Resolution 2019-31089 RESOLUTION NO! 2019-31089 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER AND WAIVING, BY 5/7THS VOTE, THE FORMAL COMPETITIVE BIDDING REQUIREMENT,AS PERMITTED IN SECTION 2-367 OF THE CITY CODE, FINDING SUCH WAIVER TO BE IN THE CITY'S BEST INTEREST; AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT FOR THE PURCHASE OF LIFEPAK PRODUCTS, IN THE AMOUNT NOT TO EXCEED $153,248, FOR THE PURPOSE OF STANDARDIZING LIFEPAK DEFIBRILLATOR PRODUCTS UTILIZED BY THE FIRE DEPARTMENT ADVANCED LIFE SUPPORT RESPONSE UNITS; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE FINAL NEGOTIATED AGREEMENT. WHEREAS, the City of Miami Beach Fire Department currently utilizes the Physio-Control LIFEPAK® 15 Defibrillator/Monitor for cardiac monitoring, defibrillation, cardioversion, external cardiac pacing, and other Advanced Life Support functions; and WHEREAS, the Fire Department previously procured LifePak items from Physio-Control pursuant to NASPO Master Agreement: State of Oklahoma Contract SW300 #0K-SW-300 ("the NASPO piggyback"); and WHEREAS, Stryker Sales Corporation ("Stryker") acquired Physio-Control in April 2016, subsequently requiring that all purchase orders be issued to Stryker as of July 30, 2019; and WHEREAS, while Stryker provided documentation that all valid Physio-Control contract pricing would be honored, the City of Miami Beach cannot issue purchase orders to vendors not stipulated in piggyback contracts; and WHEREAS,the City's Fire Department continually utilizes advanced technologies in order to provide cutting edge medical treatment to the citizens and visitors of the City of Miami Beach, particularly those regarding the latest in advanced cardiac diagnosis and treatment; and WHEREAS,the state of the art LifePak 15 monitor-defibrillator offers the current advances in continuous, non-invasive monitoring of carbon monoxide and Oxygen saturation,and enhances the treatment of life-threatening heart attacks by automatic, continuous monitoring of five (5) cardiac leads in the background and immediately alerting the paramedics to changes via the St-Segment Trending feature; and WHEREAS,Stryker(formerly Physio-Control)devices contain exclusive features which strongly benefit the Rescue Division and, by extension, the critically ill patients being treated for cardiac insufficiency, by(I)saving precious time and space,(II)freeing personnel to perform other critical tasks and (III)providing the ability to internally archive up to two hundred (200)waveform cardiac events for later retrieval for Quality Assurance/Quality Control purposes; and WHEREAS,all other existing Fire Department monitoring equipment,including Rescue Division and Ocean Rescue Division Automatic External Defibrillators (AED's)are Stryker products which are compatible; therefore, the City will be able to use the monitors and defibrillators manufacturer service agreement for all related equipment and eliminate the need for multiple service, supply and repair contracts; and WHEREAS, Stryker is the only authorized vendor from which to obtain the LIFEPAK® defibrillator/monitor family of products, including specifically,accessories(batteries and electrodes), repair parts & upgrades, remanufactured devices, and services in Florida; and WHEREAS, the Fire Department obtained pricing for the current need to buy five (5) LifePakl5 from Stryker, in the amount of $153,248, and determined the price to be fair and reasonable; and WHEREAS, all five (5) LifePak15 models will be received during FY 2019; however, these units will be paid, interest free, in the following amounts and during the following fiscal years: adopted FY 2019 ($ 30,649.60), FY 2020 ($61,299.00), and FY 2021 ($61,299.00). NOW,THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA,that the Mayor and City Commission hereby accept the recommendation of the City Manager and waive, by 5/7ths vote, the formal competitive bidding requirement, as permitted in Section 2-367 of the City Code, finding such waiver to be in the City's best interest; and further authorize the City Manager to negotiate an agreement for the purchase of LifePak products, in the amount not to exceed $153,248, for the purpose of standardizing LifePak Defibrillator products utilized by the Fire Department Advanced Life Support Response Units; and further authorize the City Manager to execute the final agreement. RECOMMENDATION In light of the fact that all other existing Fire Department monitoring equipment, including those used by Rescue Division and Ocean Rescue Division, are Stryker products, the purchase of the five (5) LifePakl5 defibrillator products from Stryker will serve to standardize the departmental monitoring equipment and eliminating the need for multiple service, supply and repair contracts. Based upon the foregoing, The City Manager recommends that the Mayor and City Commission waive the formal competitive bidding requirement, by a 5/7ths vote, as permitted under Section 2-367(e) of the City Code, as being in the best interest of the City. Page 241 of 720 The Miami Beach Fire Rescue Department continually uses advanced technologies to provide cutting edge medical treatment to the citizens and visitors of the City of Miami Beach. This is especially true concerning the technology used in advanced cardiac diagnosis and treatment. The state of the art LifePakl5 monitor-defibrillator provides this needed technology for continuous, non- invasive monitoring of carbon monoxide and oxygen saturation. In addition, treatment of life- threatening heart attacks is enhanced by automatic, continuous monitoring of all 12 cardiac leads in the background and immediately alerting the paramedics to changes via the ST-segment trending feature. More importantly, this technology has replaced outmoded LifePakl2 technology which Stryker no longer services as they have been "phased out" of production. The Fire Department presently uses the LifePakl5s on majority of the rescue units and all personnel are competent in its usage. These features integrated within the device strongly benefit the Rescue Division and, by extension, the critically ill patients being treated for cardiac insufficiency by saving precious time and space and by freeing personnel to perform other critical tasks. All of these features, including the ability to internally archive up to two hundred (200) waveform cardiac events for later retrieval for Quality Assurance/Quality Control purposes are exclusive features of the Stryker product. The fact that all other existing Fire Department monitoring equipment, including Rescue Division and Ocean Rescue Division Automatic External Defibrillators (AED's) are Physio-Control products is another important factor. This provides compatibility and eliminates the need for multiple service, supply, and repair contracts. Stryker is the only Monitor/Defibrillator manufacturer that offers service and repairs in the field by in-house authorized Stryker Control technicians. Stryker, is the only source from which to obtain the LIFEPAK®defibrillator/monitor family of products, including specifically, accessories (including batteries and electrodes), repair parts & upgrades, remanufactured devices, and services in Florida. Stryker does not utilize the services of any authorized dealers or distributors in the sale of its products in this market. Funding is available in the amount of$153,248.00 from the Operating Expenditures Account. The Administration recommends that the Mayor and City Commission adopt the attached resolution approving and authorizing the issuance of a Purchase Order to Stryker as the sole source provider of the Lifepak 15 Defibrillator/Monitor in the amount of$153,248.00. Further, Stryker is allowing MBFD to take possession of all five (5) allowing CMB to pay for them over a three-year period. Year one would cost $30,649.60. Year two (2) would cost $61,299.20 and year three (3)would cost the same$61,299.20 with zero percent interest. FINANCIAL INFORMATION All five (5) LifePakl5 models will be received during FY 2019; however, these units will be paid, interest free, in the following amounts and during the following fiscal years: adopted FY 2020 ($30,649.60), FY 2021 ($61,299.00), and FY 2022 ($61,299.00).
