RESOLUTION 91-20394 RESOLUTION NUMBER 91-20394 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE OPTION TO RENEW THE LEASE OF THE COLONY THEATER TO THE CONCERT ASSOCIATION OF GREATER MIAMI , INC. FOR A THREE YEAR PERIOD TERMINATING THE 31 DAY OF AUGUST, 1994, AS PROVIDED IN RESOLUTION # 88-19309 WHEREAS, the City of Miami Beach has leased the property known as the Colony Theater, located at 1040 Lincoln Road, to the Concert Association of Greater Miami , Inc. ; and WHEREAS, the lease .Approved by Resolution # 88-19309 has an option for a three year renewal at a renegotiated subsidy amount; and WHEREAS, the City of Miami Beach is desirous of maintaining the use of this property as a Performing Arts Center; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the mutual covenants contained in the prior lease be extended through the three year option period at a reduced subsidy of $85,000 the first year, $80,000 the second year, and $75,000 the third year. WHEREAS, the Lease Agreement between the lessor and lessee dated July 29, 1988 contains in Section 3 an option to extend the lease for a period of three years; and WHEREAS, the option to extend the Lease Agreement contains a provision to renegotiate the operating subsidy contained in Section 24; and WHEREAS, both parties are desirous to extend the lease on a re- negotiated basis; NOW THEREFORE, the mutual considerations contained in original lease are extended until August 31, 1994 under the provisions of Section 3 of that lease; and THAT Section 24 of the lease be amended to provide an operating subsidy of $85,000 for the year ending August 31, 1992; $80,000 for the year ending August 31, 1993; and $75,000 for the year ending August 31, 1994. This lease arrangement, under which the Concert Association of Greater Miami , Inc. was a successful proposer, included a three year option to extend the contract through 1994. Both the Admin- istration and the Concert Association have been pleased with the operations of the Colony Theater under the Concert Association' s management. The operation subsidy which was included in the original contract has been renegotiated as required by the pro- visions of the option and the City' s cost to be reduced $5,000 per year beginning this year through the termination of the contract. 4DhlINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt this Resolution to extend the lease of the Colony Theater to the Concert Association of Greater Miami , Inc. until August 31, 1994.
