RESOLUTION 91-20320 RESOLUTION NO. 91-20320 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE DEPARTMENT OF NATURAL RESOURCES, THE GOVERNOR, AND HIS CABINET TO SET ASIDE THE METROPOLITAN DADE COUNTY, FLORIDA BOARD OF COUNTY COMMISSIONER'S RESOLUTION NO. R-571-91, IN FAVOR OF THE ALTERNATIVE PROPOSAL AS PROVIDED BY THE DEPARTMENT OF ENVIRONMENTAL RESOURCES MANAGEMENT FOR SEASONAL SPEED LIMIT RESTRICTIONS. Be it resolved by the City Commission of the City of Miami Beach, Florida, that Whereas, the use of Biscayne Bay and the Intracoastal Waterway (ICW) serve as both home to the West Indian Manatee, and a vital recreational resource which supports an entire marine industry in Dade County; and Whereas, the marine industry as well as the recreational boaters have recognized the importance of implementing a vessel restriction that will help to save the manatee and reduce boating accidents; and Whereas, the Department of Environmental Resources Management (DERM) has provided alternate plans to the more restrictive ones approved and recommended by the Metropolitan Dade County Commission, which environmentalists and researchers from the University of Miami have agreed would still provide a high degree of protection for the Manatee and would provide safety benefits for the boating public as well, while still permitting boaters to travel at a reasonable speed and to enjoy waterskiing at specific locations during the most popular boating season; and Whereas, the City Commission of the City of Miami Beach is interested in protecting the rights of both the West Indian Manatee and the commercial establishments that rely on the ICW and Biscayne Bay for their livelihood, i .e. boat rental companies, fuel docks and marinas, restaurants on the water, jet ski and para-sail operators as well as commercial fishing vessels and boat manufacturers; and Whereas, the City Commission strongly believes that the vessel restrictions as recommended by the County Commission will tempt owners of small craft, (25 f t. and under) which make up the vast majority of registered boats in Dade County to attempt to negotiate the treacherous waters in Government cut out into the ocean in order to either save travel time or to enjoy waterskiing, which we fear will result in tragic and unnecessary loss of human life; and Whereas, a compromise position acceptable to both environmentalists and the vast boating community already exists which meets the objectives of the County Commission resolution. Now, therefore, be it resolved by the City Commission of the City of Miami Beach, Florida, that it urges the Department of Natural Resources, The Governor, and His Cabinet to set aside Metropolitan Dade County, Florida Board of County Commission Resolution No. R-571-91, in favor of the alternative proposal provided by DERM for seasonal speed limit restrictions. Dear Ms. McVety: Following the Governor and Cabinet' s request of 13 counties, Dade County being one; our Department of Environment Resources Management (DERM) , pursued the collection of a scientific data base upon which to base conclusions regarding manatees and the areas within our waterways where they frequent, their injuries/mortality and boating activity. After approximately 2 years of this effort DERM issued. its recommendations (attached memo from Manager) designed basically t0 provide the highest degree of protection for manatees in those areas where the documentation clearly established congregation or travel corridors. While not recommending them, DERM outlined alternatives, including relaxingthe speed restrictions from May to October, reducing the limited entry zone in the Coral Gables Waterway, and providing for summer water skiing areas • in North Bay. After a public hearing, the Board approved the attached Resolution basically taking the same. position that DERM took in its recommendation. The Board found that current procedures allowed for DNR to grant exemptions to commercial fishermen, fishing guides and boat manufacturers after a proper showing. In addition, the Board found that the DERM plan did provide a minimally restricted north/south route on the east side of the Bay. These were factors which it was felt provided a degree of relief for the boating community where justified. The plight of the manatee and the growing number of boating accidents involving human injury and/or fatality is more than coincidental. This recommendation, which has been developed in response to- a mandate from the Florida Governor and Cabinet, has been reviewed and placed on the agenda at the request of the Environment and Land Use Committee . . .•• - - BACKGROUND In October 1989 , the Florida Governor and Cabinet directed 13 counties , including Dade , to develop comprehensive manatee protection plans . Because vessel collisions are the leading cause of human-related manatee death statewide , the Florida Department of Natural Resources ( FDNR) has placed priority on the development of vessel speed limits and related restrictions to protect manatees and their habitats . The State is now preparing a vessel speed rule for Dade and is avaiting a formal recommendation from the Dade County Board of g • County Commissioners . The FDNR desires to! conduct hearings andP resent the rule to the Governor and Cabinet for final consideration this summer. Pursuant to the State mandate , the Department of Environmental Resources Management (DERM) has been collecting data on manatee distribution and mortality and boating activities in Dade County. Based on the scientific data available, DERM has identified areas frequented by manatees and has proposed vessel speed limits and • sanctuary • zones to protect these areas . Year-round "slow speed/minimum wake" zones recommended by DERM include tributaries , 1 , 000-foot-wide shoreline buffer zones in most of north Biscayne Bay and portions of south Biscayne Bay, and several lakes and canals in north Dade (vessels traveling at "slow speed/minimum wake" must not make excessive wake or be on plane ; for most vessels , this is approximately 7-8 miles per hour ) . The most controversial portion • of the proposal involve speed limits on the ICW, waterskiing in north Biscayne Bay, and limited entry the Coral inGables Waterway. After receiving public comment and considering May alternative staff proposals, these committees recommended that the Board of , County Commissioners approve DERM' s more • restrictive March 26 proposal and modified this plan to include additional "slow speed" areas to protect seagrass beds north and south of Julia Tuttle Causeway. C V a I d O 1 Commission Memorandum Page 2 June 19, 1991 The Administration believes that the proposed restrictions would create an undue burden, both on the boating public and the marine industry. Also, they will force vessels wishing to transit Biscayne Bay to use the Meloy Channel, which parallels the Miami Beach coastline, and was not designated to handle the amount of traffic that would result. Therefore, we are recommending that the FDNR review the proposal as submitted by the Dade County Commission, and adopt the seasonal recommendation that DERM proposed, which would be acceptable to both the boating public and the environmentalists. This approach would provide somewhat less protection for the manatees, it would allow boaters to travel at reasonable speed during the most popular boating season, and still provide some boating safety benefits. ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission adopt the attached resolution urging the Florida Department of Natural Resources to reconsider the proposed restrictions submitted by Dade County and adopt the less restrictive alternative proposed by the Department of Environmental Resources Management.
