2003-25309 Reso RESOLUTION NO. 2003-25309 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING $592,239.00 IN CITY OF MIAMI BEACH QUALITY OF LIFE/RESORT TAX FUNDING FROM FISCAL YEAR 2001/2002 (LESS FIVE PERCENT FOR ADMINISTRATIVE CHARGES TO NORTH BEACH DEVELOPMENT CORPORATION) FOR IMPROVEMENTS IN THE NORTH BEACH COMMUNITY; AND REALLOCATING $73,000.00 IN PRIOR YEARS' QUALITY OF LIFE FUNDING, IN THE AMOUNTS OF $15,000.00 FROM FISCAL YEAR 99/00; AND $58,000.00 FROM FISCAL YEAR 00/01; PROVIDING FOR A TOTAL OF $665,239.00 FOR THE PURPOSE OF FUNDING TOURISM ORIENTED PROJECTS IN THE NORTH BEACH AREA AND A FUTURE FUNDING COMMITMENT FROM NORTH BEACH DEVELOPMENT CORPORATION FROM FISCAL YEAR 2002/2003 FOR $25,000.00 FOR THE BYRON CARLYLE THEATER. WHEREAS, in 1992, the City of Miami Beach voters agreed to a one percent increase in the resort tax collection on hotel room rent; and WHEREAS, half of the one percent was to create public incentives for a Convention Center Headquarter Hotel, and the other 50% was designated for the promotion of Quality of Life (Q.O.L.) tourism related activities and facilities; and WHEREAS, that 50% Quality of Life increment has been equally split in thirds for improvements in the North, Middle and South Beach communities; and WHEREAS, the one-third portion available through Resort Tax collections for the North Beach community in Fiscal Year 2001/2002 Quality of Life funds equals $592,239.00, less five percent (5%) for administrative charges to North Beach Development Corporation (NBDC); and WHEREAS, in addition to the $592,239.00, North Beach Development Corporation (NBDC) has reviewed prior years' funds and propose that balances left from Fiscal Year 99/00 (program year five) and $58,000.00 from Fiscal Year 00/01 (program year six) providing for an additional $73,000.00 be included as a reallocation and a part of the 2001/2002 Quality of Life budget; and WHEREAS, the $592,239.00 in Fiscal Year 2001/2002, which includes five percent (5%) for administrative charges to NBDC, plus the reallocated balance of $73,000.00, provides a total of $665,239.00 of Quality of Life funds available through Resort Tax Collections for the North Beach community; and WHEREAS, since 1995, North Beach Development Corporation has assisted the City in prioritizing projects to be implemented; and WHEREAS, a public meeting was held on May 14, 2003, to reach community agreement on how best to expend the $635,627.00 of Fiscal Year 2001/2002 (program year seven) Quality of Life funds available Resort Tax funds for the North Beach community; and WHEREAS, projects totaling $1,033,177.00 were reviewed and prioritized by the North Beach community and the list was reduced to match available funding; and WHEREAS, preference was given to projects with strong tourism components that would clearly benefit both visitors and residents of the North Beach area; and WHEREAS, last year, NBDC also committed funding $55,777.00 of Quality of Life funds from Fiscal Year 2001/2002 Program year seven) to complete the North Shore Tennis Center project. These funds were already approved and authorized by the City Commission through Resolution No. 2002- 25048 on November 13, 2002; and WHEREAS, NBDC Board reviewed and approved the community's recommendations at their May 20, 2003 meeting; and WHEREAS, the Administration and NBDC have not reached consensus on the recommended funding levels for this year's North Beach Quality of Life Program and the City recommends including funding for the Byron Carlyle, Normandy Park, North Beach Canal Cleanups, and All-America City program; and WHEREAS, this recommendation was based on the City Commission's priorities and established commitment toward these projects. In order to accomplish this, the Administration recommends reducing or eliminating funding for the following NBDC recommended projects: Stone Crab Festival, North Beach Art & Culture Thursday Nights, Log Cabin Calendar of Events, NBDC Marketing Campaign, and the NBDC Events Coordinator; and WHEREAS, the Administration recommends recalculating the five percent (5%) that NBDC receives for administration netting out all City of Miami Beach projects that do not require their administrative oversight; and WHEREAS, the City and NBDC agreed that the $25,000 allocation for the Byron Carlyle Theatre was deferred to Year 8 funding, which becomes available for use for this project October 1, 2003; and 2 ~ WHEREAS, $25,000 is now available for NBDC to redistribute toward one or more of this year's applicants; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve the appropriation of $592,239.00 in Fiscal Year 2001/2002 (less $15,799.00, which is the 5% administrative charge for to North Beach Development Corporation) and reallocating $73,000.00 in prior years' Quality of Life funding to be expended on projects as recommended by the City Administration in Appendix A, providing $649,440.00 in available Resort tax funds for the purpose of funding tourism oriented projects in the North Beach area and a future funding commitment from North Beach Development Corporation from Fiscal Year 2002/2003 for $25,000.00 for the Byron Carlyle Theater. In February 2003, I requested North Beach Development Corporation to begin the Quality of Life Fund application process. North Beach Development Corporation advertised the application process in the Miami Herald - Neighbors Beach Section on February 23, 2003; the SunPost on February 27,2003; the application form was posted on the NBDC website; and past applicants were mailed an application. The deadline to submit applications was March 21, 2003. In April 2003, I requested North Beach Development Corporation to begin