Ordinance 2019-4319 ORDINANCE NO, 2019-4319 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE MIAMI BEACH CITY CODE, ENTITLED "ADMINISTRATION," BY AMENDING ARTICLE III, ENTITLED " AGENCIES, BOARDS AND COMMITTEES," BY AMENDING DIVISION 31, ENTITLED "SUSTAINABILITY COMMITTEE," BY AMENDING SECTION 2-190.142 THEREOF, ENTITLED "COMPOSITION" TO REMOVE THE REQUIREMENT FOR AN APPOINTMENT OF A CITY COMMISSIONER TO THE SUSTAINABILITY COMMITTEE; AND, PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, on October 7, 2008, the Mayor and City Commission of the City of Miami Beach adopted Ordinance No. 2008-3618 (the "Ordinance"), establishing the Sustainability Committee (the "Committee") for the purpose of focusing attention on general environmental improvement trends, or"green initiatives," within the City of Miami Beach; and WHEREAS, the Ordinance, codified in Sections 2-190.140-143 of City's Code of Laws and Ordinances ("City Code"), requires for the Committee to be composed of seven (7) voting members, one each directly appointed by the Mayor and each City Commissioner, and a City Commissioner, to serve as a nonvoting member and as a chairperson of the committee; and WHEREAS, on March 11, 2015, the Mayor and City Commission adopted Resolution No. 2015-28962, establishing a City Commission Committee, the Sustainability and Resiliency Committee, to address issues related to general environmental improvement trends, sustainable development, and green initiatives; and WHEREAS, as there is no longer a need for a City Commissioner to serve as a non- voting member of the Sustainability Committee, Section 2-190.142 must be amended to remove the requirement for an appointment of a City Commissioner to the Sustainability Committee. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. Section 2-190.142 of Division 31, of Article III, of Chapter 2 of the City Code, entitled "Administration," is hereby amended as follows: CHAPTER 2 ADMINISTRATION * * * ARTICLE IV.AGENCIES, BOARDS AND COMMITTEES * * * Division 31. Sustainability Committee Sec. 2-190.142. Composition. The committee shall consist of seven voting members, one each to be directly appointed by the mayor and each city commissioner. A city commissioner, appointed by the mayor, shall terve as a nonvoting mcmbcr and shall also servc as the chairperson of the committee. SECTION 2. CODIFICATION It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Miami Beach City Code. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. SECTION 3. REPEALER All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. SEVERABILITY If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 5. EFFECTIVE DATE.
