Resolution 2019-31054 RESOLUTION: 2019-31054 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE FINANCE AND CITYWIDE PROJECTS COMMITTEE AT ITS SEPTEMBER 20, 2019 MEETING, TO ENGAGE A RATE CONSULTANT TO ASSIST THE CITY IN DEVELOPING MONTHLY USER FEES FOR STORMWATER SYSTEM "TIE-INS," FOR PROPERTIES (OTHER THAN SINGLE FAMILY HOMES) THAT ARE NOT CURRENTLY MAINTAINING THEIR OWN STORMWATER MANAGEMENT SYSTEM ON-SITE AND CONNECT TO THE CITY'S STORMWATER MANAGEMENT SYSTEM TO HANDLE THEIR STORMWATER VOLUME. WHEREAS, on April 26, 2017, the Mayor and City Commission adopted Resolution No. 2017- 29840, to develop a policy and engineering solution for a stormwater system that would have the capacity to allow private property owners to connect to the City's municipal stormwater system; and WHEREAS, following the adoption of Resolution No. 2017-29840, certain low-lying commercial properties were permitted to be connected into the City's stormwater system; and • WHEREAS, a stormwater management fee was contemplated as part of the drainage connection permit provided to the commercial properties that are tied into the City's stormwater system, to assess costs to the beneficiaries who"tie-in"or connect to the City's stormwater utility, based on their relative contribution to the City's stormwater utility system's needs; and WHEREAS, currently, the stormwater fee for properties that connect to the City's stormwater system has not yet been established. However, the runoff shed by these properties flows into the City's system, which results in costs to the City's stormwater enterprise fund; and WHEREAS, the foregoing costs include operational and maintenance expenses as well as the added capital costs due to capacity constraints; and WHEREAS, although there are only a few properties that have connected to the City's stormwater system, these commercial properties deferred any upfront capital expenses required to construct on-site stormwater management systems to handle their own stormwater volume on-site; and WHEREAS, a dedicated stormwater management fee would offset the costs incurred by the City for these commercial properties; and WHEREAS, the City has historically engaged a rate consultant to establish reasonable fees for its utility systems; and WHEREAS, on September 20, 2019 meeting, the Finance and Citywide Projects Committee recommended engaging a rate consultant to assist in development of monthly user fees for properties (other than single family homes)that are not currently maintaining their own stormwater systems onsite and connect to the City's stormwater system. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Finance and Citywide Projects Committee at its September 20, 2019 meeting, to engage a rate consultant to assist the City in developing monthly user fees for stormwater system "tie-ins," for properties (other than single-family homes) that are not currently maintaining their own stormwater management system on-site and connect to the City's stormwater management system to handle their stormwater volume. Morales, City Manager DATE: October 16, 2019 SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE FINANCE AND CITYWIDE PROJECTS COMMITTEE AT ITS SEPTEMBER 20, 2019 MEETING, TO ENGAGE A RATE CONSULTANT TO DETERMINE THE VALUE OF TIE-INS FOR COMMERCIAL PROPERTIES THAT ARE NOT CURRENTLY MAINTAINING THEIR OWN STORMWATER IN ORDER TO DEVELOP A MONTHLY FEE FOR THESE PROPERTIES. RECOMMENDATION The Administration rgcommends approving the Resolution. BACKGROUND/HISTORY On April 26, 2017, the City Commission resolved, via Resolution No. 2017-29840, to develop a policy and engineering solution for private property owners within the City's municipal stormwater system. Following this ordinance, certain low-lying commercial properties were permitted to be connected into the City's stormwater system. ANALYSIS A stormwater management fee was contemplated as part of the drainage connection permit provided to commercial properties that are tied into the City's stomiwater system. Currently, this fee has not been established. However, the runoff shed by these properties flows into the City's system which results in costs to the City's stormwater enterprise fund. These costs include operational and maintenance expenses as well as the added capital costs due to capacity constraints. There are only a few properties that fall into this category. These commercial properties deferred any upfront capital expenses required to retain their stormwater onsite. A dedicated stormwater management fee would offset the costs incurred by the City for these commercial properties. City staff recommended referring this item to the Finance and Citywide Projects Committee for concurrence in developing a commercial property stormwater connection and usage fee that accurately captures the costs associated with these tie-ins. The City has historically engaged a rate consultant to establish reasonable fees for such purpose and is prepared to move in that Page 2357 of 2557 direction. At its September 20, 2019 meeting, the Finance and Citywide Projects Committee made a motion to proceed with engaging a rate consultant to determine the value of these tie-ins for commercial properties that are not currently maintaining their own stormwater in order to develop a monthly fee for these properties.
