RESOLUTION 92-20497 • 4 RESOLUTION NO. 92-20497 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING AND SUPPORTING THE ADMINISTRATION'S EFFORTS TO ENTER INTO DISCUSSIONS WITH THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL, THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS, AND ANY OTHER AGENCIES TO ENCOURAGE HOTEL DEVELOPMENT IN MIAMI BEACH BY EXEMPTING SUCH HOTELS FOR DEVELOPMENT OF REGIONAL IMPACT REVIEW. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT: WHEREAS, the City Commission acknowledges the need to encourage the development of one or more Convention Center hotels in Miami Beach; and WHEREAS, at the present time, any proposed hotel over 350 rooms is required to undergo a Development of Regional Impact review; and WHEREAS, there are potential regional and State legislative amendments which can be pursued to eliminate or reduce the requirements for Development of Regional Impact review for proposed hotels; and WHEREAS, in a March 13 , 1992 letter to State Representative Elaine Bloom, the Secretary of the Department of Community Affairs expressed his support for an amendment to the Regional Plan to encourage hotel development in Miami Beach. NOW THEREFORE BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF MIAMI BEACH hereby authorizes and supports the Administration= s efforts to enter into discussions with the South Florida Regional Planning Council, the Florida Department of Community Affairs, and any other agencies to encourage hotel development in Miami Beach by exempting such hotels from Development of Regiona, Impact review. My understanding is that the principal objective is to locate a hotel adjacent to or in the immediate vicinity of the convention center, as an adjunct to the convention center, although it is possible that the hotel may be located outside • the immediate vicinity of the convention center. I have discussed your inquiry with members of my staff and with the staff of the South Florida Regional Planning Council (SFRPC) . Based on those discussions, I am comfortable confirming the following to you. As 1 have told you, it is my strong belief that the City ought to proceed to develop a master or downtown D.R. I. to - maximize its competitive ability to attract new hotel development to Miami Beach. . By completing an appropriate D.R. I. process itself, the City can eliminate the need for certain future developers to engage in the D.R.I. process. Although the early such D.R.I . 's took a long time to complete, the process is far more routine today, so that it doesn't take nearly as long. In addition, because of your expressed concern that a hotel D.R.I, for Miami Beach would likely take unreasonably long, . I have discussed the subject with the South Florida Regional Planning Council staff. I commit to you that p this Department will accord comparable priority treatment to such a DRI, t although we are subject to g � c some short statutory time limits with which we must comply. Moreover, both the SFRPC and this Department commit to provide senior D.R. I. staff to assist such a hotel developer in there aration of its D.R. I. application. P P Finally, this will confirm that the Department of Community Affairs (DCA) 'will not ob ect� to at least one site on Miami Beach, not be located in the coastal high hazard area, being designated as highly suitable gng y for a 750-room resort or conference hotel, to be effectuated pursuant to the provisions of Section 380. 0651 (3) (g) 2, F. S. In order to accomplish this, the South Florida Regional Planning Council would need to propose an amendment to p �' its comprehensive regional policy plan, send it to DCA for our review and adopt by rule the specific geographic site within Miami Beach where the 750-room resort or conference hotel threshold would apply. Once the 750-room threshold is in effect a 600-room resort or conference hotel could then be built without D.R. I. review. It would also be possible toro ose construction P p of a resort or conference hotel between 600 and 750 rooms, which would be presumed to not' require D.R. I. review. However, as I indicated, such a hotel may be subject to a bindinglettr procedure determining that the hotel impacts would not require the need for DRI review. I have discussed the foregoing with SFRPC staff and they agree that it i s acceptable.ptable. Thein' only request was that the City coordinate with the SFRPC in respect to hurricane evacuation planning. Carlton City Manager er !• SUBJECT: A RESOLUTION AUTHORIZING THE CITY ADMINISTRATION TO ENTER INTO DISCUSSIONS WITH THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL AND OTHER AGENCIES TO PROVIDE LEGISLATIVE AMENDMENTS TO ENCOURAGE HOTEL DEVELOPMENT IN MIAMI BEACH For the past several years, the City has been pursuing various options - legal, financial, and legislative - which would improve our chances of attracting a major hotel developer to construct a convention center hotel in Miami Beach. One series of options which are being seriously considered are amendments to state and regional legislation which would exempt large hotels from an extensive "Development of Regional Impact" (DRI) review process, which is presently required for any hotel with 350 rooms or more. What is a DRI? A Development of Regional Impact, as defined in Section 380. 06, FS is "any development which, because of its character, magnitude, or location, would have a substantial effect upon the health, safety, or welfare of citizens in more than one county" . Specific development thresholds have been established which would trigger a DRI. Those which are of concern to the- City of Miami Beach include the following: 1. Residential dwelling units 3 , 000 2 . Hotel/Motel units 350 In order to receive DRI approval, a project must undergo extensive review by a number of state and regional agencies, including the Department of Community Affairs, Department of Natural Resources, Department of Transportation, Department of Environmental Regulation, South Florida Regional Planning Council, and South Florida Water Management District, among others. It generally takes one to two. years to obtain these approvals and it costs the applicant approximately $500, 000 to prepare the DRI application. Several developers have indicated to members of the City Administration that the ability to waive the DRI process would be extremely desirable, and that the cost and lengthy DRI review process act as a disincentive for hotel development. 142 AGENDA ITEM DATE 41- 2 4, IOU !, h I (-'01 ' • i •i • There are provisions in Chapter 380 which permit the .hotel threshold to be increased to 750 rooms in counties with populations greater than 500, 000 and only in geographic areas specifically designated as highly suitable for increased threshold intensity in the approved local comprehensive plan and the comprehensive regional policy plan. In October, 1990, the City of Miami. Beach adopted language in its comprehensive plan to approve the increased threshold for hotel development. The City Administration believes that it is in the best interest of the City of Miami Beach to pursue discussions with the South Florida Regional Planning Council, the Florida Department of Community Affairs, and any other pertinent agencies to accomplish these modifications to State and/or regional legislation to encourage the development of one or more convention center hotels. The Administration is therefore requesting authorization from the City Commission to enter into these discussions.
