Resolution 2019-30946 RESOLUTION NO. 2019-30946 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND/OR AUTHORIZING THE CITY MANAGER TO PERFORM THE FOLLOWING ACTIONS: (1) TO RECAPTURE $128,095.00 OF HOME INVESTMENT PARTNERSHIP (HOME) FUNDS PREVIOUSLY ALLOCATED TO THE LOTTIE APARTMENTS REHABILITATION AS ENTITLEMENT FUNDS FOR THE FY 18/19 ACTION PLAN AND FIVE YEAR CONSOLIDATED PLAN FOR FY 2017-2022, AND TO REALLOCATE SAID FUNDS TO THE MADELEINE VILLAGE APARTMENTS REHABILITATION PROJECT; (2) TO ALLOCATE $108,563.93 OF UNALLOCATED HOME INVESTMENT PARTNERSHIP (HOME) FUNDS PREVIOUSLY ALLOCATED TO THE FY 19/20 REQUEST FOR PROPOSALS FOR HOME AND CDBG FUNDS, AND TO REALLOCATE SAID FUNDS TO THE MADELEINE VILLAGE APARTMENTS SEAWALL PROJECT; (3) TO ALLOCATE $95,716.00 OF FY 18/19 COMMUNITY HOUSING DEVELOPMENT ORGANIZATION (CHDO) FUNDS TO THE MADELEINE VILLAGE APARTMENTS REHABILITATION PROJECT; AND 4) TO SUBMIT THE REVISED ACTION PLANS AND CONSOLIDATED PLANS TO HUD; AND FURTHER AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE CITY INTERDEPARTMENTAL AGREEMENTS AND DOCUMENTATION AS REQUIRED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD). WHEREAS, the City is an entitlement recipient of HUD formula grant programs as follows: Community Development Block Grant (CDBG) fund, and HOME Investments Partnership (HOME)funds; and WHEREAS, the Action Plan for federal funds is a requirement under HUD's formula grant programs, which include the CDBG and HOME programs and delineates the specific projects and activities funded by each year's HUD allocation; and WHEREAS, the five-year Consolidated Plan is augmented and refined by the City's annual submission of the one-year Action Plan; and WHEREAS, the City allocated HOME and CDBG funds to the Lottie Apartments rehabilitation project, which is divided in two phases; and WHEREAS, pursuant to Resolutions No. 2016-29420 and 2017-29803, the Mayor and City Commission approved the allocation of HOME funds, in the amount of $464,816.34, to Phase 1 of the Lottie Apartments rehabilitation project; and WHEREAS, pursuant to Resolution No. 2018-30390, the Mayor and City Commission approved the allocation of HOME funds, in the amount of$475,580.00, for Phase 2 of the Lottie Apartments rehabilitation project; and WHEREAS, pursuant to Resolutions No. 2017-29876 and 2018-30135, the Mayor and City Commission approved the allocation of HOME funds to the Madeleine Village Apartments for the rehabilitation of the project, including the restoration of the seawall, and the relocation of tenants; and WHEREAS, the Madeleine rehabilitation project and the seawall restoration project are at a 95% completion phase; and WHEREAS, based upon additional requirements associated with LEED certification, City staff identified a funding gap of $108,000.00 for the Madeleine Village Apartments seawall restoration and $205,000.00 for the rehabilitation project and relocation of tenants; and WHEREAS, City staff identified funding from the following sources: 1) $108,563.93 in unallocated funds from the FY 19/20 HOME Request for Proposals (RFP); 2) $128,095.00 from the recapture of FY 18/19 Lottie Apartments rehabilitation project funds; 3) $95,716.00 from the FY 18/19 HOME CHDO reserve allocation; and WHEREAS, the City released an RFP for FY 19/20 HOME and CDBG funds on January 27, 2019 and no proposals were received for HOME, however, it was determined that one of the CDBG proposals submitted by the Housing Authority of the City of Miami Beach, in the amount of$300,000.00, was an appropriate HOME capital project; and WHEREAS, there are $108,563.93 unallocated funds from the FY 19/20 HOME RFP; and WHEREAS, City staff has recommended the recapture of$128,095.00 of funds from Phase ll the Lottie Apartments rehabilitation project; and WHEREAS, the City received $95,716.00 for the FY 18/19 HOME CHDO reserve allocation; however, on March 7, 2019, HUD sent notice that the Consolidated Appropriations Act of 2019 includes a provision suspending the 24-month commitmentrequirement for the CHDO set-aside funds through December 31, 2021; and WHEREAS, the resulting HOME and CDBG funds recapture will be incorporated into the City's various Action Plans and 2017-2022 Consolidated Plan and Capital budgetary documents; and WHEREAS, as per the Citizen Participation Plan, a change of use triggers a minor Amendment; and WHEREAS, the City Manager is the designated agent for all HUD formula grants and executes the grant