Resolution 2019-31062 RESOLUTION NO. 2019-31062 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A WORK ORDER WITH TEAM CONTRACTING INC., IN THE AMOUNT OF $815,000, PLUS AN OWNER'S CONTINGENCY IN THE AMOUNT OF $130,000, FOR A TOTAL AMOUNT OF $945,000; WITH PREVIOUSLY APPROPRIATED FUNDING, FOR THE INSTALLATION OF A NEW EMERGENCY GENERATOR AT THE SCOTT RAKOW YOUTH CENTER AS PART OF THE GENERAL OBLIGATION BOND PROGRAM FOR THIS FACILITY LOCATED AT 2700 SHERIDAN AVENUE, PURSUANT TO THE COMPETITIVELY BID SOURCEWELL COOPERATIVE CONTRACT FOR CONSTRUCTION SERVICES, FORMERLY KNOWN AS NATIONAL JOINT POWERS ALLIANCE (NJPA); AND FURTHER, AUTHORIZING THE DIRECT PURCHASE OF THE NEW GENERATOR AND RELATED EQUIPMENT IN ACCORDANCE WITH SECTION 212.08(6), F.S., AND RULE 12A-1.094, F.A.C. WHEREAS, Job Order Contracting (JOC) is a contracting methodology that enables facility owners to expedite and accomplish a large number of repairs, maintenance and construction projects with a single, competitively bid contract with pre-established pricing for most construction activities; and WHEREAS, the Finance and Citywide Projects Committee (the Committee), on February 21, 2014, endorsed a recommendation by the Administration, as a pilot to reintroduce this efficient process of project delivery to the City, to begin utilizing the Gordian Group's indefinite quantity contract (IQC), alternatively known as JOC, for construction services to expedite the delivery of construction or maintenance projects under $250,000, or for emergency projects, as approved by the City Manager; and WHEREAS, the National Joint Powers Alliance (NJPA), now known as Sourcewell, a national cooperative that bids contracts aggregating the spend volume of agencies across the country, awarded Contract No. 071415-GGI for IQC construction services, and said contract includes an award to Team Contracting, Inc., through the Gordian Group's IQC process, to provide services to the City pursuant to the contract; and WHEREAS, on January 15, 2014, via Resolution No 2014-28462,the City Commission authorized the Administration to utilize cooperative awards by Sourcewell, pursuant to Section 2-369 of the Miami Beach City Code; and WHEREAS, the City's Property Management Department is responsible for administering a project to install an Emergency Generator at the Scott Rakow Youth Center, (the "Project"); and WHEREAS, in order to expedite the completion of the Project, the Administration recommends utilizing the Sourcewell IQC Contract No. 071415-GGI to procure the necessary construction services for the Project; and WHEREAS,Team Contracting, Inc., has been identified as an eligible contractor under the Sourcewell IQC Contract No. FL-SEA-GC04-041019-TCI., as the most qualified and experienced contractor to complete the required scope in a timely manner; and WHEREAS, on November 6, 2018, Miami Beach residents voted to approve a $439 million General Obligation Bond Program to revitalize public spaces, public structures and enhance public security for the future of Miami Beach; and WHEREAS, Scott Rakow Youth Center was identified as part of the General Obligation Bond program; and WHEREAS,facility enhancement includes the installation of an Emergency Generator; and WHEREAS, City staff is currently negotiating the final cost with Team Contracting Inc., in the total amount of$945,000 including an owner's contingency; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the the City Manager to execute a work order with Team Contracting, Inc., in the amount of $815,000, plus an Owner's Contingency in the amount of$130,000.00,for a total amount of$945,000;with previously appropriated funding, for the installation of an emergency generator at the Scott Rakow Youth Center, pursuant to the competitively bid Sourcewell Cooperative Contract for Construction Services, formerly known as National Joint Powers Alliance (NJPA); and further, authorize the direct purchase of the new generator and related equipment in accordance with Section 212.08(6), F.S., and Rule 12a-1.094, F.A.C. BACKGROUND/HISTORY ANALYSIS On November 6, 2018, Miami Beach residents voted to approve a $439 million General Obligation Bond Program to revitalize public spaces, public structures and enhance public security for the future of Miami Beach. The Scott Rakow Youth Center was identified as part of the General Obligation Bond program to be enhanced with the installation of a 1000 kW generator as well as a number of ancillary items such as the automatic transfer switch, enclosure, fuel system and concrete base. The Project procured via the Gordian Indefinite Quantity Contract (IQC) was awarded to Team Contracting Inc. an eligible contractor under the Sourcewell IQC Contract No. FL-SEA GC04-041019-TCI. The installation of Page 203 of 849 the generator will allow the Scott Rakow Youth Center to function as a City designated Emergency Operations Activation (EOA) in the event of a storm or other catastrophe that results in loss of power to the facility. The Job Order Contracting (JOC) is a contracting methodology that enables facility owners to expedite and accomplish a large number of repairs, maintenance and construction projects with a single, competitively bid contract with pre-established pricing for most construction activities. On February 21, 2014 the Finance and Citywide Projects Committee (the Committee) endorsed a recommendation by the Administration to reintroduce this efficient process of project delivery to the City, to begin utilizing the Gordian Group's indefinite quantity contract (IQC), alternatively known as JOC, for construction services to expedite the delivery of construction or maintenance projects under $250,000, or for emergency projects, as apprcved by the City Manager. Sourcewell, formally known as National Joint Powers Alliance (NJPA), a national cooperative that bids contracts aggregating the spend volume of agencies across the country, has awarded Contract No. #071415-GGI for IQC construction services to the Gordian Group. The NJPA contract with the Gordian Group includes a number of contractors prequalified to provide services to the City pursuant to the contract under an IQC pre-priced methodology. In the interest of time, the City has chosen to expedite the Project and utilize the IQC process to procure the necessary construction services for the Project. Through the IQC process, Team Contracting, Inc. ("Contractor")was identified as the most qualified and experienced contractor to complete the identified scope utilizing the Sourcewell IQC Contract No. 071415-GGI to procure the necessary construction services. The City and the Gordian Group met with the Contractor to review the scope for the Project. After negotiations, the Contractor submitted a bid proposal, utilizing the Catalog in the amount of $815,000 for the Project plus an Owner's project contingency of$130,000.00, for the total amount of$945,000. The cost proposal is currently being reviewed and analyzed by the engineer of record, staff, and the Gordian Group to negotiate final cost. Therefore, the Administration believes that it is in the City's best interest to authorize the City Manager to negotiate and execute the work order with Team Contracting, Inc., in the amount of $945,000 including an Owner's contingency with previously appropriated funding for the installation of emergency generator at the Scott Rakow Youth Center, pursuant to the competitively bid Sourcewell Cooperative Contract for Construction Services, formerly known as National Joint Powers Alliance (NJPA). FINANCIAL INFORMATION Previously appropriated as part of the General Obligation Bond project #18 Scott Rakow Youth Center. CONCLUSION The Administration recommends adopting the Resolution.
