RESOLUTION 92-20640 RESOLUTION NO. 92-20640 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND THE CHIEF OF POLICE TO ENTER INTO A COOPERATIVE AGREEMENT BETWEEN THE METROPOLITAN DADE COUNTY SCHOOL BOARD AND THE CITY OF MIAMI BEACH PROVIDING FOR DRUG ABUSE RESISTANCE EDUCATION (D.A.R.E. ) INSTRUCTION BY POLICE PERSONNEL AT THE FOUR DADE COUNTY PUBLIC ELEMENTARY SCHOOLS LOCATED IN MIAMI BEACH. WHEREAS, in accordance with Section 233 . 0663 , Florida Statutes, the D.A.R. E. program curriculum shall be provided as an enhancement to the existing school based substance abuse prevention program, To Reach Ultimate Success Together (TRUST) , to students in the exit grade level of selected elementary schools, and WHEREAS, the City has received grant funding through the D.A.R.E. program for providing such instruction, and WHEREAS, the City of Miami Beach and the Dade County School Board agree to enter into this cooperative agreement for the purpose of providing drug abuse resistance education instruction at the four Dade County Public Elementary Schools located in Miami Beach. NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission hereby authorizes the City Manager and the Chief of Police to enter into a cooperative agreement with the Dade County School Board to provide D.A.R.E. instruction at the four Dade County Elementary Schools located in Miami Beach. METROPOLITAN DADE COUNTY SCHOOL BOARD AND THE CITY OF MIAMI BEACH ADMINISTRATIVE RECOMMENDATION The Administration recommends the approval authorizing the City Manager and the Chief of Police to enter into a Cooperative Agreement between the Metropolitan Dade County School Board and the City of Miami Beach to provide for drug abuse resistance education by police personnel at four Dade County Elementary Schools located in Miami Beach. BACKGROUND The City has received grant funding through the D.A.R.E. program for providing drug abuse instruction to students in the exit grade level of selected Miami Beach Elementary Schools. ANALYSIS The D.A.R.E. program curriculum shall be provided as an enhancement to the existing school based substance abuse prevention program. CONCLUSION This Resolution should be approved in order to provide drug abuse resistance education (D.A.R.E. ) by police personnel at the four Dade County Elementary Schools located in Miami Beach. AGENDA _ i--1ITEM DATE ��� _9 [�� COOPERATIVE AGREEMENT THIS COOPERATIVE AGREEMENT, DATED THIS 11 DAY OF JULY 1991, BY AND BETWEEN THE SCHOOL BOARD OF DADE COUNTY, FLORIDA, LOCATED AT 1450 N.E. 2ND AVENUE, MIAMI, FLORIDA 33132, HEREINAFTER REFERRED TO AS "DCPS" AND MIAMI BEACH POLICE DEPARTMENT LOCATED AT 1100 WASHINGTON AVENUE, MIAMI BEACH, FLORIDA 33132, HEREINAFTER REFERRED TO AS THE "COOPERATING AGENCY." WITNESSETH WHEREAS, in accordance with Section 233.0663, Florida Statutes, the DARE Program curriculum shall be provided as an enhancement to the existing school-based substance abuse prevention program, To Reach Ultimate Success Together (TRUST), to students in the exit grade level of selected elementary schools; NOW,THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt of which is hereby acknowledged, ti-:e parties agree as follows: I. DCPS shall: A. Provide services of the DCPS, Department of Substance Education, TRUST Program, to the Cooperating Agency as follows: 1. recommend applicants to be considered for admission for DARE training as proposed by the Cooperating Agency; 2. represent DCPS at meetings of the DARE Program regarding local, state, and national issues; 3. assist with the development and implementation of the DCPS DARE section of the TRUST Substance Education Procedures Manual (hereinafter referred to as TRUST Manual), attached hereto, and incorporated herein by reference; 4. work cooperatively with the Cooperating Agency to identify school sites for the implementation of the DARE curriculum; 5. identify needs and resources; 6. conduct cooperatively an annual evaluation of the DARE Program pursuant to the standards set forth by Section 233.0663, Florida Statutes; Page 1 of 3 7. provide liaison assistance between the Cooperating Agency and participating schools. B. Provide elementary-level school sites at which the DARE Program shall be implemented, as follows: 1. principals at such schools shall implement the DARE curriculum as outlined in the TRUST Manual; 2. teachers at such schools shall follow the guidelines outlined in the TRUST Manual. II. The Cooperating Agency shall: A. Work cooperatively with DCPS to identify school sites for the implementation of the DARE curriculum; B. Maintain and submit a current list of schools implementing the DARE curriculum; C. Assist with the implementation of the DARE section of the TRUST Substance Education Procedures Manual; D. Provide the necessary funds for approved DARE extracurricular events, unless there is mutual prior agreement regarding other funding arrangements for specific events; E. Cooperatively conduct an annual evaluation of the DARE Program pursuant to the standards set forth by Section 233.0663, Florida Statutes; F. Provide the services of a certified DARE officer who shall comply with the guidelines outlined in the DARE section of the TRUST Manual. Ill. Terms and Compensation: A. The term of this cooperative agreement shall be from July 11, 1991 through and including June 30, 1994. B. Either party may terminate this agreement upon thirty (30) days' written notice to the other. C. This agreement may be amended or modified only by mutual, written consent of both parties. Page 2 of 3 *The following indemnification shall only apply to the extent allowed by law, and in any event only to the limit set forth in Florida Statute 768.28. D. Pursuant to the provisions contained within Section 768.28, Florida Statutes, the Cooperating Agency hereby agrees to indemnify and hold harmless DCPS, its agents, representatives, and employees from and against any and all injury to person or damage to property caused by the sole negligence, gross negligence or willful misconduct of the Cooperating Agency, its agents, representative, and employees.* E. There shall be no exchange of funds between DCPS and the Cooperating Agency to implement the provisions of this cooperative agreement.
