RESOLUTION 92-20556 RESOLUTION NO. 92-20556 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER A REQUEST THAT THE CITY EXCHANGE UTILITY EASEMENTS AND, AT OWNER' S COST, PERMIT RELOCATION AND ABANDONMENT OF A 30u SANITARY SEWER FORCE MAIN AND GAS MAIN ON THE PROPERTY LOCATED AT 5900 COLLINS AVENUE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, the City has received a request for the exchange of utility easements, and, at the owner' s cost, permit relocation and abandonment of a 30" sanitary sewer force main and gas main on the property located at 5900 Collins Avenue, and legally described as Tract 3 , and the Westerly extension of Tract 3 of the Bath Club Property, Plat Book 40, Page 14 of the Public Records of Dade County, Fla. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a Public Hearing for consideration of the aforementioned proposed request is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall , 1700 Convention Center Drive, Miami Beach, Florida, beginning at 2: 15 P.M. on the 2nd day of September, 1992 , and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of said Public Hearing in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard. Carat /(AV City Manager Zit SUBJECT: CALLING FOR A PUBLIC HEARING TO CONSIDER EXCHANGES OF UTILITY EASEMENTS AND RELOCATION OF A 30u SANITARY SEWER FORCE MAIN AND GAS MAIN - TRACT 3, BATH CLUB PROPERTY, 5900 COLLINS AVENUE ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission authorize a public hearing to be held to consider the exchange of easements with Edel International Developers, Ltd. , a Florida limited partnership, owners of the property at 5900 Collins Ave. The owner agrees to pay all costs associated with construction of a new 30" sanitary sewer force main and gas main and abandoning the existing 30" force main and gas main. BACKGROUND: Edel International Developers, Ltd. , is proposing construction of a new condominium building on property they own on the west side of Collins Ave at 59th St. There is a 30" sanitary sewer force main existing in a 10 ' wide easement across the center of the property. The owner has requested that the City agree to an exchange of easements and has agreed to pay all costs involved including relocation of the City force main and existing gas main. ANALYSIS: Edel International Developers, Ltd. will pay all costs related to the easement exchange and pipe construction and abandonment. City Staff has evaluated the request and approved construction drawings for the relocation work. CONCLUSION: The exchange of easements and relocation of the 30" force main should be approved with the owners of the property paying all costs.
