RESOLUTION 93-20735 RESOLUTION NO. 93-20735 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DECLARING ACQUISITION OF THE PROPERTY IDENTIFIED AND DESCRIBED AS LOT 13, BLOCK 18, OCEAN BEACH ADDITION NO. 2, PAGE 56, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA (ALSO KNOWN AS 1337 COLLINS AVENUE) , FOR THE EXPANSION OF THE EXISTING OFF- STREET PARKING FACILITY LOCATED AT 13th STREET & COLLINS AVENUE, DECLARING SAME TO BE A PUBLIC NECESSITY, AUTHORIZING THE ACQUISITION OF SAID PROPERTY BY PURCHASE, DONATION OR THE FILING OF EMINENT DOMAIN PROCEEDINGS AND DECLARATION OF TAKING, AS NECESSARY. WHEREAS, for the purposes of expanding the existing parking facilities located at 13th Street and Collins Avenue, the City of Miami Beach desires to acquire the property within the area located at 1337 Collins Avenue; and WHEREAS, the City Commission desires to approve the selection of the above-described site as the site of the aforementioned parking facility expansion; and WHEREAS, the legal description of the specific property to be acquired is: Lot 13 , Block 18 , of OCEAN BEACH ADDITION NO. 2 , Plat Book 2 , Page 56 , of the Public Records of Dade County, Florida; and WHEREAS, the City Commission finds, determines and declares that it is necessary to acquire fee simple title to the above- described property for use as an off-street parking facility; and WHEREAS, the City Commission determines and declares that acquisition of the above-described property is a public necessity and is necessary, practical and in the best interest of the City of Miami Beach; and WHEREAS, the City Commission finds, determines and declares that the acquisition of the above-described property by purchase, donation, or eminent domain proceedings is for the public use and benefit. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1 . The Mayor and City Commission finds, determines and declares that the matters set out in the foregoing recital; are true and correct and they are hereby incorporated as a portion of this Resolution. Section 2 . The recommendation of the City Manager as to the acquisition of the above-described property as the site for an off-street parking facility is hereby accepted and approved. Section 3 . The City Commission declares that it is necessary to acquire fee simple title to the following legally described property as the site for an off- street parking facility: Lot 13 , Block 18 , of OCEAN BEACH ADDITION NO. 2 , Plat Book 2 , Page 56, of the Public Records of Dade County, Florida. Section 4 . The Mayor and City Commission authorizes the City Manager and the City Attorney, through their staffs or through special counsel engaged for such purposes, to acquire the above-described properties through purchase, donation or through eminent domain proceedings, including declaration of taking. Legally described as: Lot 13 , Block 18, of Ocean Beach Addition No. 2 , Plat Book 2 , Page 56, of the Public Records of Dade County, Florida The sum of SEVEN HUNDRED AND TWENTY-FIVE THOUSAND AND 00/100 DOLLARS ($725,000) is compensation in full for the described property, free of all encumbrances, including liens, mortgages, judgments, contracts for the payment of money, real estate taxes and other governmental levies for all prior years. Seller shall be responsible for documentary stamps, including surtax, and their own attorneys fees. Real estate taxes and prepaid rents shall be prorated to date of closing. All improvements on the described property are included in this offer. This offer for sale is made on the understanding that eminent domain proceedings are about to be instituted as to this property; consequently, this agreement is made to forestall protracted litigation. We understand that this offer is subject to approval of the City of Miami Beach and it can be accepted only by City of Miami Beach Resolution authorizing same. Delivery of possession shall be upon payment of the above amount unless written consent to an extension is received. This sale is subject to the following special conditions: 1. The foregoing is subject to tenants in possession and such leases as the tenants may have. Seller agrees not to enter into any written leases after the date of this offer. 2 . City Manager er SUBJECT: RESOLUTION APPROPRIATING FUNDS, AND ACCEPTING AN OFFER FOR SALE, FOR THE ACQUISITION OF THE PROPERTY LOCATED AT 1337 COLLINS AVENUE TO BE USED IN CONNECTION WITH THE PROPOSED EXPANSION OF THE OFF—STREET PARKING FACILITY AT 13TH STREET AND COLLINS AVENUE ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission adopt the attached resolution appropriating funds from the Parking Impact Fee - Ocean Drive District Acct No. 1558000.341201 and from the Parking Impact Fee - Collins Avenue South District Account No. 1558000. 341216 for a total of $725, 000.00, for the acquisition of the property located at 1337 Collins Avenue (Lot 13, Block 18, Ocean Beach Addition No. 2, as recorded in Plat Book No. 2, Page 56, of the Public Records of Dade County, Florida) . Furthermore, the Administration recommends that the City Commission authorize the Mayor to execute the Offer For Sale submitted by New Patrifam, Inc. , for said acquisition, to be used in connection with the expansion of the off-street parking facility at 13th Street and Collins Avenue. BACKGROUND: The City Administration was approached by representatives of New Patrifam, Inc, owners of the property located at 1337 Collins Avenue, with an offer to sell the subject property for $725, 000. 00. The subject parcel is directly adjacent, and to the north of, the existing Off-street Parking Facility located at 13th Street and Collins Avenue. In light of this offer and being well aware of the need to alleviate the parking situation in the South Beach area, the Administration initiated a process to evaluate the feasibility of expanding the existing facility. During this evaluation, the Administration contracted the services of Mr. Howard Mays from Desmond and Associates of Chicago to assist in the process. Mr. Mays is one of the foremost structural engineers in the parking industry and had already had the opportunity to carefully review the structural soundness of the existing facility. He has analyzed the current design, which includes the subject parcel, and estimates that the new property has the potential for approximately 94 spaces. The addition would expand the existing facility to a new structure with connections on each level, providing for parking bays on either side of the lane. . . .continued 63 AGENDA ITEM DATE March 3, 1993 - 2 - 13th Street Parking Expansion In November of 1992, the Administration requested proposals for appraisal services in connection with the subject property. The firms of Delahanty and Associates and Slack and Johnston were retained to provide the appraisals. ANALYSIS: After an analysis of the appraisal reports, and consultation with both appraisers, it was determined that the market value of the property was $575, 000.00. The Administration considers that the costs associated with an eminent domain action, if pursued, coupled with the current appraised value, would be well in excess of the current $725, 000.00 offer. The issue was presented before the Finance Committee at their meeting of February 23, 1993, and the Committee concurred with the Administrations position, and concluded that the matter be forwarded to the City Commission. CONCLUSION: The Administration considers that the expansion of the 13th Street Parking Facility would provide a much needed increase in the amount of parking spaces currently available in the South Beach area and is seeking authorization from the City Commission to acquire the necessary property to accomplish said expansion. Funds for this acquisition are available form Parking Impact Fee - Ocean Drive District Acct No. 1558000.341201 and Collins Avenue South District Account No. 1558000.341216.