applications, grant agreements, and other applicable HUD documents on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the City Manager to perform the following actions: (1) to recapture $128,095.00 of HOME Investment Partnership (HOME) funds previously allocated to the Lottie Apartments rehabilitation as entitlement funds for the FY 18/19 action plan and five year consolidated plan for FY 2017-2022, and to reallocate said funds to the Madeleine Village Apartments rehabilitation project; (2) to allocate $108,563.93 of unallocated HOME funds previously allocated to the FY 19/20 Request for Proposals for HOME and CDBG funds, and to reallocate said funds to the Madeleine Village Apartments seawall project; (3) to allocate $95,716.00 of FY 18/19 Community Housing Development Organization (CHDO) funds to the Madeleine Village Apartments rehabilitation project; and 4) to submit the revised action plans and consolidated plans to HUD; and further authorize the City Manager and City Clerk to execute City interdepartmental agreements and documentation as required by the U.S. Department of Housing and Urban Development(HUD). RECOMMENDATION Adopt the resolution recapturing and reallocating HOME funds. ANALYSIS As an entitlement community, the City is required to submit an annual One-Year Action Plan describing how it will utilize funding and resources to address priority needs identified in the City's five-year Consolidated Plan. The City allocated $464,816.34 in HOME Investment Partnership (HOME)funds to the Lottie Apartments rehabilitation project, a nine-unit multifamily affordable housing building via resolutions 2016-29420 and 2017-29803 and their respective Action Plans. The substantial rehabilitation of the Lottie Apartments was divided in two phases and Phase 1 includes, but is not limited to: termite treatment, roof repair/ replacement, and Page 317 of 2228 kitchen and bathroom renovations of four units. The FY 18/19 Action Plan, approved via resolution 2018-30390, authorized the use of HOME funds for Phase 2 of the rehabilitation of the Lottie Apartments in the amount of $475,580, to complete the rehabilitation of the remaining five units and their temporary relocation. The Lottie Apartments Phase 2 will not commence until one year after the last building permit is finalized for phase one, which is estimated to be October 2020. The FY 17/18 Action Plan approved via resolution no. 2017-29876, authorized the use of HOME funds in the amount of $316,448 for the rehabilitation and relocation of the Madeleine Village Apartments, a 16-unit multi-family affordable building, located at 7861-7871 Crespi Blvd, within a historic district. The City will complete two capital projects utilizing HOME and CDBG funds: 1) the rehabilitation of the apartment building adhering to Leadership in Energy and Environmental Design (LEED) standards; and 2) the restoration of the seawall, to elevate it to the required by city code. The design phase is 95% completed for both projects and in the preparation of bid documents for the procurement of a qualified contractor, HCS staff identified a funding gap and funding allocations in the following amounts, as illustrated below. Madeleine Village Seawall $108,000 -$108,563.93, unallocated funds from Restoration FY 19120 HOME RFP Madeleine Village $205,000 -$128,095 recapture of FY 18/19 Apartments Rehabilitation Lottie Apartments rehabilitation funds Project -$95,716 FY 18/19 HOME CHDO allocation The FY 18/19 Action Plan also included $95,716 of HOME funds set-aside funding allocation for Community Development Housing Organization(CHDO). However, on March 7, 2019, HUD sent notice that the Consolidated Appropriations Act of 2019 includes a provision suspending the 24-month commitment requirement for the CHDO set-aside funds through December 31, 2021. The reallocation of funds will be included in the capital budget documents for FY 19/20 accordingly. Once funds are allocated to the projects, HCS will collaborate with the Procurement Department to issue the Invitation to Bid (ITB) for the rehabilitation of the apartments and an invitation to Quote (I TQ)for the seawall restoration project. CONCLUSION The Administration recommends approval and authorization of the actions proposed above, the subsequent submission to HUD of amended multiple year Action Plans and multiple year Consolidated Plans as amended herein, and authorizing the City Manager to execute all required documents as delineated herein.
