A RESOLUTION OF THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA
REQUESTING, PURSUANT TO SECTION 14-1 OF THE
CITY'S ZONING ORDINANCE NO. 89-2665, THAT THE
CITY ADMINISTRATION AND THE PLANNING BOARD
CONSIDER A CHANGE IN THE ZONING DESIGNATION
AND THE PERMITTED USES ALONG BOTH THE NORTH
AND SOUTH SIDES OF FIFTH STREET FROM WEST
AVENUE TO WASHINGTON AVENUE, AND TO FURTHER
REQUEST THE CITY ADMINISTRATION TO UNDERTAKE A
REVIEW OF ALL ZONING REGULATIONS RELATING TO
NIGHTCLUBS AND BARS THROUGHOUT THE CITY.
WHEREAS, the proliferation of nightclubs on Fifth Street has
caused the surrounding residential neighborhoods to be besieged
with problems relating to crime, violence, noise, parking and
littering; and
WHEREAS, the City Commission desires to protect the quality of
life and prevent the deterioration of these residential
neighborhoods; and
WHEREAS, the City Commission requests the Planning and Zoning
Department to undertake changing the zoning to eliminate nightclubs
as a permitted use along Fifth Street from West Avenue to
Washington Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA:
SECTION 1.
That the Planning and Zoning Department undertake changing the
zoning to eliminate nightclubs as a permitted use along Fifth
Street from West Avenue to Washington Avenue, and further, for the
City Administration to undertake a review of all zoning regulations
relating to nightclubs and bars throughout the City.
SECTION 2 .
That the zoning changes recommended by the Planning and Zoning
Department be submitted to the City's Planning Board for
consideration and then on to the City C 'mission for 'nal action.
PASSED and ADOPTED this 16th day .f September , 1992./
