A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA ADOPTING
AN OPERATING BUDGET AND APPROPRIATING
FUNDS FOR THE POLICE CONFISCATION TRUST
ACCOUNT FOR FISCAL YEAR 1992/93 IN THE
AMOUNT OF $182 , 373 . TO BE FUNDED BY THE
PROCEEDS OF CONFISCATED FUNDS.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
WHEREAS, Section 932 . 705, Florida Statutes, addresses the
purposes and procedures to be utilized for the appropriation
and expenditures of the Police Confiscation Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach
has determined that the needs for expenditures and
appropriation exist and the expenditure or appropriation of
forfeiture funds is in compliance with Section 932 . 705; and
WHEREAS, such funds are available in the Police
Confiscation Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, THAT the City Commission
hereby adopts a FY 1992/93 Police Confiscation Fund Budget for
the City of Miami Beach, in the amount of $182 , 373 . (as
reflected in Exhibit 1) .

I, Phillip G. Huber, Chief of Police, City of MIami Beach, do
hereby certify that the aforementioned proposed request for
expenditures from the City of Miami Beach Police Confiscation
Trust Fund, for the 1992/93 Fiscal Year to provide funds for
the salaries of the Police Legal Advisors and Secretary, and
fringe benefits; Property Supervisor and Physical Fitness
Coordinator (1/2 year) ; litigation expenses for the Police
Legal Unit, and operating expenses, complies with the
provisions of Section 932 .705 Florida Statutes.

SUBJECT: POLICE CONFISCATION TRUST ACCOUNT FOR FY 1992/93
The Administration requests permission to adopt an operating
budget of the Police Confiscation Trust Account for FY 1992/93
to appropriate $182, 373 . to be used to provide funds for the
salaries of the Police Legal Advisors and Secretary, and
fringe benefits; Property Supervisor and Physical Fitness
Coordinator (1/2 year) ; litigation expenses for the Police
Legal Unit; and operating expenses.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission adopt
the operating budget for the Police Confiscation Trust Account
and appropriate funding.
BACKGROUND
Florida Statute 932. 705 provides for, but is not limited to,
expenditure of forfeiture funds for crime prevention and other
law enforcement purposes.
ANALYSIS
In accordance with Florida Statute 932 .705, forfeiture funds
have been placed in the Police Confiscation Trust account.
There is currently $300, 000 in open, pending forfeiture cases.
CONCLUSION
The proper procedure has been complied with in accordance with
F.S.S. 932. 705.