advertising the public meeting where the North Beach community would make its recommendations for the allocation of the Quality of Life Funds. North Beach Development Corporation advertised the public meeting in the Miami Herald - Neighbors Beach Section on May 11, 2003 and May 8, 2003; the SunPost on May 8, 2003; Meeting Notices were sent to the NBDC database (over 600 people); approximately 600 fliers were distributed throughout the commercial, residential and resort districts; several Condo Associations and Home Owners Associations were informed and either e-mailed or provided with fliers to distribute to its owners (King Cole, Burleigh House, The Manhattan, Normandy Sud. Home Owners Association, St. Tropez, Normandy Shores Homeowners Association, Park View Island etc...); the meeting was posted on the NBDC website in the Community Events section; NBDC Board was e-mailed several times and each board member was asked to tell their neighbors about the meeting. The meeting was held on May 14, 2003 at the Shane Watersports Center. The meeting was called to order at 6:00pm. Barry Klein, President of North Beach Development, opened the meeting with his introduction and then turned the meeting over to me as the chairperson. Barry left immediately after his introduction. The meeting ended five hours later at 11 :OOpm. Because the Quality of Life Fund recommendations are supposed to be a community process, an attendance count was taken at the beginning of the meeting. I felt comfortable proceeding with the meeting given that there were 12 North Beach community members in the room that were not affiliated with the North Beach Development Corporation Board of Directors nor were Quality of Life Fund applicants. Throughout the meeting there were several people who arrived late and several people who left before the meeting adjourned. Listed below is the final count of attendees: 47 total attendees . 24 attendees were North Beach residents, property owners or business owners with no affiliation to NBDC nor were Quality of Life Fund applicants . 21 attendees were Quality of Life Fund applicants (4 of which were also North Beach residents, 1 was both a resident and a NBDC Board Member) . 1 attendee was an NBDC Board Member and North Beach resident . 1 attendee fell into the other category: Miami Dade Commissioner Sally Heyman's Aide I started the meeting by explaining where Quality Of Life Funds come from and what they are required to be used for; specifically "for the promotion of the tourist industry, which shall include, but not be restricted to the following: publicity, bureau activities, promotional events, convention bureau activities, capital improvements and the maintenance of all physical assets in connection therewith." I explained that the North Beach community is privileged each year to recommend to the City Commission on how the community would like to see the Quality of Life Funds allocated. Everyone in the room was provided with a list detailing each project, the amount of Quality of Life Funds applied for and my initial funding recommendations. My recommendations were based on my initial review of the applications. My recommendations were subject to change after hearing each applicant's presentation and discussing each application with the North Beach community. Each applicant was given approximately 5 minutes to present their application, followed by an additional 5 minutes for questions from the community. After all the projects were reviewed, the community in attendance revisited each application to determine if their project met the criteria for Quality of Life Funds, the project's potential impact to North Beach tourism and the project's history, viability and prior success. Some projects were recommended to be funded in full, some funded in part and some no funding at all. I have attached the community's recommendation for your review. Unfortunately there were not enough Year 7 Quality of Life Funds to recommend for each and every applicant. The community in attendance felt that the Shane Water Sport Center's success in the promotion of tourism in the North Beach community was to be recognized and would like the City Commission to pre-approve $35,000 to be allocated from Year 8 Quality of Life Funds for the landscaping project submitted by the Shane Water Sports Center. The community also wants you to know that Robert Childers who applied for the North Beach Triathlon Project and who was recommended for $5,000 has agreed to donate 50% of the proceeds from his event to the Teen Job Corp. Coordinating the long list of presenters while simultaneoL:sly, occhestrating the myriad of different personalities volleying for a chance to offer their suggestions was no easy feat! Although the meeting went on long after any of us had ever anticipated, it appeared that everyone who had something to present or an opinion to expressdid was given an opportunity to do so. Which brings me to my second reason for writing. I realized during that meeting, just how important community gatherings of this type really are, Giving the community a forum to express their feelings about the allocation of money that impacts thelr lives (and the quality of their lives) is something we need to see more of. It's a terrific example of how democracy at the grass roots level should work. So, although at times it seemed like the meeting was never going to end, and although there were moments when it was a bit frustrating having to listen to the personal agendas of some of the residents in attendance, it really was an excellent model of how a community should work. I applaud Horth Beach and the City of Miami Beach for their commitment to making sure that the community is involved with these types of decisions and thank you both again (as well as the N.B.D.C. and the Quality of Life Funding Committee) for all of your efforts in making this possible. ------. The Board supported the recommendations with the following two additions: 1) A 2nd pre-allocation of Year 8 funds for $50,000 was recommended for the City's Capital Improvements Project: "Restroom Buildingfor North Shore Park". 