A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, REQUESTING THE CITY OF MIAMI
BEACH PLANNING BOARD TO GIVE CONSIDERATION TO
ALLOWING LIMITED ORGANIZED RELIGIOUS ACTIVITY IN
SINGLE FAMILY NEIGHBORHOODS AS CONDITIONAL
PERMITTED USES.
WHEREAS, during the period of February 1990 through September
1990 there were complaints and violations regarding organized
religious services being conducted at the property located at 3401
Prairie Avenue, Miami Beach; and
WHEREAS, the City of Miami Beach filed a complaint for
permanent injunction in Dade County Circuit Court in September of
1990 to enjoin the organized religious activities at 3401 Prairie
Avenue; and
WHEREAS, on September 21, 1990, the City Commission appointed
Dr. Leonard Haber to research and investigate possible resolutions
of the matter and Dr. Haber issued a report on March 5, 1991; and
WHEREAS, the legal proceedings in the Circuit Court action
were abated pending the report of Dr. Haber; and
WHEREAS, Dr. Haber's report concludes that the current
activities at 3401 Prairie Avenue do constitute a violation of the
current zoning and that the only solutions are to change the zoning
to permit limited organized religious activities in single family
neighborhoods or to proceed to enforce the zoning law as it stands;
and
WHEREAS, the City Commission wishes the City of Miami Beach
Planning Board to give consideration to changes in zoning in single
family residential areas to permit limited organized religious
activities as conditional permitted uses.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission of the
City of Miami Beach hereby requests the City of Miami Beach
Planning Board to give consideration to allowing limited organized
religious activity in single family neighborhoods as conditional
permitted uses.
