BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, it is agreed that there are neighborhoods within the City of Miami Beach where physical and social conditions currently exist that foster the existence of slums, blight and blighting influences; and WHEREAS, recipients of assistance from the Housing Authority live in these neighborhoods along with many other low/moderate income individuals as defined by the U.S. Department of Housing and Urban Development; and WHEREAS, the Housing Authority and the City wish to cooperate in the development and implementation of a program for the elimination of adverse physical and social conditions in order to provide better living conditions and an increased quality of life for low/moderate income residents who live in the City; and WHEREAS, on June 10, 1992 , the City in conjunction with the Miami Beach Housing Authority met and developed a Mission Statement for the development of a joint program for community development enhancement in the City of Miami Beach; and WHEREAS, on June 24 , 1992 , via Resolution No. 92-4 , the Miami Beach Housing Authority adopted such Mission Statement; and on July 8 , 1992 , via Resolution No. 92-20542 , the City of Miami Rt r11 anr7 WHEREAS, on July 15, 1992 , representatives from the City of Miami Beach and the Miami Beach Housing Authority, jointly presented the Mission Statement and proposed community development activities, including budgets, to the Area Manager of the U.S. Department of Housing and Urban Development, Region IV, Jacksonville Area Office; and WHEREAS, the Housing Authority wishes to provide certain services, which are only available through the City, and which are not a part of the City's budget and which, but for this Agreement, the City would not provide; and WHEREAS, on November 10, 1992 , the Housing Authority's Board of Commissioners approved the attached Letter of Understanding between the Housing Authority and the City which outlines the specific projects/activities to be undertaken; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby ratify the Letter of Understanding between the City of Miami Beach and the Miami Beach Housing Authority for the development of a joint program for community development enhancement in the City of Miami Beach PASSED AND ADOPTED THIS 18th /DAY OF ov-mbej , 1992 . f jr/A7 1 MAYOR ATTEST: FORMROVED m„„A, LEG EPT. ADMINISTRATION RECOMMENDATION: To adopt the attached Resolution which ratifies the Letter of Understanding between the Miami Beach Housing Authority and the City of Miami Beach for the development of a joint program for community development enhancement in the City of Miami Beach. BACKGROUND: On June 10, 1992, the City Administration in conjunction with the Miami Beach Housing Authority met and developed a Mission Statement for the development of a joint program for community development enhancement in the City of Miami Beach. There are neighborhoods within the City of Miami Beach where physical and social conditions currently exist that foster the existence of slums, blight and blighting influences. Further, recipients of assistance from the Housing Authority live in these neighborhoods along with many other low/moderate income individuals as defined by the U.S. Department of Housing and Urban Development. This Mission Statement (see attached) was adopted on June 24, 1992, via Resolution No. 92-4 by the Miami Beach Housing Authority, and on July 8, 1992, via Resolution No. 92-20542 by the City of Miami Beach. On July 15, 1992, representatives from the City of Miami Beach and the Miami Beach Housing Authority, jointly presented this Mission Statement and proposed community development activities, including budgets, to the Area Manager of the U.S. Department of Housing and Urban Development, Region IV, Jacksonville Area Office. The City and the Housing Authority have had an on-going dialogue since June, 1992, regarding the expenditure of available Housing Authority funds for community development needs related to improving the quality of life for Housing Authority tenants. The attached Letter of Understanding represents the collective recommendations of the City Administration and the Housing Authority Board as approved at their meeting of November 10, 1992 . This document represents a significant dollar commitment on the . part of the Housing Authority Board. AGENDA R-'1- " ITEM DATE COMMISSION MEMO NOVEMBER 18, 1992 PAGE 2 ANALYSIS: The Housing Authority and the City wish to cooperate in the development and implementation of a program for the reduction of adverse physical and social conditions in order to provide better living conditions and an increased quality of life for recipients of Housing Authority programs. On an annual basis, the City and the Housing Authority will determine the appropriate amount of funds, i.e. a financially sound portion of the accumulated reserves of the Housing Authority, to be used for community development activities in areas which demonstrably serve public/subsidized housing. CONCLUSION: It is recommended that the Resolution ratifying the Letter of Understanding between the Miami Beach Housing Authority and the City of Miami Beach be adopted by the City Commission at this meeting in order to undertake these activities as soon as possible. This letter will serve as the Memorandum of Understanding between the Housing Authority and the City of Miami Beach for the time period between 10/1/92 and 9/30/93 . At the outset, it is clearly understood that any activity undertaken with these funds will be consistent with all applicable Federal, State, and Local regulations and rulings, including but not limited to, Florida Statute 421. PROJECTS RECOMMENDED TO BE FUNDED BY THE HOUSING AUTHORITY The following is a description of those projects that the City would like the Housing Authority to consider funding this year, but are not limited to those