2) NBDC withdrew its application for $15,450 for the "Arts in North Beach Programs" after determining that the $15,000 that was recommended for "North Beach Art & Culture Thursday Nights" was sufficient for "Arts" efforts. The $15,450 was moved to the "Teen Job Corps. Program ", a program that is struggling for funding. When we first introduced the Wise Women Weekend in 1999, although we did offer sleeping rooms, We ex.pected this to be mostly a transient conference with few people staying at the hotel. Much to our surprise, we attracted many more women staying at hotel for the weekend, then we had ever imagined. Today, the Wise Women Weekend has become a hiah profile, locally and nationally known event with .ttendees arriving from around the state and around the country. It has aho gained a reputation as a retreat for women residing in different parts of Florida, wishing to escape for a quick weekend without going far away from home. In 2001, more then 40% of all attendees stayed at the hotel, (25% stayed more then one night). In 2002, more then 65% of attendees stayed eithn at the Radisson Deauville or at neighboring hotels. Here are the ways this event meets the NBDC Quality of Life fundiDa: requirements to promote tourism: 1) The Wise Women Weekend I!enerates tourism revenue and aW3feness of North Beach from attendee participation in the following arells; a. To date NBDC produced 15 events that featured mostly live music and dance as well as for several art exhibits. The events have brought a rich variety of cultural themes to audiences that have included residents of Miami Beach and all parts of DadeIBroward Counties as well as for several tourists staving in Miami Beach hotels. The eyents are advertised considerably through calendar listings of the Miami Herald New Times and Sun Post and they usual Iv receive an article in the Miami Herald's Neighbor's section prior to the event. Several events attracted more than 400 people and have received considerable press coverage. Item SummarY/Recommendation: In 1992, the City of Miami Beach voters agreed to a one percent increase in the resort tax collection on hotel room rent. Half of the one percent was to create public incentives for a Convention Center Headquarter Hotel, and the other 50% was designated for the promotion of Quality of Life (Q.O.L) tourism related activities and facilities. That 50% Quality of Life increment has been equally split in thirds for improvements in the North, Middle and South Beach communities. The one-third portion available through Resort Tax collections for the North Beach community in Fiscal Year 2001/2002 Quality of Life funds equals $592,239.00, less five percent (5%) for administrative charges to NBDC. In addition, NBDC has reviewed prior years' funds and propose reprogramming $15,000.00 from Fiscal Year 99/00 (program year five) and $58,000.00 from Fiscal Year 00/01 (program year six) providing for an additional $73,000.00 be included as a reallocation and a part of the 2001/2002 Quality of Life budget, which provides a total of $665,239.00 of Quality of Life funds available through Resort Tax Collections for the North Beach community. A publiC meeting was held on May 14, 2003, to reach community agreement on how best to expend the available Quality of Life/Resort Tax funds from Fiscal Year 200112002 (program year seven) for the North Beach community. Projects totaling $1 ,033,177 .00 were reviewed and prioritized by the North Beach community and the list was reduced to match available funding. Last year, NBDC also committed funding $55,777.00 of Quality of Life funds from Fiscal Year 2001/2002 Program year seven) to complete the North Shore Tennis Center project. These funds were already approved and authorized by the City Commission through Resolution No. 2002-25048 on November 13, 2002. Subsequently, the City Administration met with NBDC on July 16, 2003 to review their recommendations. The Administration and NBDC have not reached consensus on the recommended funding levels for this year's North Beach Quality of Life Program. ADMINSTRA TION RECOMMENDATION Adopt the Resolution and approve the City Administration's funding recommendations. FUNDING Funding is available from Quality of Life/Resort Tax funding from fiscal year 2001/02 and a reallocation of $73,000.00 from Fiscal Year 1999/2000 and Fiscal Year 2000/01 North Beach Quality of Life funds. ANALYSIS In 1992, the City of Miami Beach voters agreed to a one percent increase in the resort tax collection on hotel room rent. Half of the one percent was to create public incentives for a Convention Center Headquarter Hotel, and the other 50% was designated for the promotion of Quality of Life (Q.O.L.) tourism related activities and facilities. That 50% Quality of Life increment has been equally split in thirds for improvements in the North, Middle and South Beach communities. North Beach Development Corporation (NBDC) is entering year seven of this program. The one-third portion available through Resort Tax collections for the North Beach community in Fiscal Year 2001/2002 Quality of Life funds equals $592,239.00, less five percent (5%) for administrative charges to NBDC. In addition, NBDC has reviewed prior years' funds