RESOLUTION NO. 92-20450
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA AUTHORIZING THE CITY ADMINISTRATION TO
TAKE ALL NECESSARY STEPS 'i1.) COMPLY WITH CHAPTER 163 OF
THE FLORIDA STATUTES REGARDING THE ADOPTION OF A
COMPREHENSIVE PLAN FOR THE CITY OF MIAMI BEACH, FLORIDA
AND AUTHORIZING A BUDGET TRANSFER, IF NECESSARY, FOR THE
PROCESS.
WHEREAS, in October of 1989, the City of Miami Beach adopted
a Comprehensive Plan pursuant to the dictates and requirements of
Chapter 163 of the Florida Statutes; and
WHEREAS, the Third District Court of Appeal has issued an
opinion which states that the publication of notice of the plan
adoption was improper; and
WHEREAS, in order to insure that the City of Miami Beach has
a legally adopted Comprehensive Plan in order to comply with state
law, the Mayor and City Commission wish to authorize the City
administration to take all steps necessary for the City to have a
validly enacted Comprehensive Plan.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that:
Section 1.
The City administration is hereby authorized to take all
necessary steps to comply with all requirements for the adoption of
the 1989 Comprehensive Plan and also authorizing administration to
consider the utilization of the Dade County's Comprehensive Plan,
on an interim basis, if necessary.
Section 2 .
Funds for the adoption process and all matters related to the
Comprehensive Plan process shall be as required by the
administration and any necessary budget transfer is hereby
authorized.