contained herein: I . BENEFIT FUND The Housing Authority shall contribute into a dedicated fund to be jointly held in the name of the Housing Authority and the City of Miami Beach (requiring signatures from both parties) , a total of $245 , 667 to accomplish support services which will improve the quality of life of Housing Authority tenants and enhance their self sufficiency, as follows: A. RECREATION PROGRAMS 1. Request from Housing Authority: $50, 000 FY 1992-93 The Housing Authority is asked to fund a recreation program at Normandy Isle Park to serve Mr. Howard Galbut Miami Beach Housing Authority November 13 , 1992 Page 2 an estimated 175 youth, specifically in an "After School Program" , January through June, Monday through Friday, 2 : 00 to 6: 00 p.m. , ages K through 6th grade; and a "Summer Program" - June through August, Monday through Friday, 8 : 30 a.m. to 5 : 00 p.m. , ages K through 6th grade. These Recreation Programs will commence in January 1993 for the After School Program, and June 1993 for the Summer Program. Tenants of Section 8 units and other subsidized housing shall be given top priority in these programs. The City, in cooperation with the Housing Authority, will conduct an outreach program publicizing the availability of services and will recruit qualified recipients. Normandy Isle Park is the only public park on Normandy Isle, where there is a concentration of Section 8 units, including Housing Authority projects such as: the Sir Herbert at 1930-1950 71st Street, which contains 35 units; the Twin Waters Apartments at 1955-65 Calais Drive which contains 12 units, and the Cielo Apartments at 1930-40 Marseilles Drive which contains 18 units. As illustrated on the map attached, there are up to 175 subsidized units on Normandy Isle within walking distance to this, the only open space park, in the Normandy Isle area. 2 . City Match: $1, 188,972 in FY 1992/93 in City funds, for such recreation programs as: after school care, summer camp, sports activities, arts and crafts, senior citizen dances, vocational and educational programs, etc. Further, $18 , 900 in FY 92/93 CDBG funds, are available to match Housing Authority funds for the Normandy Isle Park program. Also, the City is funding a youth program in Tatum Park, through a Police grant @ $77 , 000. B. ENHANCED POLICE PROTECTION FOR HOUSING AUTHORITY/SECTION 8 TENANTS : 1. Request from Housing Authority: $115, 267 FY 92/93 - The City of Miami Beach's Police Department will provide enhanced police protection for Housing r , Mr. Howard Galbut Miami Beach Housing Authority November 13 , 1992 Page 3 Authority tenants and Section 8 tenants as follows: 2 officers on 4 ten-hour days, one on Monday through Thursday and one on Wednesday through Sunday. The officers will provide special walking beat patrol services to Rebecca Towers North and South, with availability via beeper. This beat shall be limited to no further than six (6) blocks from Rebecca Towers. The Police will also patrol all Section 8 units in the North Beach area as determined by the Housing Authority's list. The patrol units will also target specific problem corners and intersections in the vicinity of Section 8 units. The two new police officers will be assigned by January 4 , 1993 . The Housing Authority shall provide office space for Police presence within Rebecca Towers. 2 . City Match: The City will continue its other full police patrol services throughout the rest of the City, including the Flamingo neighborhood which has a large number of Section 8 units. C. SUBSIDIZED CHILD CARE: 1. Request from Housing Authority: $46, 800 FY 92/93 - T he Housing Authority is requested to fund child care for residents of assisted housing and other HUD assisted housing programs in the North and South Beach target areas. The City has already found that 10 subsidized child care slots @ $2 , 340 per slot can be provided by Happy Kids Child Day Care Center located at 7118 Byron Avenue, and 10 subsidized child care slots @ $2 , 340 per slot can be provided by the Miami Beach Rainbow Child Day Care Center located at 833 6th Street. These child care services will commence by January 1993 . The City and the Housing Authority will also pursue other qualified providers for additional slots. 2 . City Match: $70 , 000 FY 92/93 - The City, through the CDBG Program has funded the following subsidized child care slots: Miami Beach Rainbow Day Care @ $50 , 000 for 20 slots, Aleph Child Development Center @ $10 , 000 for 6 slots, and the Mr. Howard Galbut Miami Beach Housing Authority November 13 , 1992 Page 4 St. John's Child Care Center @ $10, 000 for 25 variable scholarships. In addition, the City is providing approximately $100, 000 to the Happy Kids Child Day Care Center for interior and exterior renovations. D. ENHANCED CODE ENFORCEMENT: 1. Request from Housing Authority: $33, 600 FY 92/93 - The Housing Authority is requested to provide funds for a South Beach Code Enforcement Officer @ including fringe benefits, with the purpose $33 , 600 These of ins inspecting 1, 000 units annually. P g inspections would be for Section 8 assisted units and other units that affect those persons living in subsidized housing, e.g. a building next to one containing subsidized housing tenants. The Code Enforcement officer will be hired by January 4 , 1993 and will also provide training to Housing Authority inspectors. 