A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR
AND CITY CLERK TO ENTER INTO A HIGHWAY
LANDSCAPING MAINTENANCE MEMORANDUM OF
AGREEMENT WITH THE FLORIDA DEPARTMENT OF
TRANSPORTATION
WHEREAS, many roadside areas and median strips abutting Department of Transportation right-of-
way areas must be maintained and attractively landscaped; and
WHEREAS, the City Commission desires that City of Miami Beach beautify and improve
various rights-of-way areas within the City of Miami Beach by landscaping; and
WHEREAS, the City Commission has authorized the submission of a Florida Department of
Transportation Highway Beautification grant proposal for the Eastern end of the Julia Tuttle Causeway; and
WHEREAS,the City Commission of the City of Miami Beach wishes to authorize the Mayor and City
Clerk to enter into a Highway Landscaping Maintenance Memorandum of Agreement between the City of
Miami Beach and the Florida Department of Transportation for the Eastern end of the
Julia Tuttle Causeway as required for grant submission.
NOW THEREFORE, BE IT DULY RESOLVED by the City Commission of the City of Miami Beach, Florida
that
Section 1. The City Commission of the City of Miami Beach hereby authorizes the Mayor
and City Clerk upon notification of a Highway Beautification Grant award, to enter into a Highway
Landscaping Maintenance Memorandum of Agreement between the City of Miami Beach and the State of
Florida Department of Transportation for the Eastern end of the Julia Tuttle Causeway in substantially the
same form as the example agreement attached hereto.
Section 2. The City Clerk of the City of Miami Beach is hereby directed to distribute copies of this
Resolution to the Department of Transportation as required and to all other persons as directed by the
City Manager.

SUBJECT: Authorization for entering into a Highway Landscaping Maintenance
Memorandum of Agreement with the Florida Department of
Transportation
ADMINISTRATION RECOMMENDATION: The City Administration recommends
adoption of the attached resolution authorizing the Mayor and City Clerk to enter
into a Highway Landscaping Memorandum of agreement with the Florida
Department of Transportation, at such time as the City is notified of a Highway
Beautification Grant Award.
BACKGROUND: At the January 13, 1993 commission meeting authorization was given
to apply for a grant to improve the landscaping at the East end of the Julia Tuttle
Causeway. If we receive the grant a maintenance agreement between the City and
State will have to be signed which sets forth the City's responsibilities with regard
to maintenance. A resolution authorizing the Mayor and City Clerk to enter into
that agreement is required aspart of the applicationprocess for the grant.

ANALYSIS: The Department of Transportation does not provide maintenance for
extensively landscaped areas such as is proposed in the grant application. They
will, if funded by the legislature, pay for maintenance at the same level as provided
for areas where basic mowing and litter removal is all that is needed.
CONCLUSION: If we want improved landscaping in these areas we are required, under
current Department of Transportation policy, to maintain what we install.
