Resolution 2020-31142 RESOLUTION NO. 2020-31142 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER AND WAIVING, BY 5/7THS VOTE, THE FORMAL COMPETITIVE BIDDING REQUIREMENT, IN ACCORDANCE WITH SECTION 2-367 OF THE CITY CODE, FINDING SUCH WAIVER TO BE IN THE CITY'S BEST INTEREST, AUTHORIZING THE PURCHASE OF BIOLOGICAL ODOR CONTROL SYSTEMS, INCLUDING, MAINTENANCE, REPAIRS AND PARTS, FROM BIOREM ENVIRONMENTAL INC., FOR THE PURPOSE OF STANDARDIZING THE BIOLOGICAL ODOR CONTROL SYSTEMS LOCATED AT THE WASTEWATER PUMP STATIONS CITYWIDE, IN THE NOT TO EXCEED AMOUNT APPROPRIATED FOR SUCH ODOR CONTROL SYSTEMS THROUGH THE CITY'S ANNUAL BUDGET PROCESS. WHEREAS, on July 8, 2015, the Mayor and City Commission awarded a design build construction contract to David Mancini & Sons, Inc. (DMSI), pursuant to Request for Proposal 2014-253-YG, to design and build a 54" redundant sewer force main; and WHEREAS, on December 14, 2016,the Mayor and Commission approved a change order to the agreement which added the refurbishing of wastewater Pump Station No. 1, a biological odor control system from BIOREM Environmental Inc. ("BIOREM"), to treat air pollution emissions and the removal of odor found within organic compounds that may contribute to the surrounding environment; and WHEREAS, BIOREM is an environmental biotechnology company that designs, manufactures various emission control systems; and WHEREAS, the City of Miami Beach Public Works Department has determined that the new odor control system at wastewater Pump Station No. 1, located at 1053 Jefferson Avenue, is performing reliably, and Public Works desires to use this particular biological odor control system, and to use BIOREM citywide to standardize the currently inoperable odor control systems and other wastewater pump stations; and WHEREAS, internal and external stakeholders have complained about the unpleasant odor that wastewater pump stations produce, moreover, when wastewater begins to turn septic, the bacteria in the sewage will begin to produce higher levels of hydrogen sulfide, ammonia, methane, and other odorous substances, which chemicals are corrosive, flammable, difficult to treat, and harmful to the environment; and WHEREAS, at this time, the City has the need to replace non-operating odor control systems at wastewater Pump Station No. 10, located at 28 Venetian Way, wastewater Pump Station No. 15, located at 5100 Pine Tree Drive, and wastewater Pump Station No. 28, located at 300 28th Street, and WHEREAS, standardizing BIOREM citywide for odor control would allow Public Works to continuously and more efficiently design, build, install and maintain odor control systems as needed on wastewater pump stations citywide; and WHEREAS, the benefits to standardizing with the BIOREM system include: (1) assuring consistency, efficiency and reliability for all city wastewater pump stations odor concerns; (2) minimizing the need to use multiple vendors for maintenance issues; and (3) reducing the cost associated with keeping large stock of parts from different manufactures; and WHEREAS, Public Works has collected references from other municipalities where BIOREM Environmental odor control systems have been designed, built, installed and maintained at wastewater pump stations and are successfully operating; and WHEREAS, for the reasons stated herein, and pursuant to Section 2-391 of the-City Code, the Administration recommends waiving the competitive bid requirement, and standardizing BIOREM Environmental Inc. biological odor control systems as the City's standard at wastewater pump stations citywide. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager to waive, by 5/7ths vote, the formal competitive bidding requirement, in accordance with Section 2-367 of the City Code, finding such waiver to be in the City's best interest, authorize the purchase of biological odor control systems, including, maintenance, repairs and parts from BIOREM Environmental Inc., for the purpose of standardizing the biological odor control systems located at the wastewater pump stations citywide, in the not to exceed amount appropriated for such odor control systems through the City's annual budget process. As part of that refurbishing, DMSI installed a biological odor control system from BIOREM Environmental Inc. The Purpose of the odor control system is to treat air emissions and removal of odor found within organic compounds that may contribute to the surrounding environment. BIOREM is an environmental biotechnology company that designs, manufactures various emission control systems. After more than two years the City of Miami Beach Public Works Department has been very pleased with the performance of the new odor control system at wastewater Pump Station No. 1 located at 1053 Jefferson Avenue. It has been both exceptionally effective at removal of odors and very reliable with minimal maintenance required. Public Works desires to use this particular biological odor control system and standardize citywide for repairs of all inoperable odor control systems and other wastewater pump station needs. MANAGER'S DUE DILIGENCE & RECOMMENDATION Based on the foregoing, I recommend that the Mayor and City Commission hereby accept the written recommendation of the City Manager and waive, by 517ths vote, the formal competitive bidding requirement, in accordance with Section 2-367 of the City Code, finding such waiver to be in the City's best interest, , and authorizing the purchase of biological odor control systems from BIOREM Environmental Inc.for the purpose of standardizing citywide wastewater pump stations in the not to exceed amount appropriated annually for these products through the City's budget process. Each system will include an cylindrical, vertical FRP vessel and ancillary components as listed below. The differences between the systems will primarily be the diameter of the Biotrickling filter vessels. PS#10 will have a 36"diameter vessel, PS#15 will have a 72" diameter vessel and PS#28 will have a 48"diameter vessel. The height will be the same for each, approximately 15'. System Performance A. When loaded under average conditions the biofiltration system will achieve at least 99 percent removal of H25 for inlet concentration levels above 10 ppm. For inlet concentration levels less than 10 ppm,the outlet concentration levels shall be less than 0.1 ppm. 'Narranties A. The Manufacturer warrants that the biofilter media will not compact,degrade or decompose for a period of 10 years from the date of Substantial Completion, provided that the system is operated in accordance with the Manufacturer's printed Operation and Maintenance Manuals.