2 . City Match: $167, 767 FY 92/93 - The City, through its code enforcement efforts will provide five Code Enforcement Officers: three in the South Beach area and two in the North Beach area. E. JOINT ACCOUNT FOR IMPLEMENTATION The Housing Authority contributions outlined in Section 1, above, will be transferred into the joint account fund by December 15, 1992 , and shall be jointly disbursed by the City and the Housing Authority upon an implementation schedule to be agreed to by the City of Miami Beach and the Housing Authority. Any interest earned shall accrue in favor of the Housing Authority. Any funds not expended in the above categories within a reasonable time, shall be returned to the Housing Authority. II. AFFORDABLE HOUSING JOINT VENTURE FUND A. Request from Housing Authority: $380, 000 FY 92/93 - The aside,Authority shall set within its own funds, $380, 000 during fiscal year 1992/1993 specifically for Mr. Howard Galbut Miami Beach Housing Authority November 13 , 1992 Page 5 the creation. of a joint venture affordable family housing project between the City of Miami Beach and the Housing Authority. The lawful purpose of the Miami Beach Housing Authority must be met by any project herein. The funds may be used for the following activities: Acquisition of land. Demolition of structures. Financial assistance in the form of: Construction loans. Permanent Financing. Grants. The funds may be used towards the construction or renovation of one or more residential development(s) affordable to families earning up to 80% of the Dade County median income and otherwise qualified for assistance from the Miami Beach Housing Authority. The Housing Authority and the City of Miami Beach shall jointly develop a Request for Proposal by January 1, 1993 , and shall jointly select development teams to implement the above project by April 15 , 1993 . The Housing Authority and the City shall jointly provide ongoing supervision during the implementation and development stage. The project to be developed shall be of high quality material and design and offer a living environment conducive to family living. The Housing Authority and the City may use funds to provide educational and similar services to enhance the ability of its low income tenants to maintain and support their units. Notwithstanding the above, the City and the Housing Authority shall consider joint venturing other viable projects as well. CityMatch: $803 , 606 FY 92!93 - The City through the Multi-Family Rehabilitation (HOME) Rental Set-Aside Program @ $437, 000 and the CDBG Multi-Family and Single- Family Famil Rehabilitation Programs @ $366 , 606 will provide funds for rehabilitation. Approximately 18 units of 500 square feet each (assuming new construction, and excluding acquisition isition costs) could be rehabilitated through the HOME Program. Also, approximately 60 units could be rehabilitated utilizing the City's Multi-Family Interest Subsidy Program to buy-down the interest rates. PROJECTS TO BE FUNDED BY THE CITY OF MIAMI BEACH The following is a more complete description of community o ment projects that the City will fund as a match to the development p � Housing Authority's projects previously listed, some of which have been discussed above: Two newP arking lots @ $164 , 000 in the Flamingo Park area. The Multi-FamilyRehabilitation (HOME) Rental Set-Aside Pro ram @ $437 , 000. (Assuming new construction, .and excluding acquisition costs, approximately g • ximatel 18 units of 500 square feet each could be constructed. ) North Shore Single-Family Rehabilitation @ $234 , 000. (Assuming the average rehabilitation cost of $10, 000, C g approximately 23 homes could be rehabilitated. ) Multi-Family, Single-Family Rehabilitation (CDBG) @ $366, 606 both in North Beach and South Beach. (Utilizing the City's Multi-Family Interest Subsidy Program to buy-down the interest rates, approximately 60 units could be rehabilitated. ) North Beach Task Force Public Improvements @ $120, 000. (Activities to be undertaken may include such items as: street lighting, curb and gutter, landscaping, etc. in the same g g' Authority' s funds will be area/streets where the Housing Y expended. ) North Shore Public Area Revitalization @ $3 , 000, 000. If a private match is provided, then approximately 16, 600 square feet could be rehabilitated. ) pP y South Beach Commercial Revitalization & Facades @ $100, 000. (Utilizinga maximum grant of $10, 000 per store front, approximately 10 facades could be renovated. ) The provision of five (5) Code Enforcement Officers: three in the South Beach area and two in the North Beach area @ $167 , 767 . Thep rovision of Park Programs in both the North Beach and South Beach areas @ $1, 188 , 972 . (Examples of park programs include: after school care, summer camp, sports activities, arts and crafts, senior citizen dances, vocational and educational programs, etc. ) Public Social Service programs funded through the Community Development Block Grant (CDBG) Program and General Funds @ $ ' g elderly services,900 e. . child care, vices, congregate and home delivered meals, life sustaining medication, youth services, adult day care, and vocational fee waivers. INDEMNIFICATION OF THE HOUSING AUTHORITY BY THE CITY Should the U.S. Department of Housing and Urban Development take audit exception to specific projects or components of specific projects as discussed above, it is understood that both parties • willP ursue corrective action with all due diligence in order to assure that theP rojects qualify and that audit findings are resolved on a timely basis. Should these efforts fail and should the findings made by HUD be as a result of the City's error in concept or implementation, only then, the City shall as a limitation on recovery indemnify the Housing Authority up to the dollar amount expended and any closeout costs incurred by the Housing ing Authority at that point in time for that specific project. . The City Manager of the City of Miami Beach and the Director of the Housing Authority shall report to their respective Commissioners regarding progress in the previous year, and then receive authority to move ahead with the second year. I am very enthusiastic about the potential for major improvements to the living environment of Housing Authority residents and the tremendously positive image that such a program will create for both our agencies.
