Resolution 2020-31226 RESOLUTION NO. 2020-31226 A RESOLUTION BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER AND DEFERRING THE COLLECTION DATE OF THE ANNUAL PARKING FEE IN LIEU PAYMENTS FOR FY 2021 TO AUGUST 1, 2020, AS WELL AS WAIVE THE INTEREST AND PENALTIES RESULTING FROM THE EXTENSION. WHEREAS, Section 130-133(a)(2) of the Land Development Regulations of the City Code sets forth the billing criteria for those projects that utilize a yearly fee-in-lieu payment plan for required parking impact fees; and WHEREAS, the annual fee-in-lieu payments must be paid in full by June 1 of each year, for as long as the applicable use exists; and WHEREAS, these fees start to accrue interest and penalties on June 2nd, if they are not paid in full; and WHEREAS, in light of the extenuating circumstances associated with the closure of businesses due to the COVID-19 pandemic, a 60-day deferment of the payment of the annual PIF accounts is in the best interests of supporting business and commerce in the City; and WHEREAS, this Resolution would extend the due date for Annual Fee in Lieu Accounts from June 1, 2020 to August 1, 2020, as well as waive the interest and penalties resulting from the extension. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager and defer the collection date of the annual parking fee in lieu payments for FY 2021 from June 1, 2020 to August 1, 2020, as well as waive the interest and penalties resulting from the extension. RECOMMENDATION The administration recommends that the City Commission adopt the Resolution to defer the collection date of the annual parking fee in lieu payments for FY 2021. BACKGROUND/HISTORY Section 130-133(a)(2) of the Land Development Regulations of the City Code sets forth the billing criteria for those projects that utilize a yearly fee-in-lieu payment plan for required parking impact fees. The annual fee-in-lieu payments must be paid in full by June 1 of each year, for as long as the applicable use exists. ANALYSIS The yearly fee-in-lieu payments for required parking impact fees are due on June 1st. Based on the code, these fees start to accrue interest and penalties on June 2nd, if they are not paid in full. In light of the extenuating circumstances associated with the closure of businesses due to the COVI D-19 pandemic,the administration recommends that the City Commission authorize a 60 day deferment of the payment of the annual PI F accounts. This can be done by Resolution (see attached). The attached Resolution would extend the due date for Annual Fee in Lieu Accounts from June 1, 2020 to August 1, 2020, as well as waive the interest and penalties resulting from the extension. If the attached Resolution is adopted, the City would send out the FY 2021 invoices (for June 1, 2020 to May 31, 2021)immediately but allow for payments to be deferred up to 60 days, until August 1, 2020. Additionally, the interest and penalties resulting from the extension would be waived. There are roughly 60 participants in the yearly fee-in-lieu program and a large majority are restaurants, with some hotels, daycares and retail operations that can't provide the required parking. The Annual Fee in Lieu generated approximately$470,000 last year, and we estimated a similar revenue this year. Because of the CON/ID-19 crisis, the administration believes that Page 171 of 435 extending a grace period for the payment of the fee is in order. FINANCIAL INFORMATION The Administration recommends that the City Commission adopt the attached Resolution to defer the collection date of the annual parking fee in lieu payments for FY 2021.
