RESOLUTION NO. 92-20506 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER A RECOMMENDATION OF THE PLANNING BOARD ON THE FOLLOWING: AMENDING COMPREHENSIVE ZONING ORDINANCE NO. 89-2665, AMENDING SECTION 6, ',SCHEDULE OF DISTRICT REGULATIONS," AMENDING SUBSECTION 6-2, ENTITLED "RM-1, RESIDENTIAL MULTI-FAMILY, LOW INTENSITY" BY ADDING A HEIGHT RESTRICTION FOR SITES THAT ARE ADJACENT TO A WATERWAY AND WITHIN 200 FEET OF A SINGLE FAMILY DISTRICT; PROVIDING FOR INCLUSION IN THE ZONING ORDINANCE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, this amendment would limit the height of multi-family development in the RM-1 zoning classification on sites within two hundred feet of single family districts; and, WHEREAS, the Planning Board of the City of Miami Beach held a public hearing on April 21, 1992 and voted 6-1 to recommend in favor of this amendment to Zoning Ordinance 89-2665; and, WHEREAS, said action of the Planning Board has been duly transmitted to the City Commission pursuant to Section 14 , entitled "Changes and Amendments" of Zoning Ordinance No. 89-2665, and Section 14 requires that a public hearing be held by the City Commission to hear the Planning Board's recommendation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing for consideration of the aforementioned amendment to the Zoning Ordinance is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, on June 3 , 1992 , beginning at 4 : 50 P.M. and the City clerk is hereby aut ized and directed to publish appropriate Public Notice of the id Public Hearing in a newspaper of general circulation of the it of Miami Beach, at which time and place all i 1erested parties will be heard. Carlton( City Manager ' �, CL • SUBJECT: AMENDMENT TO ZONING ORDINANCE 89-2665 RELATIVE TO AMENDING THE RM-1, RESIDENTIAL MULTI-FAMILY LOW INTENSITY DISTRICT MAXIMUM BUILDING HEIGHT -.SETTING OF PUBLIC HEARING ADMINISTRATION RECOMMENDATION The Planning Board has recommended approval of this amendment to Zoning Ordinance No. 89-2665. Accordingly, the Administration recommends that the Commission set a public hearing date for its consideration. Further, since this matter is related to the proposed re- zoning of the Sunset Harbor site which is to be heard by the Commission on June 3, 1992 it is recommended that this hearing be set as a companion item on the same date. BACKGROUND The City Administration, through the Miami Beach Planning Board, has requested that an amendment to the Zoning Ordinance be considered, which would place a height restriction on sites located in the RM-1 District. The sites affected would be those adjacent to a waterway and within 200 feet of a single family district. At the April 21, 1992 meeting of the Planning Board, the proposed amendment was recommended for approval, 6-1. On March 9, 1992, the Planning Board passed a motion to re-zone that portion of the Miami Beach Yacht Club (a/k/a Sunset Harbor) site that is located along the canal from RM-3 to RM- 1. Included in that motion was a provision that the RM-1 District regulations be amended to include a height restriction. It was noted that the RM-1 District in the Architectural District has a height limitation of 40 feet and that this should be the height restriction for the amended RM-1 District. ANALYSIS The major expressed concern on this issue was the proximity of the high-rise multi-family district to a low-rise single family district, and the fact that a narrow waterway may not be an adequate visual buffer between the two uses. In response to this concern, the proposed amendment to the Zoning Ordinance adds language to Section 6-2, B.7.restricting the height of developments in the RM-1 District that are adjacent to a waterway and within 200 feet of a single family district. This would ensure that those multi-family sites on canals, across from single family homes, would be limited to a maximum height of 40 feet. The attached map delineates which areas would be affected by this amendment. 13 AGENDA ITEM DATE CONCLUSION Along with its recommendation to approve this amendment, the Planning Board also provided direction to the Planning & Zoning Department staff to further study the possibility of expanding this restriction to all sites within multi-family districts that are within 200 feet of a single family district regardless of their location on a waterway. Conceptually, the same rationale should apply to all such situations since it is the juxtaposition of height between multi-family and single family districts which is the real issue. The Administration concurs with this direction, but believes also that the proposed amendment, as presented, should move forward through the approval process since there is a related issue to be addressed.
