUND BUDGET
BACKGROUND
During the Commission meeting of May 22, 1991, Dexter Lehtinen, United States
Attorney, presented the City of Miami Beach with checks totalling $325,462.02.
These funds represents Miami Beach's 50% share of the proceeds from of a joint
Federal local drug forfeiture case. These funds must be utilized for law
enforcementur oses by increasing and not supplant the current appropriated

operating budget.
Receipt of these funds had been anticipated and as such were previously

appropriated by Resolution No. 91-20253, on February
Department's General Fund budget for law enforcement purposes. However, for
internal fiscal and audit controls it is desirable that these funds be first
deposited in the Police Confiscated Fund and then transferred to the General
Fund.
In order to accomplish this, it is necessary to amend the Police Confiscated Fund
Budget.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt the attached
resolution providing for the 8th Amendment to the Police Confiscated Fund Budget.