and propose reprogramming $15,000.00 from Fiscal Year 99/00 (program year five) and $58,000.00 from Fiscal Year 00/01 (program year six) providing for an additional $73,000.00 be included as a reallocation and a part of the 2001/2002 Quality of Life budget. Since 1995, NBDC has assisted the North Beach community in prioritizing projects to be implemented. Participation from all parts of the community is encouraged; public meetings are advertised and held to develop the project "wish list". Consensus is builtthrough these workshops to fund projects that will yield the greatest benefits for the community at large. A public meeting was held on May 14, 2003, to reach community agreement on how best to expend the available Quality of Life/Resort Tax funds from Fiscal Year 2001/2002 (program year seven) for the North Beach community. Of the sixteen (16) individuals in attendance, only five (5) households were represented at the meeting. All others in attendance were project applicants (please refer to Appendix B for the May 14, 2003 community meeting sign in sheet). Projects totaling $1,033,177.00 were reviewed and prioritized by the North Beach community and the list was reduced to match available funding. Preference was given to projects with strong tourism components that would clearly benefit both visitors and residents of the North Beach area. Please see attached Appendix A for a full project list with descriptions and cost estimates. Last year, NBDC also committed funding $55,777.00 of Quality of Life funds from Fiscal Year 2001/2002 (program year seven) to complete the North Shore Tennis Center project. These funds were already approved and authorized by the City Commission through Resolution No. 2002-25048 on November 13, 2002. NBDC Board reviewed and approved the community's recommendations at their May 20, 2003 meeting. Subsequently, the City Administration met with NBDC on July 16, 2003 to review their recommendations. It is standard practice for the Administration to review funding recommendations with advisory boards (Le Community Development Block Grant and Cultural Arts Council) prior to City Commission review and approval to ensure that grant allocations are in line with the City Commission's priorities. Furthermore, despite efforts made by NBDC, the public meeting held on May 14, 2003 failed to have broad community representation, which only emphasized the need for appropriate City Administration and City Commission review. As directed at the Finance and Citywide Projects Committee meeting of July 16, a workshop will be scheduled for the City Commission to review the Quality of Life program and process in its entirety. Discussions at the July 16 meeting with NBDC focused on project funding levels and the administrative set aside of five percent (5%) for NBDC. Unfortunately, the Administration and NBDC have not reached consensus on the recommended funding levels for this year's North Beach Quality of Life Program. The City recommends including funding for the Byron Carlyle, Normandy Park, North Beach Canal Cleanups, and All-America City program. This recommendation was based on the City Commission's priorities and established commitment toward these projects. In order to accomplish this, the Administration recommends reducing or eliminating funding for the following NBDC recommended projects: Stone Crab Festival, North Beach Art & Culture Thursday Nights, Log Cabin Calendar of Events, NBDC Marketing Campaign, and the NBDC Events Coordinator. (Please refer to Appendix A for a full project list, NBDC's Recommendations, and the City Administration's recommendations). Furthermore, the Administration recommends recalculating the five percent (5%) that NBDC receives for administration netting out all City of Miami Beach projects that do not require their administrative oversight. This will reduce their administrative funding from $29,612.00 to $15,786.00 for program year seven and into the future. This reduction was based on the result of an analysis completed by the City, which compared the NBDC's operation to the Cultural Arts Council (CAC) and the Miami Beach Visitor and Convention Authority (VCA). This comparison was done because all three (3) organizations are not- for-profit marketing and granting agencies. The chart below demonstrates the operational and program funding levels of all three (3) organizations over the last three (3) fiscal years and projections for the coming fiscal year. It is for this reason that the Administration recommends recalculating their administrative allocation netting out all City of Miami Beach projects that do not require their administrative oversight. It is also important to note that the City has committed an additional $20,000 from the General Fund and $20,000 from the CDBG fa~ade program allocation toward their administrative operation, plus $2,000 and $3,000 in a Police Grant and CDBG Grant respectively for the Teen Job Corps, which equals an annual City contribution of $110,799 toward operating capital for NBDC. Moreover, the City provides them with an additional $32,000 towards the production of the Miami Beach Festival of the Arts for a total of $72,000. CONCLUSION The Administration recommends approving the Resolution which appropriates $592,239.00 in Fiscal Year 2001/2002 (less $15,786.00, which is the 5% administrative charge to North Beach Development Corporation) and reallocating $73,000.00 in prior years' Quality of Life funding to be expended on projects as recommended by the City Administrations in the Appendix A, providing $649,440.00 in available Resort tax funds for the purpose offunding tourism orielMt d projects in the North Beach area.
