RESOLUTION 92-20500 not executed • RESOLUTION NO. 92-20500 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH EUNICE L. MARTIN TO ACT AS LEGAL COUNSEL FOR THE CITY'S CODE ENFORCEMENT BOARD. WHEREAS, the City Commission believes that the City's Code Enforcement Board should have independent legal counsel ; and WHEREAS, Eunice L. Martin has served successfully and is currently serving as a Special Master and Hearing Officer for fire code violations in the City of Miami Beach; and WHEREAS, Eunice L. Martin is a highly qualified and competent attorney who also serves as a Traffic Magistrate for Dade County; and WHEREAS, the Administration has recommended that the City Commission authorize the City Manager to enter into an agreement with Eunice L. Martin to act as Legal Counsel to the City' s Code Enforcement Board for compensation in the amount of two hundred dollars ($200) per day for a term of twelve months; provided that the agreement may be renewed annually upon mutual consent of the City Manager and Ms. Martin, with either party having the right to sever the agreement upon thirty (30) days prior written notice to the other party. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: that the City Commission hereby authorizes the City Manager to enter into an agreement with Eunice L. Martin to act as Legal Counsel to the City' s Code Enforcement Board for compensation in the amount of two hundred dollars ($200) per day for a term of twelve months; provided that the agreement may be renewed annually upon mutual consent of the City Manager and Ms. Martin, with either party having the right to sever the agreement upon thirty (30) days prior written notice to the other party. The following course of action is suggested: One of the current three attorneys who sits as a Special Master and Hearing Officer for our Fire Code Violations is recommended to be the Legal Counsel for the Code Enforcement Board. Ms. Martin is a highly qualified and competent attorney who also sits as a Traffic Magistrate. Her resume is attached for your review. Ms. Eunice L. Martin would receive two hundred dollars ($200.00) per day for her services as Legal Counsel for the Code Enforcement Board. ADMINISTRATION RECOMMENDATION It is the recommendation of the Administration that the City Commission authorize the City Manager to enter into an Agreement with Ms. Martin to act as Legal Counsel for the Code Enforcement Board. The terms and conditions will provide for two hundred dollars ($200.00) per day fee and the term to be twelve months from the date of Commission approval.
