RESOLUTION 92-20596 1 • / RESOLUTION NO: 92-20596 A Resolution of the City Commission of the City of Miami Beach, Florida, authorizing an extension of the existing South Miami Beach Enterprise Zone boundaries pursuant to a bill entitled "An Act Relating to Enterprise Zones", passed during a Special 1992 Legislative Budget Session, and in accordance with Chapter 290. F.S. ; and, authorizing the Metropolitan Dade County Commission to apply to the State of Florida for said extension; and upon approval and certification of said extension by the State of Florida, Resolution No. 86-18504 shall be superseded and rescinded. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: WHEREAS, The Miami Beach City Commission has adopted as a primary city-wide goal the economic development of this community; and WHEREAS, The designation of Enterprise Zones pursuant to Chapter 290 of the statutes of the State of Florida has provided invaluable assistance to this municipality in its effort to achieve the economic development objectives of private sector reinvestment and jobs creation; and WHEREAS, There exists an additional defined geographic area within the corporate limits of the City of Miami Beach which contains a large number of commercial buildings which are deteriorated or deteriorating as well as a large number of substandard housing units which contribute to ill health and pose other potential dangers to their residents; and WHEREAS, The City of Miami Beach desires to maximize the potential for private investment by extending the boundaries of the existing South Miami Beach Enterprise Zone, pursuant to a bill entitled "An Act Relating to Enterprise Zones" , passed during a Special 1992 Legislative Budget Session, which allows local governments one chance to change the boundary of their existing enterprise zones; and WHEREAS, On June 4 , 1986 the Miami Beach City Commission adopted Resolution No. 86-18459 approving the boundaries of a proposed Enterprise Zone; and WHEREAS, On July 9, 1986 the Miami Beach City Commission adopted Resolution No. 86-18504 approving the alteration of the boundaries of said Enterprise zone. WHEREAS, The Miami Beach City Commission now desires to extend the boundaries of said enterprise zone; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that; SECTION 1. The City Commission does hereby declare that the boundaries of the current South Miami Beach enterprise zone shall be extended, pursuant to a bill entitled "An Act Relating to Enterprise Zones" , passed during a Special 1992 Legislative Budget Session, and in accordance with Sections 290. 0055 (3) , (4) , and (5) , F.S. ; and, that such extension is to be effective as provided in Section 10 of this resolution. Page 2 SECTION 2 . That said properties are fully described in "Exhibit A" which is the legal description of the Enterprise Zone including boundary change. SECTION 3 . That "Exhibit B" lists the street and address ranges included in said boundaries. SECTION 4 . That "Exhibits C and D" show the boundaries of the new Enterprise Zone and they show the boundaries of the new zone as compared to the existing zone. SECTION 5. That "Exhibit E, " to be included in this resolution, is an analysis of population affected by the proposed Enterprise Zone boundary change. SECTION 6. That "Exhibit F, " to be included in this resolution, is a list of programs of local participation to be enacted and/or retained in said Enterprise Zone contingent upon State approval within the boundaries of the Enterprise Zone. SECTION 7 . That the City Commission of the City of Miami Beach, Florida states that the level of local participation in the Enterprise Zone approved prior to January 1, 1987 , will not be reduced. SECTION 8 . That the Miami Beach City Commission further requests that the Metropolitan Dade County Commission approve the extension of the current South Miami Beach Enterprise Zone as submitted by the City, and make application to the Office of the Community Program Administrator of the Department of Community Affairs of the State of Florida to certify this area as eligible for benefits contained in 290. 