A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE
FLORIDA LEGISLATURE TO ENACT SENATE BILL 206,
OR ITS RELATED BILL, HOUSE BILL 161, BOTH
ENTITLED THE "FLORIDA COMPETITIVE WORKFORCE
ACT," OR SIMILAR LEGISLATION THAT WOULD
PROHIBIT DISCRIMINATION IN FLORIDA ON THE BASIS
OF SEXUAL ORIENTATION AND GENDER IDENTITY IN
HOUSING, EMPLOYMENT, AND PUBLIC
ACCOMMODATIONS; AND DIRECTING THE CITY CLERK
TO SEND THIS RESOLUTION TO THE CHAIR AND
MEMBERS OF THE MIAMI-DADE LEGISLATIVE
DELEGATION, THE GOVERNOR, THE SENATE
PRESIDENT, THE HOUSE SPEAKER, SENATOR
ROUSON, AND REPRESENTATIVE TOLEDO.
WHEREAS, Senate Bill 206 ("SB 206") and its related bill, House Bill 161 ("HB
161"), both entitled the "Florida Competitive Workforce Act," have been filed for
consideration during the Florida Legislature's 2020 session by Senator Darryl Rouson (D-
St. Petersburg) and Representative Jackie Toledo (R-Tampa), respectively; and
WHEREAS, both SB 206 and HB 161 would amend the Florida Civil Rights Act
and Fair Housing Act, codified in Chapter 760 of the Florida Statutes, to prohibit
discrimination in employment, housing, and public accommodations on the basis of
sexual orientation and gender identity; and
WHEREAS, the City of Miami Beach prides itself on being a diverse and inclusive
community and has demonstrated a long history of opposing discrimination based on
sexual orientation and gender identity, among other categories; and
WHEREAS, as stated in the City's Human Rights Ordinance, "prejudice,
intolerance, bigotry and discrimination and disorder occasioned thereby threaten the
rights and proper privileges of its inhabitants and menace the very institutions,
foundations and bedrock of a free, democratic society"; and
WHEREAS, in view of the foregoing principles, the City's Human Rights Ordinance
prohibits discrimination in employment, public accommodations, housing, and public
services, on the basis of race, color, national origin, religion, sex, intersexuality, gender
identity, sexual orientation, marital and familial status, age, disability, ancestry, height,
weight, domestic partner status, labor organization membership, familial situation, and
political affiliation; and
WHEREAS, however, Florida state law currently does not offer such protections
on a statewide level to lesbian, gay, bisexual, and transgender Floridians; and
WHEREAS, because Florida law currently fails to prohibit discrimination statewide
on the basis on sexual orientation and gender identity, the lesbian, gay, bisexual, and
transgender Floridians who reside in municipalities and counties with no local protections
are vulnerable to, and without recourse against, such invidious discrimination; and
WHEREAS, nearly 60% of Floridians currently live in counties and municipalities
that have passed measures prohibiting discrimination based on sexual orientation and
gender identity; and
WHEREAS, in addition to ensuring basic fairness and equal treatment for all
Floridians, legislation prohibiting discrimination on the basis of sexual orientation and
gender identity is increasingly seen as essential to attracting the best and brightest to
Florida's workforce; and
WHEREAS, 83% of Fortune 500 companies — many of which do business in
Florida — have adopted comprehensive anti-discrimination policies that offer protections
to persons who are lesbian, gay, bisexual, or transgender precisely because it is good for
business and helps them attract and recruit outstanding talent; and
WHEREAS, the Florida Competitive Workforce Act is supported by Florida
Competes, a coalition of major employers, including 11 Fortune 500 companies AT&T,
CSX, Darden Restaurants, Marriott, NextEra Energy, Office Depot, Raymond James,
Tech Data, Uber, Walt Disney World Resort, and Wells Fargo, along with more than 450
local businesses; and
WHEREAS, a complete list of the companies and businesses across the State that
have united to form the Florida Competes coalition, and to promote and advocate for the
passage of the Florida Competitive Workforce Act, is attached hereto as Exhibit A; and
WHEREAS, a poll conducted by the Bob Graham Center for Public Service in
collaboration with the University of Florida Bureau of Economic and Business Research
found that 73% of respondents support the Florida Competitive Workforce Act; and
WHEREAS, the Florida Competitive Workforce Act has received broad, bipartisan
support in both the House and Senate; and
WHEREAS, to ensure that all Floridians are protected against discrimination on
the basis of sexual orientation and gender. identity or expression, and to ensure that
Florida remains competitive in attracting the best and brightest workers and businesses
to the State, it is imperative that the Legislature take action in the upcoming session to
enact the Florida Competitive Workforce Act or similar legislation that would prohibit
discrimination in Florida on the basis of sexual orientation and gender identity in housing,
employment, and public accommodations; and
WHEREAS, accordingly, the Mayor and City Commission of Miami Beach urge the
Florida Legislature to enact SB 206 or HB 161, or similar legislation that would prohibit
discrimination in Florida on the basis of sexual orientation and gender identity in housing,
employment, and public accommodations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature to enact Senate Bill 206, or its related
bill, House Bill 161, both entitled the "Florida Competitive Workforce Act," or similar
legislation that would prohibit discrimination in Florida on the basis of sexual orientation
and gender identity in housing, employment, and public accommodations; and direct the
City Clerk to send this Resolution to the Chair and Members of the Miami-Dade
Legislative Delegation, the Governor, the Senate President, the House Speaker, Senator
Rouson, and Representative Toledo.
