A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AN
AMENDMENT TO THE MANAGEMENT AGREEMENT BETWEEN
THE CITY OF MIAMI BEACH PARKING DEPARTMENT AND
BEACH PARKING SYSTEMS, INC, (BPS) FOR
PROVISION OF POLICE SERVICES FOR ADDITIONAL
SECURITY IN THE GARAGE ON WEEKENDS AND
EVENINGS AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE THE FIRST AMENDMENT.
WHEREAS, the City Commission executed a contract with Beach
Parking Systems, Inc. (BPS) , for the management and operations of
the 17-A Municipal Parking Garage; and
WHEREAS, BPS has identified the need to provide off-duty
police officer services on weekend days and evenings; and
WHEREAS, this additional service will enhance the security
system of the garage as well as traffic control ; and
WHEREAS, the cost for these additional services will be
$8, 800. 00 annually; and
WHEREAS, BPS has already paid for an off-duty Miami Beach
Police officer to assist with security and traffic control during
the first three months of the contract period.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission of the
City of Miami Beach, Florida, authorizes the Mayor and City Clerk,
on behalf of the City, to execute the First Amendment to the
Management Agreement between the City of Miami Beach and Beach
Parking Systems, Inc. , to provide for the costs for off-duty Miami
Beach Police Officer services on weekends and increasing the
contract amount by $8, 800. 00 annually.

SUBJECT: AMENDMENT No. 1 TO THE MANAGEMENT AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH PARKING DEPARTMENT AND BEACH PARKING SYSTEMS, INC. , FOR
PROVISION OF POLICE SERVICES FOR ADDITIONAL SECURITY IN THE GARAGE
ON WEEKENDS AND EVENINGS.
On March 20, 1991, Commission Resolution No. 91-20268 was adopted, authorizing
the Mayor and City Clerk to execute an agreement with Beach Parking Systems,
Inc. , to manage and operate the municipal parking garage located on the northeast
corner of 13th Street and Collins Avenue (commonly known as 17A) . The original
contract provided for maintenance, operations, and security services for an
initial period of three years. During the first three months of operation, the
contractor had noticed that the volume of business on weekend days and nights
increases substantially; requiring the need to hire off-duty police officers.
Due to the nature of the traffic and security control , BPS has paid for these
additional services without the request for an increase. However, since this
service would appear to be a regular requirement to enhance the garage's
operation, BPS representatives have requested that their base management fee of
the contract be increased by $8,800.00. BPS will be responsible for hiring off-
duty Miami Beach Police Officers to work at the facility; providing enhanced
security, police visibility and uniform traffic control .
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the attached
resolution which authorizes the Mayor and City Clerk to execute an amendment to
the management agreement between the City and Beach Parking Systems, Inc. ,
increasing the contract by $8,800.00 for the purpose of providing off-duty police
officer security on weekends.

THIS FIRST AMENDMENT TO THE AGREEMENT is made and entered into this
10th day of July , 1991, by and between the City of Miami
Beach and Beach Parking Systems, Inc. (BPS) .
WITNESSETH
WHEREAS, pursuant to Resolution No. 91-20268, the City of
Miami Beach and Beach Parking Systems, Inc. (BPS) entered into a
Management Agreement for the Municipal Parking Garage 17-A, the
("Agreement") ; and
WHEREAS, the contractor wishes to amend the Agreement to
provide for additional security utilizing off-duty Miami Beach
Police Officers for enhanced security and traffic control on
weekend days and evenings; and
WHEREAS, the cost for these additional services are projected
to be $8, 800. 00 for the duration of the current year.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, and other good and valuable consideration, the
receipt of which is hereby acknowledged, the parties hereby agree
as follows:
1. The following provisions shall be added to the Agreement:
I. Under "SCOPE OF WORK" add the following:
(f) (1) Contract for a minimum of one (1) off-duty Miami
Beach Police Officer for increased security and traffic
control on weekends and other special event days on which
increased usage levels reflect a need for such increased
security as deemed reasonably necessary.
III. Under "CONSIDERATION", add the following to
paragraph III A:
The compensation for services as defined in paragraph I
(f) (1) above shall not exceed $8, 800. 00 for the remainder
of the current year of the contract. This $8 , 800 fee
shall be allocated in equal monthly installments and
shall be included as an increase in the base management
fee paid to BPS.
2 . The Parties hereby ratify and confirm all other terms and
conditions of the Agreement which remain unchanged.