007 (1) , F.S. SECTION 9 . That the Mayor is hereby empowered to execute the required Certification which must accompany the Enterprise Zone boundary change application to be submitted to the State of Florida. SECTION 10. This resolution shall become effective at such time that the State of Florida, Department of Community Affairs, approves and certifies the area as displayed in "Exhibit D" ; and, at such time that the Department of Community Affairs makes its certification, Resolution No. 86-18504 of the City of Miami Beach, Florida, shall be superseded and rescinded. POPULATION ANALYSIS AND RATIONALE FOR BOUNDARY AMENDMENT The proposed extension to the Miami Beach Enterprise Zone would encompass a portion of the North Shore area which, due to a proliferation of low income residents, deteriorated housing stock and an ailing business climate, is designated as a Community Development Target Area. Over 50 percent of the residents in this area have extremely low incomes (less than 50% of the median income for Dade County) , and are predominantly minorities with young children. As a result of this trend, the more affluent owners of single- family dwellings in the North Shore area, have grown discontent with the declining quality of area commercial establishements and now spend most of their shopping dollars elsewhere. By extending the boundaries of the Enterprise Zone, new businesses, investment and development interests seeking to locate within the area will be able to take advantage of the various Federal, State and County financial/tax incentives already available in the current Enterprise Zone. F.S. ; and, authorizing the Metropolitan Dade County Commission to apply to the State of Florida for said extension; and, upon approval and certification of said extension by the State of Florida, Resolution No. 86-18504 shall be superseded and rescinded. ADMINISTRATION RECOMMENDATION The Administration recommends that the accompanying resolution be passed which authorizes an extension of the existing enterprise zone boundary to incorporate the North Shore Community Development target areas, as well as authorizing the Metropolitan Dade County Commission to apply to the State of Florida for said extension. BACKGROUND During a Special 1992 Legislative Budget Session, a bill entitled "An Act Relating to Enterprise Zones" was passed. The bill amended Subsection 290. 0055, F.S. , revising the calculation for the determination of the total population of all areas authorized to be enterprise zones in counties which operate under a home rule charter. The bill also permits local governments with existing enterprise zones to modify the boundaries of these zones provided that the modified zones meet established population size and zoning composition requirements. Modifications to boundaries may only be made once and must be approved by Metro-Dade County prior to submittal to the State of Florida, Department of Community Affairs by September 30, 1992 . Prior to the passage of this bill, the collective population of all areas authorized to be enterprise zones within such a county could not exceed 10 percent of the total population of the county. The bill raised this cap to 12 percent. As a result of this amendment, t} City of Miami Beach has the opportunity to extend the existing Enterprise Zone boundary to incorporate the North Shore Community Development target areas. 18 AGENDA ITEM DATE �! • Page 2 Commission Memorandum No. New and/or expanding businesses within the extended area would therefore be able to benefit from the various federal, state and county financial/tax incentives currently available in the South Miami Beach Enterprise Zone. Also, this designation would improve the North Shore area ' s potential to receive State and/or Federal grants. The creation of the existing Enterprise Zone was authorized by Resolution No. 86-18459 on June 4, 1986 and amended by Resolution No, 86-18504 on July 9, 1986. A map and legal description of the proposed boundary extension as well as a list of the various incentives available to businesses located within the Enterprise Zone are included in the application attached to this resolution. ANALYSIS The concept of connecting the North Shore area with the South Miami Beach enterprise zone via the Indian Creek Waterway, is based upon Perrrine's similar plan to connect with the City of Homstead's established enterprise zone via the median along U.S. AlA. Since there is a statutory cap of 30 on the number of enterprise zones created, and since the State is already at this cap, the two percent increase on the population cap coupled with the opportunity for boundary amendments to existing enterprise zones, affords Perrine the only possibility to become part of the enterprise zone program. Since the validity of the "umbilical" concept will be subject to interpretation by the State of Florida, the City's administration saw this as an opportunity to join forces with Perrine and the City of Homstead to push its acceptance. As such, upon passage and submittalof the accompanying resolution, the City Manager should be authorized to negotiate any boundary adjustments as required by the County and the State of Florida. Commercial zoning districts were calculated as 100% commercial properties; residential zoning were calculated as 100% residential ; mixed use entertainment zoning (MXE) was calculated as 25% residential and 75% commercial . (Please note that, since we were unable to conduct a full-scale existing land use survey