RESOLUTION 92-20648 RESOLUTION NO. 92-20648 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE DADE COUNTY CANVASSING BOARD'S CERTIFICATION OF THE RESULTS OF THE CITY OF MIAMI BEACH SPECIAL ELECTION HELD ON NOVEMBER 3, 1992 AND DECLARING RESULTS THEREOF. WHEREAS, on November 3 , 1992 , Metropolitan Dade County conducted a General Election, at which time the City of Miami Beach authorized the holding of a Special Election; and WHEREAS, by Resolution No. 92-20537 adopted on July 8, 1992 , Resolution No. 92-20538 adopted on July 8, 1992 , Resolution No. 20574 adopted on September 2 , 1992 and Resolution No. 92-20576, adopted on September 2 , 1992 , Dade County Election Officials were authorized to conduct the Special Election of the City of Miami Beach to be held on November 3 , 1992 ; and WHEREAS, the certification of the results of the City of Miami Beach Special Election as submitted by the Metropolitan Dade County Canvassing Board, said certification being dated November 4 , 1992 , has been received and is made a part of this resolution; and WHEREAS, said Certification reflects that Questions "A" , "B" , "C" and "D" as set forth below were approved by the electorate of the City of Miami Beach.* NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that said Certification be and the same is hereby adopted, which reflects the following results upon the questions: A. RUNOFF ELECTION ONE WEEK AFTER GENERAL ELECTION; VICE-MAYOR SELECTED WITHIN THIRTY DAYS FROM RUNOFF. SHALL MIAMI BEACH CITY CHARTER SECTION 8 BE AMENDED TO CHANGE THE RUNOFF ELECTION DATE FROM TWO WEEKS AFTER GENERAL ELECTION TO ONE WEEK AFTER GENERAL ELECTION AND CHANGING VICE- MAYOR SELECTION DATE FROM THREE TO THIRTY DAYS AFTER RUNOFF ELECTION? 14 , 963 YES 5, 244 NO *The four ballot questions have been lettered "A" , "B" , "C" and "D" for purposes of this Resolution only and were not so lettered on the ballot. 1 B. SHALL SECTION 40 OF THE MIAMI BEACH CITY CHARTER BE AMENDED TO CHANGE THE COMMISSION ELECTION QUALIFYING PERIOD FROM NOT MORE THAN ONE HUNDRED AND THIRTEEN DAYS NOR LESS THAN ONE HUNDRED NINE DAYS PRIOR TO SAID ELECTION TO THE FOUR CONSECUTIVE DAYS IMMEDIATELY FOLLOWING THE FIRST MONDAY IN SEPTEMBER, IN THOSE YEARS IN WHICH A GENERAL ELECTION IS HELD? 13 , 572 YES 4 , 654 NO C. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission approve the resolution. BACKGROUND: The City Commission adopted Resolution Numbers 92-20537 , 92-20538 , 92-20574 , and 92-20576 calling for a Special Election to be held on Tuesday, November 3 , 1992 , to consider four changes to the City Charter: > Section 8 : Runoff election one week after General Election; Vice-Mayor selected within thirty days from runoff • Amendment to co,.1 ;nr, a0 of the City Charter changing the qualifying periods for elected office > Section 432: One percent increase in room rent portion of Resort Tax > Section 6: Limitation on sale or lease of park, recreation, or waterfront land located within Miami Beach Pursuant to the resolutions listed above, Dade County Election Officials shall conduct the Special Election, and the Dade County certification of the results of said election shall be accepted by the City Commission of the City of Miami Beach. Upon receipt on November 4, of the Certificate of the County Canvassing Board indicating the Special Election results the companion resolution shall be prepared. CONCLUSION: The resolution prepared by the City Attorney' s Office with the attached Certificate of County Canvassers should be adopted as a reflection of which questions have been approved by the electorate of the City of Miami Beach.