due to time constraints, this assumption was made. We believe that it is reasonable, considering the fact that there is a trade-off in residential versus commercial zoning districts in terms of mixed uses. For example, many of the City' s major hotels are located in residential zoning districts. ) It should be noted that the extensive work involved in calculating these figures for the proposed enterprise zone was conducted entirely by Charles Buckles, Senior Plans Designer, who completed this task in a most thorough and professional manner. Avino, P.E . , P.L. S . Zone Expansion FROM: County Manager RECOMMENDATION It is recommended that the Board approve the expansion of the Miami Beach Enterprise Zone, authorizing the County Manager to apply to the Florida Department of Community Affairs for the designation of the revised area as an Enterprise Zone in concurrence with the Resolution passed by the City of Miami Beach, and commit to enact the local participation program approved through Resolution R-1001-86 contingent upon State approval of revised Enterprise Zone. BACKGROUND The Board, on July 15, 1986, through Resolution R-1001-86 approved the creation and filing of an application pursuant to Chapter 290, Florida Statutes, designating certain areas of State Enterprise Zones . Dade County filed and was subsequently approved for three Enterprise Zones : 1 . North/Central Dade (E .Z . No. 1400 B.C. ) 2 . Miami Beach (E . Z . No. 1415 ) and 3 . Homestead/Florida City (South Dade) (E . Z . No. 1406 ) During the 1991 Legislative Session, a bill was passed extending the then expired deadline for the changing of the boundaries of previously approved enterprise zones . The new deadline to apply for State approval of boundary changes is September 30, 1992 . In addition, the State Legislature enacted, earlier this year, an amendment to S . 290 . 0055, F. S . which revised the calculation for the determination of the total population of all areas authorized to be enterprise zones in Dade County, effectively adding two- percent (2% ) to the population percentage allowed as a cap. This amendment was passed at the urging of the Perrine Association, public and civic leaders in Homestead and Florida City and through the effort of South Dade ' s political representation in Tallahassee . In order to take advantage of this window of opportunity for boundary change, the City of Miami Beach is seeking to expand its existing Enterprise Zone and has requested Dade County' s endorsement and cooperation in that endeavor. We have been • Honorable Mayor and Members Board of County Commissioners Page 2 assured that the new expanded Miami Beach Zone will conform to and meet the minimum 40% commercial and 40% residential zoning requirements, as well as the limited population cap. As a separate action, the Board will consider expanding the existing South Dade Enterprise Zone to include the area of Perrine . The City of Miami Beach has pledged to cooperate rather than compete with the South Dade effort and will make sure that its application for expansion will not exceed the available population limit after the South Dade E .Z . application is acted on. The Miami Beach City Commission is to act on a resolution endorsing the expanded Enterprise Zone on September 16 , 1992 , to conform with the instructions established' by the Florida Department of Community Affairs . The Board is hereby requested to endorse the application for expansion for the Miami Beach Enterprise Zone which needs to be submitted to the Department of Community Affairs in Tallahassee. It is also proposed that the Board commit to enact the local participation program approved through Resolution R-1001-86 within the boundaries of the revised zone once it has received State approval . POPULATION ANALYSIS AND RATIONALE FOR BOUNDARY AMENDMENT The proposed extension to the Miami Beach Enterprise Zone would encompass a portion of the North Shore area which, due to a proliferation of low income residents, deteriorated housing stock and an ailing business climate, is designated as a Community Development Target Area. Over 50 percent of the residents in this area have extremely low incomes (less than 50% of the median income for Dade County) , and are predominantly minorities with young children. As a result of this trend, the more affluent owners of single- family dwellings in the North Shore area, have grown discontent with the declining quality of area commercial establishements and now spend most of their shopping dollars elsewhere. By extending the boundaries of the Enterprise Zone, new businesses, investment and development interests seeking to locate within the area will be able to take advantage of the various Federal, State and County financial/tax incentives already available in the current Enterprise Zone.
